NOTARY ATURE (SEAL) AMY MALDONADO My commission expires: 061 --(c;)'/LA NOTARY PUBLIC STATE OF COLORADO NOTARY ID 20084028148 MY COMMISSION EXPIRES SEPT.12,2016 Jul 24 14 12: 17p 9705870337 p. 5 RESOLUTION 2014-_ WHEREAS, the Johnstown Fire Protection District (District), is a Colorado Title 32 Special District of the State of Colorado, duly organized and existing under the Constitution and the laws of the State of Colorado; and WHEREAS, the members of the Board of Directors of the District (Board) have been duly elected, chosen and qualified; and WHEREAS in 1999, the electors of the District approved a ballot issue that provided for an increase of 2.0 mills with 1.0 mills of such tax increase designated solely for "capital funds"; and WHEREAS, the Board has determined that the interests of the District, the public interest, and the financial integrity of the District demand and require that the District seek voter approval (as required by Busse v. City of Golden, 73 P.3d 460 (Colo. 2003) for changing the use of the proceeds from such 1999 special additional mill levy to provide additional funds for the District's general operating expenses to more adequately provide for the public's safety and welfare; and WHEREAS, October 7, 2014, is one of the election dates at which ballot issues may be submitted to the eligible electors of the District pursuant to Sec. 32-1-103 (21) C.R.S. and Sec. 32-1-804, C.R.S.; and WHEREAS, the change of use of the proceeds does not constitute a TABOR election because such ballot question, if approved by the voters, would not create a new tax or a change in tax policy resulting in new tax revenues as explained in Bruce v. City of Colorado Springs, 129 P3d 988 (Colo. 2006); and WHEREAS, it is necessary to submit to the eligible electors of the District, at the election, the proposition of changing the designated and permissible use of the tax proceeds from the 1999 special mill levy; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE JOHNSTOWN FIRE PROTECTION DISTRICT: Section 1. All action heretofore taken (not inconsistent with the provisions of this resolution) by the District and the officers thereof, directed towards the election and the objects and purposes herein stated are, ratified, approved and confirmed. Section 2. The election shall be conducted as a special district mail ballot election pursuant to the Colorado Local Government Election Code, Article 13.5 of Title 1 of the Colorado Revised Statutes., and all laws amendatory thereof and supplemental thereto. Section 3. Missy Sobeski is hereby designated as the District's Designated Election Official. Section 4. The Board hereby authorizes and directs the Designated Election Official to certify the following question in substantially the form hereinafter set forth which shall be submitted to the electors of the District at a special election to be held on October 7, 2014, being the first Tuesday after the first Monday in October: QUESTION 1. If any section, paragraph, clause or provision of this resolution shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this resolution.
