HomeMy WebLinkAbout750020 1785 RESOLUTION WHEREAS, a public hearing was held on November 24, 1975, in a the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Eastman Kodak Company, c/o Rodney D. Knutson, Esq. , Agent, Windsor, Colorado, requesting a change of zone from "I" Industrial District to "A" Agricultural District (Planned Unit Development), and WHEREAS, the petitioner was present and represented by Mr. Rodney D. Knutson, Esq. , and WHEREAS, there was no opposition to the change of zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request of petitioner and studied the recommendations of the Weld County Planning Commission as submitted, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the petition of Eastman Kodak Company, c/o Rodney D. Permission to use the Park access road will be granted only during the duration of the actual drilling operations , ap- proximately two weeks in duration . 2 . A $50 , 000 performance bond to be required prior to using the Park access road. The bond will remain in effect for six months after usage is complete on the road. 3 . A Standard Transport Permit will be needed for each vehicle using the Park access road. The permit will allow one vehicle to enter and leave on the access road for one trip only . A permit will be necessary for each type of vehicle using the access road , including cars and pickups . The driller will accept all liability connected with usage of the park access road. 4 . Right turns only will be permitted for vehicles exiting the Park onto the State Highway . 5 . Z-260-75-11 Eastman Kodak Change of Zone I have reviewed the plan for the proposed change of zone at the Eastman Kodak Plant to allow for drilling operations . It appears to me that the access to this well site is through the Atlas Missile Park and on private roads . I would strongly object to the Missile road being used for access to this well site . We have plotted Site A and Site B on a USGS topo map . It appears that Tract A is at approximate elevation 4735 and Tract B is at approximate elevation 4760 . We estimate that the Poudre River in this vicinity is 4530 or less . It appears that Tract A could be in a flood area. We do not have suf- ficient engineering data to determine the actual elevation of Tract A and the actual elevation of the river in this vicinity , and therefore , we cannot give a definite answer if Tract A is in the flood plain .
