WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Highland Park Subdivision has requested that its request for approval of its Final Plat, 4th Addition, be with- drawn, and WHEREAS, the Board of County Commissioners of Weld County, Colorado desires to grant said request. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the request of Highland Park Subdivision for withdrawal of its request for approval of the Final Plat, 4th Addition, be, and hereby is , granted. S-155 : 78 : 12 PLANNING COMMISSION RECOMMENDATION February 20, 1979 Planning Commission, the final plat as presented would not assist orderly, efficient and integrated development ; does not conform with the public improvement plans of the County and City of Greeley ; and does not promote the health, safety and general welfare of the residents of the County in that the final plat does not provide for the design of the future U.S . 34 By-Pass and 47th Avenue interchange . At its meeting on January 9, 1979 the Greeley Planning Commission considered the final plat for Highland Park Fourth Addition and. recommended denial . The recommendation was based on a general finding of the ART staff review and Highway Department that appropriate anticipation of the future interchange planned for 47th Avenue and U.S . 34 was not reflected in the extension of 27th Street . The following problems were identified in the Greeley Planning Commission' s letter dated January 10, 1979 : "The highway ' s interchange plans indicate that 47th Avenue will pass over the U .S . 34 Bypass. This involves develop- ment of a gradiant in 47th Avenue. The projected extension of 27th Street wnould intersect 47th Avenue at a point ten feet below the projected grade . Finally , it is generally considered good practice that street intersections not conflict with turning movements associated with highway on and off ramps . If 27th Street is to be dedicated, then it should be routed north of the present alignment to a point of intersection with 47th Avenue that is beyond the proposed on ramp . " Additionally, our office received the following information in a letter dated February 15 , 1979 , from the Greeley Planning Department staff : "The interchange plans for 47th Avenue and U . S . 34 Bypass were not conceived as recently as August , 1978 . An interchange may have been anticipated in the 1966 free- way agreement . The interchange was recognized as a vital element of the major street plan that was set forth in the 1971 Comprehensive Plan (see page 106 , "Street and Highway Map") . Forty-Seventh Avenue is designated to be a major arterial and U . S . 34 Bypass must continue to function as a freeway . The development of the inter- change and control of access is obviously important to the orderly development of the entire community . Highland Park, Inc . S-155 : 78 : 12 PLANNING COMMISSION RECOMMENDATION February 20, 1979 I would like , therefore , to call to your attention and to the attention of the Weld County Planning Commission the provisions of C .R.S . 1973 31-23-214 (Municipal Sub- division Regulations) . Subdivisions beyond municipal limits must conform with the major street plan as adopted by the municipality. The proposed final plat does not take into account future interchange development . " Finally the Colorado Division of Highways has submitted the following in its letter dated January 5 , 1979 : "Enclosed are Advance Plans for a potential interchange at the intersection of the U. S . 34 Bypass and 47th Avenue . As can be seen on the plans , the Highland Park site would be heavily impacted by the construction of an interchange . The solid and dashed line on the small plan sheet indicates the approximate right of way which would be needed to build the intersection . In addition, the construction of an interchange would involve the elevation of 47th Avenue for the purpose of obtaining a grade separation between it and the bypass. The large plan sheet shows that this would create a grade differential of about 11 feet where 27th Street now meets 47th Avenue . It would be necessary to either cul-de-sac 27th Street or bring it north to intersect 47th Avenue at the existing grade . " The Planning Commission recommends that the final plat be rejected until such time that the applicant is willing to modify the final plat to incorporate the future interchange development in the final plat ' s design. (I) Before any commission exercises the powers set forth in section 31-2_3-213. it shall adopt regulations governing the subdivision of land within its jurisdiction and shall publish the same in pamphlet form, which shall he available for public distribution. or. at the election of the commission, the regulations may he published once each week for three consecutive weeks in the official paper of the municipality or county in which such subdivisions, or any part thereof. are located. Such regulations may provide for the proper arrangement of streets in relation to other existing or planned streets and to the master plan, for adequate and convenient open spaces for traffic, utilities. access of fire fighting apparatus. recreation, light, and air, and for the avoidance of congestion of population, including mini- mum area and width of lots. (I) The commission shall approve or disapprove a plat within thirty days after said plat has been submitted to it: otherwise such plat shall he deemed approved and a certificate to that effect shall he issued by the commission on demand unless the applicant for the commission's approval waives this requirement and consents to an exten- sion of such period. The ground of disapproval of any plat shall he stated upon the records of the commission. Any plat submitted to the commission shall contain the name and address of a person to whom notice of a hearing shall he sent. No plat shall he acted on by the commission without affording a hearing thereon. Notice of the time and place of such hearing shall be sent to said address by registered mail not less than five days before the date fixed therefor. Similar notice shall he mailed to the owners of land immedi- ately adjoining the platted land, as their names appear upon the plats in the county clerk and recorder's office or upon records in the county assessor's office and as their addresses appear in the directory of the municipality or on the tax records of the municipality or county. D. 1966, by and between the DEPARTMENT OF HIGHWAYS of the STATE OF COLORADO, hereinafter called the "Department" , and the COUNTY OF WELD, herein- after called the "County" , WITNESSETH: WHEREAS, under authority of the laws of the United States and of the State of Colorado, by and with the concurrence and approval of the United States Bureau of Public Roads, certain State and Federal funds have been allocated for the purpose of improving portions of relocated ?tate �Highway 6 No. 16, which passes C o • through the County, said improvements being currently known as Project F 007-1(11) , the route and general plan of such project being shown on Exhibit A, which is attached hereto, and by reference incorporated as a part hereof, and WHEREAS, by reason of the volume and speed of traffic on said highway and the particular danger .to the safety of the traveling public by 'collisions between vehicles proceeding in opposite directions thereon or between vehicles at intersections of said • highway with other public highways or at approaches to said highway from private property abutting thereon, the .State Highway Commission has designated said portions of said highway to be a Freeway in accordance with the Statutes of- the State of Colorado duly made • and provided, and • October 11, 1966 F 007-1 (11) Weld County WHEREAS, pursuant to said statutes, the County having juris- diction over the County highways to be affected, desires to agree upon the character and extent to which said County highways are to have ingress to and egress from the arterial lanes of said highway. The Department agrees: A. To make plans and specifications for the project currently designated as F 007-1(11) , but which designation is subject to change, and will let the contract for and supervise the construction of the project, all with funds allocated by the State and Federal Governments and without any expense to the County for such construction. That when and to the extent requested by the Department, it will assist the Department in procuring the necessary rights of way and access rights required for Project F 007-1(11) by either purchase or condemnation in accordance with 120-6-11, CRS '63, provided, however, that payment for said rights of way and access rights is made from State and Federal funds. D. That if the designation of the project is changed as indicated in Paragraph I(A) hereof, this change in no way shall affect the terms of this Agreement. IV. Public ingress to and egress from the arterial lanes of said Freeway to and from other State Highways to be affected, subject to modifications by the Department, shall be permitted only at the following locations shown on Exhibit A. At the intersection of State Highway No. 257 on or near the section corner common to Sections 10, 11, 14 and 15, T. 5 N. , R. 67 W. , Sixth Principal Meridian (Freeway Survey Station 3a3..) to and from both sides of the 's' . Construction: Subdivider shall furnish and install , at its own expense, the subdivision improvements listed on Exhibit "A" which is attached hereto and made a part hereof by this reference, according to the construction schedule set out in Exhibit "B" also attached hereto and made a part hereof by this reference. 3.1 Said construction shall be in strict conformance to the plans and drawings approved by the County and the speci- fications adopted by the County for such public improve- ments. Whenever a subdivision is proposed within three -2- miles of an incorporated community located in the County or located in any adjacent county, the Subdivider shall be required to install improvements in accordance with the requirements and standards that would exist if the plat were developed within the corporate limits of that com- munity. If the incorporated community has not adopted such requirements and standards at the time the subdivision is proposed, the requirements and standards of the County shall be adhered to. If both the incorporated community and the County have requirements and standards , those re- quirements and standards that are more restrictive shall apply. 3.2 Subdivider shall employ, at its own expense, a qualified testing company previously approved by the County to per- form all testing of materials or construction that is re- quired by the County; and shall furnish copies of test re- sults to the County. 3.3 At all times during said construction, the County shall have the right to test and inspect or to require testing and inspection of material and work at Subdivider's expense. Any material or work not conforming to the approved plans and specifications shall be removed and replaced to the satis- faction of the County at Subdivider's expense. 3.4 The Subdivider shall furnish proof that proper arrangements have been made for the installation of sanitary sewer or septic systems, water, gas, electric and telephone services. 3.5 Said subdivision improvements shall be completed, according to the terms of this Agreement, within the construction schedule appearing in Exhibit "B". The Board of County Commissioners, at its option, may grant an extension of the time of completion shown on Exhibit "B" upon application by the Subdivider. 4. Release of Liability: Subdivider shall indemnify and hold harmless the County from any and all suits, actions or claims of every nature and description caused by, arising from, or on account of said con- struction, and pay any and all judgments rendered against the County on account of any such suit, action or claim, together with all reasonable - -3- expenses and attorney fees incurred by County in defending such suit, action or claim. All contractors and other employees engaged in construction of the improvements shall maintain adequate workman's compensation insurance and public liability insurance coverage, and shall operate in strict accordance with laws and regulations of the State of Colorado governing occupational safety and health. 5. Acceptance of Streets for Maintenance by the County: Upon com- pliance with the following procedures by the Subdivider, streets with- in a subdivision may be accepted by the County as a part of the County road system and will be maintained and repaired by the County. 5.1 If desired by the County, portions of street improvements may be placed in service when completed according to the schedule shown on Exhibit "B", but such use and operation shall not constitute an acceptance of said portions. 5.2 County may, at its option, issue building permits for con- struction on lots for which street improvements detailed herein have been started but not completed as shown on Exhibit "B",and may continue to issue building permits so long as the progress of work on the subdivision improvements throughout the development is satisfactory to the County; and all terms of this Agreement have been faithfully kept by Subdivider. 5.3 Acceptance for Partial Maintenance: Upon the completion of the construction of streets within a subdivision according s to Weld County Specifications, the Subdivider shall request in writing that the County Engineer inspect said streets and accept them for partial maintenance by the County. Partial maintenance consists of all maintenance except for actual repair of streets, curbs and gutters and related street improvements. The County Engineer shall accept streets for partial maintenance for a period of one year. Nine months after initial acceptance, the County Engineer shall inspect the subject streets, and notify the Subdivider of any defi- ciencies. The County Engineer shall reinspect the streets after notification from the Subdivider that any deficiencies have been corrected. If the County Engineer finds that the streets are constructed according to County standards , he shall recommend the acceptance of the streets for full main- -4- 1 tenance to the Board of County Commissioners. 5.4 Acceptance of Streets for Full Maintenance: Upon receipt of a recommendation from the County Engineer for acceptance of streets within the subdivision, the Board of County Commis- sioners shall accept such streets as public facilities and County property, and shall be responsible for the full main- tenance of such streets including repair. 6. Improvements Guarantee: Subdivider shall furnish to the Board of County Commissioners as guarantee of compliance with this Agreement, collateral such as, but not limited to, performance or property bonds, private or public escrow agreements, liens on property, deposit of certified funds or other similar surety agreements acceptable to the Board of County Commissioners. The amount of any of the above guarantees shall be set by the Board of County Commissioners and portions of the guarantee may be released upon completion of various portions of the improvements. All or any portion of the guarantee will be released upon completion of the guaranteed improvements according to County standards and the terms of the subdivision plans and plats and, in the case of the streets, upon acceptance of the streets by the County for full maintenance as a part of the County road system. 7. Public Sites and Open Spaces: The Planning Commission and the Board of County Commissioners, upon consideration of vehicular traffic and facilities and the particular type of development proposed in the subdivision, may require the dedication, development and/or reservation of areas or sites of a character, extent and location suitable for pub- lic use for parks, greenbelts or schools , other than subdivision streets and utility easements designated, in accordance with one of the following alternatives, or as specified in the PUD plan, if any: 7.1 The required acreage as may be determined according to Section 8-15-B of the Weld County Subdivision Regulations shall be dedicated to the County or the appropriate school district, for one of the above purposes. Any area so dedi- cated shall be approved by the County or school district, and shall be maintained by the County or school district. 7.2 The required acreage as determined according to Section 8-15-B of the Weld County Subdivision Regulations may be reserved through deed restrictions as open area, the maintenance of which shall be a specific obligation in the deed of each lot -5- di within the subdivison. 7.3 In lieu of land, the Board of County Commissioners may re- quire a payment to the County in an amount equal to the market value at the time of final plat submission of the required acreage as determined according to Section 8-15-B. Such value shall be determined by a competent land appraiser chosen jointly by the Board and the Subdivider. The cash collected shall be deposited in an escrow account to be expended for parks at a later date. 8. Successors and Assigns : This Agreement shall be binding upon the heirs, executors, personal representatives, successors and assigns of the Subdivider, and upon recording by the County, shall be deemed a covenant running with the land herein described, and shall be binding upon the successors in ownership of said land. We have analyzed your development site with regard to this drainage policy and your preliminary site plan drawings and have developed a plan that is compatible to both. Our recommended solution consists of a holding pond located in the northeast corner of the property and which discharges into the existing drainage pattern north along 47th Avenue. This pond is approximately 200 feet square by 3 feet deep. The Rational Method was used to determine the allowable release rate, pond inflow and required pond volume. The pond consists of the area designated on the attached Exhibit 1 . In determining the volume of runoff the area was considered to be 90 percent impervious for the 100 year runoff. This proposed drainage plan complies with the City of Greeley's drainage policy by limiting the discharge to the historical 5 year runoff. Final Plat, Highland Park Subdivision, 4th addition, located in a portion of the SE' of Section 15, Twp. 5N, Range 66W. The site is comprised almost entirely of the soil type Vona loamy sand, 0 to 9 percent slopes. This soil type is quite compatible with the intended planned use. However, the soil is very susceptable to wind erosion and does require vegetative or suitable surface soil protection to prevent wind erosion. The plan did not include any treatment phases of how the site would be developed nor how construction would be staged. Due to severe wind erosion hazard, and due to the fact that the site is presently protected by a very good vegetative cover of adapted grasses, we would suggest that construction be staged to allow for minimum disturbance and removal of the vegetative cover. If minimized dis- turbance is not possible, then temporary cover crops or alternate methods should be explored if the site is to be left unprotected for a long period of time. The prime wind erosion season is usually during the months of February through May, however, wind erosion is possible any time of the year. Enclosed are Advance Plans for a potential interchange at the intersection of the U.S. 34 Bypass and 47th Avenue. As can be seen on the plans, the Highland Park site would be heavily impacted by the construction of an interchange. The solid and dashed line on the small plan sheet indicates the approximate right of way which would be needed to build the interchange. In addition, the construction of an interchange would involve the elevation of 47th Avenue for the purpose of obtaining a grade separation between it and the bypass. The large plan sheet shows that this would create a grade differential of about 11 feet where 27th Street now meets 47th Avenue. It would be necessary to either cul-de-sac 27th Street or bring it north to intersect 47th Avenue at the existing grade. There are presently no plans for building this interchange or acquiring the necessary right of way shown on these plans. We realize that this creates an uncertain situation for the developer, but it is important that we make clear the. possibility of future construction_. in this area. We would appreciate the protection of right-of way `or this structure by reservation, setback, or dedication (preferably the latter) as local zoning laws and regulations permit. 2. If this structure were to be built, the three existing 35-foot access points would be closed. This would be necessary to maintain the safety of the on-ramp for westbound traffic. Under the existing situation, we would also urge that 47th Avenue provide access to this site and that there be no direct access to the U.S. 34 Bypass. Enclosed is a copy of the Freeway Agreement between Weld County and the Department of Highways which specifies the intended public points of ingress and egress for this highway. Construction of the bypass, as the name implies, was to provide for the uninterrupted movement of traffic, rather than direct access for developments adjacent to the roadway. Therefore, the interests of the city and motorists would be best served by the closure of the three access points. 3. We would also like to bring to your attention the impact that highway noise would have on this subdivision and the impact of the fill slope on the storage pond shown on the Drainage Map. Noise impacts would result from the westbound on-ramp, but would not be severe if adequate noise insulation were utilized. The recommendation was based on a general finding of the ART staff review and Highway Department that appropriate anticipation of the future interchange planned for 47th Avenue and U. S . 34 is not reflected in the extension of 27th Street . More specifically, the following problems should be noted prior to final approval : 1. The extension of 27th Street to 47th Avenue will have the affect of splitting a total commercial parcel of 22 acres . Without having considered site development plans , the splitting of a commercial parcel in this manner is not considered to be a good practice. A 1964 zoning plat indicated that the street would not pass between the two commercial parcels and that 26th Street would be dedicated from 49th Avenue east to 47th Avenue at the north end of the total 22 acre commercial parcel . 2 . The above mentioned concern for fragmentation of the total commercial development area is further highlighted by the fact that interchange plans prepared in August , 1978 by the Highway Department would indicate that up to one-half of the subject 9 . 7 acre parcel will be taken up in highway right-of-way . "A COMMUNITY OF PROGRESS" 1 Chuck Cunliffe Page 2 January 10 , 1979 The necessity for extension of 27th Street under these circum- stances is not apparent. 3. The highway' s interchange plans indicate that 47th Avenue will pass over the U. S . 34 Bypass . This involves development of a gradiant in 47th Avenue. The projected extension of 27th Street would intersect 47th Avenue at a point ten feet below the projected grade . 4 . Finally, it is generally considered good practice that street intersections not conflict with turning movements associated with highway on and off ramps . If 27th Street is to be dedicated, then it should be routed north of the present alignment to a point of intersection with 47th Avenue that is beyond the proposed on ramp . These are preliminary concerns that do not appear to have been addressed in the final plat . Those present were Commissioners Cummins, Keirnes, Brown, Modlin, and Roeth. I. APPROVAL OF MINUTES Commissioner Keirnes made a motion to approve the minutes of the previous meeting as mailed. Commissioner Modlin seconded the motion. Vote was taken and the motion carried unanimously. II. CORRECTION OF DIMENSION FIGURES OF THE EAST LINE OF BLOCK 7, LOTS 1-13, AND REPLAT OF LOT 5, BLOCK 6, PHEASANT RUN, SECOND FILING LOCATION: 100 Block of 44th Avenue and 43rd Avenue Court Sam Sasaki, Planning Director, noted that the correction takes place in dimensions and distances on the plat. He pointed these out for the Commission. Commissioner Cummins made a motion to approve the correction plat as submitted. Commissioner Modlin seconded the motion. REFERRAL FROM WELD COUNTY: RECORDED EXEMPTION LOCATION: "C" Street and 71st Avenue Mr. Sasaki noted that this is a lot split according to the County subdivision requirements. In reviewing this request, staff checked back with the original subdivision plat of J-B Acres from 1973. The lot split does not appear to be detrimental to the subdivision and so staff recommends that the Commission recommend no objections to the County on this item. Jim Shelton, attorney for the applicants, explained that application was made to the County for the lot split and that the use of the property is strictly residential. Chairman Dietz asked if this would affect access to the property. Mr. Shelton replied that it would not. Commissioner Keirnes made a motion to recommend to the County that they have no objections to this request. Commissioner Roeth seconded the motion. Vote was taken and the motion carried unanimously. Corner of U.S. 34 Bypass and 47th Avenue Mr. Sasaki explained that this request would accomplish both the setting of boundaries of the commercial area and dedication of 27th Street. Staff is recommending that this item be recommended for denial at this time because the 34 Bypass at this point is on both sides.
