WHEREAS , it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 10th day of January, 1977, in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
a certain parcel of land, being the property of Laverne W.
Brigham and Shirley M. Brigham, Weld County, Colorado, more
particularly described as follows :
Part of the North Half (N1) of Section 2 , Town-
ship 3 North, Range 68 West of the 6th P.M. , Weld
County, Colorado, being more particularly described
as follow:
Beginning at the North Quarter Corner (No Cor) of
said Section 2 , and considering the North Line of the
Northeast Quarter (NW4) of said Section 2 , as bearing
North 89°25 '26" East, with all other bearings con-
tained herein relative thereto:
Thence North 89 °25 ' 26" East, along said North Line,
990.00 feet;
Thence South 00°09 ' 30" West, 2730. 10 feet;

WHEREAS, the Board of County Commissioners of Weld County,
Colroado, desires to exempt this particular division of land
from the definition of "subdivision" and :subdivided land" pursuant
to its authority under Section 30-28-101 (10) (d) , CRS 1973, as
amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations;

NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by Laverne W. Brigham and
Shirley M. Brigham, be exempt from the definition of, the terms ,
"subdivision" and "subdivided land" pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section
2-1A (3) of the Weld County Subdivision Regulations.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 10th
day of January, A.D. , 1977.
The above and foregoing Resolution was read into the record
and signed on the 12th day of January, A.D. , 1977.

RE: Recorded Exemption 242
Dear Commissioners :
The attached application, plat and related items are in
reference to a request by LaVerne and Shirley Brigham
for a recorded exemption. The parcel of land in question
is described as part of the Ni of Section 2, T3N, R68W of
the 6th P.M. , Weld County, Colorado. The subject property
contains 82. 596 acres of Class II and IV irrigated soils.
The request is to split the property into parcels of 80. 680
acres and 1 .916 acres. The Brighams currently reside on
the 80. 680 acre parcel. Their intent as indicated in a
letter dated December 8, 1976 is to split off the 1 . 916
acre parcel which is to be acquired by their daughter and
son-in-law so that they may be close by to help with the
farming operation. The 1 . 916 acre parcel is separated from
the remainder of their property by a large irrigation ditch.
Based upon the information submitted and the adopted policies
in the county, the Planning Commission staff recommends the
request be approved for the following reasons:
1 . The Town of Mead Planning Commission has indicated
the town has no objections to the approval of this
recorded exemption request .

2. The proposed split conforms with the intent clause
of the recorded exemption (Section 9-2 of the Weld
County Subdivision Regulations) , the intent clause
of the agricultural district (Section 3. 3A of the
Weld County Zoning Resolution) , and the Weld County
Comprehensive Plan since the use would be compatible
with the surrounding agricultural uses .
3. As indicated by Mr. Brigham in his letter dated
December 8, 1976 and as shown on the recorded
exemption plat, the 1 . 916 acre parcel is severed
from the remainder of Mr. Brigham' s property by an
irrigation ditch. The presence of this irrigation
ditch makes farming operations difficult on the
1. 916 acre parcel .
4. The request complies with the provisions of Section
9-4 (A) of the Weld County Subdivision Regulations.
