The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by
Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments
made during this phase of the Use by Special Review process may not be all inclusive; as other issues may
arise during the remaining application process.
COMMENTS:
CR 52 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
Section Line: CR 93 (60' right-of-way)
REQUIREMENTS:
Site Plan:
Show 60' of right-of-way for CR 93 section line access.
Access Permit Application Form:
A Weld County Road Access Permit Application Form is included in the packet. It will be required for all new
roads, driveways or other means of providing ingress or egress to lands adjoining County rights-of-way. The
application form shall be completed by the property owner to be accessed from a County road or his/her duly
authorized agent as evidenced by written documentation.
A signature and date will be required to deem the application acceptable and complete.
The FEE is $75.00 for your new access point. (small commercial or oil & gas)
Show the approved access on the plat and label it with the approved access permit number (AP#).
Noxious Weeds:
Should noxious weeds exist on the property or become established as a result of the proposed development,
the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of
the Weld County Code.
Traffic Study:
The applicant in the traffic memo is indicating that there will be semi truck traffic at 30 truck trips, and daily
deliveries/pick-ups at 16 trips.
Drainage Report:
Comment: The applicant submitted a Drainage Letter from Baseline Engineering dated Nov. 2013.
Development Standard: The historical flow patterns and run-off amounts will be maintained on site.
Condition of Approval: The drainage system drawings are required to be stamped and signed by a P. E.
registered in the State of Colorado.

Grading Permit: If more than one acre is to be disturbed, a Weld County Grading Permit will be required prior
to the start of construction.
Flood Hazard Development Standards:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
Improvements and Road Maintenance Agreement:
This document is required for this site. Road maintenance including dust control, damage repair, and triggers
for improvement will be included. (Off-site haul route)

SUBJECT: USR13-0066 Cirde B Land Company,
LLC Non-Commerdal Injection Well
The Environmental Health Division (EH) has reviewed this proposal for Mineral
Resource Development Facilities including: Oil and Gas Support and Service (disposal
and recycling sites for production waste - a Class II Underground Injection Well and an
oil and gas construction lay down/storage yard) in the A (Agricultural) Zone District.
The facility is for a Non-Commercial Class II Injection Disposal Well. There will be
approximately 15 drivers accessing the site on a daily basis. According to EH policy
portable toilets and bottled water are acceptable.
The waste handling plan indicates a dumpster will be provided for trash and emptied by
a local disposal company. The application stipulates that a SPCC plan will be created.
The plan is required to be kept on site at all times. Material Safety Data Sheets were
provided which indicate chemicals that may be stored onsite. The chemicals must be
stored on an impervious surface, and in accordance with manufacturer's
recommendations.
The dust abatement plan indicates access and drive aisles will be graveled and water or
magnesium chloride will be applied if necessary.
An Air Pollutant Emission Notice (APEN) is required.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(APEN) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment to Weld County
Department of Public Health and Environment.
2. The applicant shall submit an updated Groundwater Monitoring Plan to the
Weld County Health Department of Public Health and Environment for review
and approval.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to release of building permits:
1. The facility shall post financial assurance with the COGCC. The financial
assurance shall be adequate to cover a third-party closure of the facility,
including the plugging and abandonment of the well, in accordance with
industry standards, and the removal of all structures (including concrete) on
the facility. The site shall be returned to its original grade. The facility shall
submit evidence to Weld County Department of Public Health and
Environment that the appropriate financial assurance has been obtained.
2. A Detailed Closure Plan shall be submitted to Weld County Department of
Public Health and Environment and the Colorado Oil and Gas Conservation
Commission. The Closure Plan shall include a description of the manner in
which the well will be plugged and abandoned, as well as specific details
regarding reclamation of the property. No structures or equipment associated
with the facility shall remain on the property following closure.
3. Detailed Plans for a concrete unloading pad shall be submitted for approval.
A leak detection system shall be designed and installed beneath the concrete
unloading pad(s) and sump(s). Plans shall be submitted to and approved by
Weld County Department of Public Health and Environment.
4. Detailed plans for the concrete secondary containment structure for all
storage and processing tanks shall be submitted for approval. Secondary
containment volume shall provide containment for the entire contents of the
largest single tank plus sufficient freeboard to allow for precipitation. The
Weld County Department of Public Health and Environment will consider
structures other than concrete, provided a Colorado Registered Professional
Engineer provides a certification indicating that the proposed alternate
containment system meets, or exceeds, the function of a concrete system
with regard to containment, spills, and unintended releases.
5. A copy of the drilling log shall be submitted to Weld County Department of
Public Health and Environment.
6. Solids and sediment will accumulate in the storage tanks. The facility shall
submit a detailed plan that describes the method of how those solids will be
removed, including all on-site handling procedures. The plan shall provide a
commitment to notify the Weld County Department of Public Health and
Environment in writing, in the event the plan is amended. The plan shall be
reviewed and approved by the Weld County Department of Public Health and
Environment.
We recommend that the following requirement be incorporated into the permit as a
condition that must be met prior to operation:
1. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall
be provided to the Weld County Department of Public Health & Environment.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. No disposal of waste other than produced and flowback wastewater from
wells operated by the injection well operator are permitted. Any changes from
this approved use may require an amendment to this Special Use Permit.
2. Analytical waste data and environmental monitoring data shall be made
available to Weld County Department of Health and Environment upon
request. The Weld County Department of Health and Environment reserves
the right to require additional monitoring.
3. The facility shall be constructed and operated to ensure that contamination of
soil and groundwater does not occur. Portable containment, such as drip
pans, shall be utilized when working outside containment areas.
4. All liquid waste received at the facility shall be unloaded on the concrete
unloading pad. The unloading pad and leak detection system shall be
constructed and operated in accordance with the approved design. The
unloading pad shall be cleaned at a frequently that prevents oil and other
waste from building up on the pad. During winter months the pad shall be
maintained free of ice.
5. The Spill Prevention, Control and Countermeasure Plan shall be available on
site at all times.
6. All potentially hazardous chemicals must be handled in a safe manner, in
accordance with product labeling, and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
All chemicals must be stored secure, on an impervious surface, and in
accordance with manufacturer's recommendations.
7. This facility shall adhere to the maximum permissible noise levels allowed in
the Industrial Zone District, as delineated in Section 14-9-30 of the Weld
County Code.
8. Waste materials shall be handled, stored, and disposed of in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The applicant shall operate in accordance with
the approved Waste Handling Plan, at all times.
9. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved Dust
Abatement Plan, at all times.
10.All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored, treated, and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
11.Any contaminated soils on the facility shall be removed, treated or disposed
of in accordance with all applicable rules and regulations.
12.The facility shall comply with the approved groundwater monitoring plan.
13.All storm water, which has come into contact with waste materials on the site,
shall be confined on the site.
14.Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. As employees or
contractors are on site for less than 2 consecutive hours a day; portable
toilets are acceptable. Records of maintenance and proper disposal for
portable toilets shall be retained on a quarterly basis and available for review
by the Weld County Department of Public Health and Environment. Portable
toilets shall be serviced by a cleaner licensed in Weld County and shall
contain hand sanitizers.
15.The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

After reviewing the application and documents submitted the Building Department has the following
comments:
A building and electrical permit will be required, per Section 29-3-10 of the Weld County Code, for any
new above ground structures. A building permit application must be completed and two complete sets of
engineered plans
Buildings and structures shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2012 International Building
Code; 2012 International Mechanical Code; 2012 International Plumbing Code:; 2012 International Fuel
Gas Code; 2006 International Energy Code; 2011 National Electrical Code; 2009 ANSI 117.1
Accessibility Code and Chapter 29 of the Weld County Code.
