HomeMy WebLinkAbout20142499.tiff RESOLUTION RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A PORTION OF ALLEY BETWEEN "O" STREET AND "M" STREET - ALICIA FRANCO DE HERRERA, CIO CRISTINA LLERENAS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on August 6, 2014, the Board was presented with a Road Petition from Alicia Franco De Herrera do Cristina Llerenas, PO Box 389, Windsor, CO 80550, a copy of said petition being attached hereto and included by reference, requesting vacation of a portion of right-of-way for a portion of alley between "O" Street and "M" Street, being more fully described as follows: All that part of the 10 foot alley lying between lots 3 and 4, 7 and 8, 14 and 13, 17 and 18, 24 and 23, 27 and 28, 34 and 33, 37 and 38, 44 and 43, 47 and 48, 54 and 53, 57 and 58, 64 and 63 of Espanola Subdivision as found under recorded number's 567919 and 2865205 WHEREAS, at the request of the applicant, the Board continued the matter to August 13, 2014, to allow the applicant's legal counsel to be present, and WHEREAS, the Departments of Public Works and Planning Services have recommended approval of said request since that portion of right-of-way is not needed for the safety and welfare of the traveling public, and WHEREAS, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that the vacation of that portion of right-of-way which is described above will not leave any land adjoining the roadway without an established public road or private access easement connecting the land with another established public road, and WHEREAS, the Board of County Commissioners deems it advisable to vacate said portion of road right-of-way, with said vacation to become effective upon recording as required below. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Road Petition from Alicia Franco De Herrera, c/o Cristina Llerenas be, and hereby is, accepted. I highlighted the alley that the owner on Lot 41 is seeking to vacate. It's the entire alley that is being vacated, correct? The alley is platted as ten (10) feet wide by approx. six hundred sixty three (663) long. When you send out the notices I would make a copy and incorporate this map in color to describe the area being vacated.
