RESOLUTION
WHEREAS, a public hearing was held on November 24, 1975, in
a the chambers of the Board of County Commissioners, Weld County,
Colorado, for the purpose of hearing the petition of Eastman Kodak
Company, c/o Rodney D. Knutson, Esq. , Agent, Windsor, Colorado,
requesting a change of zone from "I" Industrial District to "A" Agricultural
District (Planned Unit Development), and
WHEREAS, the petitioner was present and represented by Mr.
Rodney D. Knutson, Esq. , and
WHEREAS, there was no opposition to the change of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request of petitioner and studied the recommendations of the Weld County
Planning Commission as submitted, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the petition of Eastman Kodak Company, c/o Rodney
D. Knutson, Esq. , Windsor, Colorado, for change of zone from "I"
Industrial District to "A " Agricultural District (Planned Unit Development),
said area being more particularly described as follows:
The following two Tracts of 5. 000 acres each, for a total
of 10. 000 acres, located in the SEI of Section 34, Township
6 North, Range 67 West, of the 6th Principal Meridian, Weld
County, Colorado, being more particularly described as follows:
Considering the east line of the SEI of said Section 34 as bearing
S 29°51'36" E, and with all bearings contained herein relative
thereto:

Commencing at the El corner of the said Section 34; thence
S 65°07'42" W 1555. 56 feet to a point; thence N23°22'12" E 335. 31
feet to the True Point of Beginning of Tract "A ".

is hereby granted under the conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department,
2. All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the zoning resolutions
of Weld County, Colorado.

3. That said change of zone herein is granted on condition that
developer proceed with due diligence to begin development of the area
rezoned and submit plans for such development for the approval of the
Weld County Planning Commission and subsequent recording of said
plans in the office of the County Clerk and Recorder, Weld County,
Colorado.
4. Subject to special conditions as to road usage contained in
letter of September 23, 1975, from the Weld County Engineer, copy of
such letter being incorporated herein and made a part of this Resolution.

SPECIAL CONDITIONS
September 23 , 1975
1 . Permission to use the Park access road will be granted only
during the duration of the actual drilling operations , ap-
proximately two weeks in duration .
2 . A $50 , 000 performance bond to be required prior to using the
Park access road. The bond will remain in effect for six months
after usage is complete on the road.
3 . A Standard Transport Permit will be needed for each vehicle
using the Park access road. The permit will allow one vehicle
to enter and leave on the access road for one trip only . A
permit will be necessary for each type of vehicle using the
access road , including cars and pickups . The driller will accept
all liability connected with usage of the park access road.
4 . Right turns only will be permitted for vehicles exiting the
Park onto the State Highway .
5 . F] gmen will be required for all heavy trucks entering or
leaving the access road at the State Highway .
6 . Access to the well site after drilling is complete will not
be permitted through the County Park.

Answers to the following questions must be submitted in writing with your petition re-
questing a chance of zoning. It is necessary that the planning commission have these
answers to act on your petition.
1 . Is it impractical , impossible, or undesirable to develoi the land according to its
current zoning classification. It is impossible to conduct oil and gas
drilling operations on the subject land under the present industrial
zoning.
2. Would the proposed rezoning benefit the entire County by allowing a typical develop-
ment which is needed and cannot locate in other parts of the County. Yes . The
need for additional oil and gas reserves is a national concern and the
drilling site must be located where the resource is believed to be .
3. Would the proposed rezoning benefit lands adjoining thearea requesting the change.
Yes.
4. What features apply to the property requesting rezoning which make it logical tore-
zone this tract and not to rezone in a similar manner surrounding properties which
may have like land use characteristics. Much of the surrounding land is
already zoned to allow such drilling operations .
5. Why are other areas in the County already zoned according to the requested classi-
fication, unsuitable for the development which is propnced. The drilling
site must be located where the resource is believed to be.
6. What proof of evidence is available that the original rezoning is faulty or that
changing conditions in the area justify rezoning at this. time . The original
zoning is not faulty , but increased oil and gas activity in the area
justify rezoning for a sufficient period of time to extract the resources

Kodak change of zone from Industrial to Agricultural Unit Development. `
This matter has been discussed with Glenn E. Billings , Chairman of the Board
of County Commissioners . He indicated that the missile site road would
not be available for drill rigs , tanker trucks , etc.
Other access routes to Tract B need to be investigated. If this office

We have reviewed the request for rezoning in order that oil and gas drilling
operations will be possible on the Kodak property. We believe that there is
no geologic reason why this rezoning should not be approved and, in fact, there

appears to he a geologic reason why it should. Assurances and methods for preventing
pollution of the local aquifers should be provided by the developer.

I have reviewed the plan for the proposed change of zone
at the Eastman Kodak Plant to allow for drilling operations .
It appears to me that the access to this well site is
through the Atlas Missile Park and on private roads .
I would strongly object to the Missile road being used
for access to this well site .
We have plotted Site A and Site B on a USGS topo map . It
appears that Tract A is at approximate elevation 4735 and
Tract B is at approximate elevation 4760 . We estimate that
the Poudre River in this vicinity is 4530 or less . It appears
that Tract A could be in a flood area. We do not have suf-
ficient engineering data to determine the actual elevation of
Tract A and the actual elevation of the river in this vicinity ,
and therefore , we cannot give a definite answer if Tract A is
in the flood plain .
