WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on July 16, 2014, the Board of County Commissioners approved the application of Swink Family Farms, LLLP, 37153 Dickerson Run, Severance, CO 80550, do Encana Oil and Gas (USA) Inc., 370 17th Street, Suite 1700, Denver, CO 80202, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0017, for Mineral Resource Development Facilities, including Oil and Gas Support and Service Facilities (centralized liquids management facility, and the transloading of a commodity from one mode of transportation to another, including truck and pipeline without limitation for oil and gas industries, including petroleum products and storage related to same, new offices and support buildings, and related equipment; temporary staging area and lay down yard for construction materials, construction office trailers, and construction parking) in the A (Agricultural) Zone District, on the following described real estate, being more particularly described as follows: Part of the E1/2 of Section 21, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, Condition of Approval #1.M.10 was approved, to read as follows: "1.M. PAGE 2 WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, studied the request of the applicant and the recommendation of the Weld County Department of Planning Services and, having been fully informed, finds Condition of Approval #1.M.10 shall be amended to read as follows: "The Haul Route from the HUB facility designated desi nated to be onto County Road 6, east to the intersection of County Roads 6 and 7, north on County Road 7 to County Road 8, east on County Road 8 (Erie Parkway). Inbound truck traffic is designated to be west on County Road 8 (Erie Parkway) to County Road 7, south on County Road 7 to the intersection of County Roads 7 and 6, west on to County Road 6 to the HUB facility. In no event shall the haul route include County Road 6 between County Road 7 and the 1-25 Frontage Road.", and WHEREAS, the Board of County Commissioners also finds it necessary to add a new Condition of Approval #1.M.16 to read as follows: "Additional signage shall be posted at the access point to County Road 6 indicating the haul route and restrictions." NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Condition of Approval #1.M.10 for Use by Special Review Permit, USR14-0017, on the hereinabove described parcel of land be, and hereby is, amended as stated above. BE IT FURTHER RESOLVED by the Board that a new Condition of Approval#1.M.16 for Use by Special Review Permit, USR14-0017, on the hereinabove described parcel of land be, and hereby is, added as stated above. Liquids Handling Hub, USR14-0017 Date: September 30, 2014 The Department of Planning Services received a request from Miracle Pfister, Manager, DJ Basin Regulatory for Encana Oil & Gas (USA) Inc., dated September 24, 2014 requesting consideration for modifying the heavy haul truck traffic into and out of the facility to be known as the Encana Liquids Handling Hub, USR14-0017. Per the Board of County Commissioners Resolution (2014-2060) dated July 16, 2014. Currently the permit requires: The Haul Route into the site for heavy truck traffic i s designated to be from County Road 8, also known as Erie Parkway, south to County Road 7 and west into the site. The designated access for heavy truck traffic shall be off of County Road 7. The Haul Route out of the site is designated to be east from the site onto County Road 7, and north to County Road 8, also known as Erie Parkway." (Resolution 2014-2060, Condition 1.M.1O) Encana Oil & Gas (USA) Inc., respectively requests consideration of a modification to the heavy haul truck traffic into and out of the facility. The Haul Route for all outbound truck traffic from the HUB facility is designated to be onto County Road 6, east to the intersection of County Road 6 and County Road 7, north on County Road 7 to County Road 8 east on County Road 8 (Erie Parkway). Inbound truck traffic is designated to be west on County Road 8 (Erie Parkway) to County Road 7, south on County Road 7 to the intersection of County Road 7 and County Road 6,west onto County Road 6 to the HUB facility. Liquids Handling Hub(USR14-0017) Dear Kim: Encana Oil & Gas (USA) Inc. is currently developing its Liquids Handling Hub ("Hub") located near Erie, Colorado. The planned facility is located on the northwest corner of the intersection of Weld County Road 6 and Weld County Road 7. A Use by Special Review (USR) permit was heard and approved by the Weld County Board of County Commissioners on July 16, 2014 (resolution 2014-2060). As you know, during that proceeding there was considerable discussion regarding the Hub's planned haul route. As a result of that discussion, the Board of County Commissioners approved the USR with a condition to change the site's access point from CR 6 to CR 7, specifically stating: "The Haul Route into the site for heavy truck traffic is designated to be from County Road 8, also known as Erie Parkway, south to County Road 7 and west into the site. The designated access for heavy truck traffic shall be off of County Road 7. The Haul Route out of the site is designated to be east from the site onto County Road 7, and north to County Road 8, also known as Erie Parkway." (Resolution 2014-2060, Condition 1.M.) Based on the traffic analysis commissioned by Encana and discussions with Erie and Weld County officials, we are now all in agreement that utilizing CR 8 (Erie Parkway) and CR 7 is the most appropriate haul route for associated Hub traffic. Both CR 8 and CR 7 were designed to manage higher levels of traffic and based on the traffic analysis, represent the best and safest access for the Hub. However, after additional review of the above condition, we respectfully request that Weld County allow Encana's Hub related truck traffic to enter and exit the Hub from a proposed entrance located on CR 6 approximately 600 feet west of CR 7. This short section of CR 6 is non-residential (see the attached map). Encana believes that this minor alteration to the Resolution condition still accomplishes the Commission's goal of impacting as few neighbors as possible. Here's a summary of the factors that contributed to our request: 1) As it stands today, the planned and approved (Weld County USR14-0017) access point is located in the middle of an incline on CR 7. Given existing topography and drainage of the Hub property, it is the only feasible location for an access point yet it creates an unsafe situation for not only existing, but proposed traffic as it limits the driver's view of existing and oncoming traffic. 2) Any access location on CR 7 necessitates that all trucks entering CR 7 from the Hub must enter the roadway from a dead stop and need to accelerate north up the incline. This increases the likelihood of collisions for vehicles traveling north or south on CR 7. 3) The traffic analysis submitted with the USR recommended Hub access on CR 6 as the best and safest access point. 4) Encana is also prepared to discuss what improvements may be needed to CR 6 in front of its property in coordination with the Town of Erie. In summary, Encana formally requests a consideration solely on condition 1.M. of Resolution 2014-2060 for USR14-0017. We respectfully request that Encana associated traffic be allowed to enter and exit the site from CR 6, west of CR 7. The primary haul route will remain north on CR 7 to Erie Parkway/CR 8. Hub related traffic will be restricted to utilizing CR 6 for the approximate 6O0 feet west of CR 7. This non-residential portion of CR 6 (along the Hub parcel) is located within and maintained by the Town of Erie. No Weld County maintained roads will be used. You provided comments to Weld County on May 19, 2014 as part of their referral review period. We have been happy to work with you on these issues and are pleased we have reached a compromise on most items. Below you will find a summary and reminder of how each item was addressed. Please let me know if you have additional questions or comments related to any of the requested information below. If not, we look forward to receiving your response that all outstanding issues and requests have been satisfied. We will forward this response to Weld County to fulfill a condition of approval to the USR. 1. The Town of Erie Comprehensive Plan indicates that future residential development is likely to occur on adjacent properties. The Town requests that the applicant utilize a combination of berming and landscaping to more effectively screen the proposed facility from these future land uses. Please see the attached screening plan. We updated the plan to reflect the number of trees required to screen the property from the municipal right-of-way (Title 10.6.4). We calculated 67 trees will be required for the approximate 2,680 linear feet of the subject property abutting CR6& CR7. The trees will work in tandem with a system of proposed berms that will be strategically located around the Hub to provide the best screening possible. 2. Per the Town of Erie Transportation Master Plan, Weld County Road 7 ("WCR 7") is indicated as a principal arterial roadway with a right-of-way width of 140-feet.The Town requests 70-feet of right- of-way, (from and west of the section line) be dedicated to the Town of Erie. The USR site plan indicates a future dedication of ROW to Erie to meet the 70 feet from west of the section line as requested. This equates to 40-more feet of ROW than exists today. 3. Per the Town of Erie Transportation Master Plan, Weld County Road 6 ("WCR 6") is indicated as a collector roadway with a right-of-way width of 80-feet. The Town requests 40-feet of right-of-way, (from and north of the section line) be dedicated to the Town of Erie. The USR site plan indicates a future dedication of ROW to Erie to meet the 40 feet from north of the section line as requested. This equates to 10-more feet of ROW than exists today. In previous discussions with the applicant the Town has indicated the preferred haul/truck traffic route (Haul Route 3 in revised Traffic Impact Study) to the site is WCR 6 via the eastern 1-25 Frontage Road. Due to the anticipated volume of truck traffic,the Town requests: a. The paving of WCR 6 along the frontage of the property to the Town's standard cross- section for a Rural Arterial. b. Installation of streetlights on WCR 6 along the frontage of the property and at the intersection of WCR 6/WCR 7. c. That a traffic engineer make recommendation(s) for safety improvements at the intersection of WCR 6/WCR 7. d. That a traffic engineer make recommendation(s) for safety improvements at the intersection of WCR 6/eastern 1-25 Frontage Road and those portions of WCR 6 not annexed into the Town of Erie. e. A detailed pavement analysis report of the preferred haul/truck traffic. We have and will continue to work with Erie and Weld County on the haul routes and access points to the Hub. We have previously provided for you all the requested studies and recommendations. 5. The Town requests that the west access into the site align with the existing access on the south side of WCR 6. The west access to the Hub is now aligned with the existing access on the south side of WCR 6. 6. The Town requests that a Photometric Plan be provided indicating that a maximum of two foot candles of illumination at the perimeter property line. In addition, permit only full cut-off lighting fixtures to prevent unnecessary glare. A Photometric Plan is included for your review. 7. The Town requests that all oil/gas equipment, including steel rimmed berms, to be painted to Town standard utilizing the approved color of Dutch Boy Northern Climb. There are some tanks located on site that can't be painted due to state and federal regulations. Specifically the large oil tanks will be painted white. The large water tanks will be bare metal (stainless steel); however they are located in the rear area of the site. The coolers will be unpainted galvanized metal. All other equipment will be painted the requested Dutch Boy Northern Climb color. 8. The Town requests that all fencing proposed to follow Town standard oil/gas fencing of Ameristar Impasse or Stronghold fencing or approved alternate. Ameristar impasse fencing, or a matching equivalent, will be installed around the portions of the site that abut the municipal right-of-way of CR 6 and CR 7. Encana will install security chain link fencing around the remainder of the site's perimeter (northern edge and portions of the west Pager 3 Erie Referral Comments-Liquids Handling Hub.doc edge). Finally, standard chain link will be used to separate the tank and separator area from the truck loading areas. Please see the attached Screening Plan for more information. 9. The applicant's submittal indicates a temporary staging area for pipeline construction. Will a time limit for operation of this staging area be imposed/written into the Special Review Permit? In the event no time limit is established the Town requests that this area be screened as indicated in comment no. 1 above. The proposed lifespan for the storage yard will be five years. It may be shorter than that. Encana proposes to revisit this portion of the site and discuss with the Town of Erie in two years'time to evaluate the expected timeframe. 10. The applicant's submittal indicates up to a 200-foot tall telecommunications tower on the site. Is this proposed tower being approved as part of the Site Specific Development Plan and Special Review Permit? There are no plans currently for a 200 foot tall communications tower on the Hub property. 11. As a reminder, any utility lines needed for the facility installed in Town right-of-way will require a License Agreement with the Town prior to installation. Noted. He continued east on Rd 6. If the entrance to the HUB is relocated so that the truck traffic must come and go to the Rd 6 and 7 intersection, not much will stop them from driving east on Rd 6, perhaps considering it to be a straight shot to or from the HUB. Already it seems that Encana hasn't passed along the word of our agreement between you,the Commissioners, us,the Rd 6 neighborhood, and Encana, to their drivers. If we,who battled hard to keep heavy truck traffic off Rd 6, respect the safety of Encana drivers and agree to a Rd 6 entrance to the HUB,then they, too, must respect our safety, and honor the agreement to stay off Rd 6. We respectfully request signage at the Rd 6 entrance from the I-25 Frontage Rd as well as the Rd 6 and 7 intersection that prohibits heavy truck traffic, both construction and oil field production vehicles. The Town of Erie Comprehensive Plan indicates that future residential development is likely to occur on adjacent properties. The Town requests that the applicant utilize a combination of berming and landscaping to more effectively screen the proposed facility from these future land uses. Please see the attached screening plan. We updated the plan to reflect the number of trees required to screen the property from the municipal right-of-way (Title 10.6.4). We calculated 67 trees will be required for the approximate 2,680 linear feet of the subject property abutting CR6& CR7. The trees will work in tandem with a system of proposed berms that will be strategically located around the Hub to provide the best screening possible. 2. Per the Town of Erie Transportation Master Plan, Weld County Road 7 ("WCR 7") is indicated as a principal arterial roadway with a right-of-way width of 140-feet.The Town requests 70-feet of right- of-way, (from and west of the section line) be dedicated to the Town of Erie. In previous discussions with the applicant the Town has indicated the preferred haul/truck traffic route (Haul Route 3 in revised Traffic Impact Study) to the site is WCR 6 via the eastern 1-25 Frontage Road. Due to the anticipated volume of truck traffic,the Town requests: a. The paving of WCR 6 along the frontage of the property to the Town's standard cross- section for a Rural Arterial. b. Installation of streetlights on WCR 6 along the frontage of the property and at the intersection of WCR 6/WCR 7. c. That a traffic engineer make recommendation(s) for safety improvements at the intersection of WCR 6/WCR 7. d. A detailed pavement analysis report of the preferred haul/truck traffic. We have and will continue to work with Erie and Weld County on the haul routes and access points to the Hub. We have previously provided for you all the requested studies and recommendations. 5. The Town requests that the west access into the site align with the existing access on the south side of WCR 6. The west access to the Hub is now aligned with the existing access on the south side of WCR 6. 6. The Town requests that a Photometric Plan be provided indicating that a maximum of two foot candles of illumination at the perimeter property line. In addition, permit only full cut-off lighting fixtures to prevent unnecessary glare. A Photometric Plan is included for your review. 7. The Town requests that all oil/gas equipment, including steel rimmed berms, to be painted to Town standard utilizing the approved color of Dutch Boy Northern Climb. There are some tanks located on site that can't be painted due to state and federal regulations. Specifically the large oil tanks will be painted white. The large water tanks will be bare metal (stainless steel); however they are located in the rear area of the site. The coolers will be unpainted galvanized metal. All other equipment will be painted the requested Dutch Boy Northern Climb color. 8. The Town requests that all fencing proposed to follow Town standard oil/gas fencing of Ameristar Impasse or Stronghold fencing or approved alternate. Ameristar Impasse fencing, or a matching equivalent, will be installed around the portions of the site that abut the municipal right-of-way of CR 6 and CR 7. Encana will install security chain link fencing around the remainder of the site's perimeter (northern edge and portions of the west Pagel 3 Erie Referral Comments-Liquids Handling Hub.doc edge). Finally,standard chain link will be used to separate the tank and separator area from the truck loading areas. Please see the attached Screening Plan for more information. 9. The applicant's submittal indicates a temporary staging area for pipeline construction. Will a time limit for operation of this staging area be imposed/written into the Special Review Permit? In the event no time limit is established the Town requests that this area be screened as indicated in comment no. 1 above. The proposed lifespan for the storage yard will be five years. It may be shorter than that. Encana proposes to revisit this portion of the site and discuss with the Town of Erie in two years'time to evaluate the expected timeframe. 10. The applicant's submittal indicates up to a 200-foot tall telecommunications tower on the site. Is this proposed tower being approved as part of the Site Specific Development Plan and Special Review Permit? There are no plans currently for a 200-foot tall communications tower on the Hub property. 11. As a reminder, any utility lines needed for the facility installed in Town right-of-way will require a License Agreement with the Town prior to installation. Noted. In listening it sounds like an additional sentence was added to: Amend #1.M.10 to read, "The Haul Route for all outbound truck traffic from the HUB facility is designated to be onto County Road 6, east to the intersection of County Roads 6 and 7, north on County Road 7 to County Road 8, east on County Road 8 (Erie Parkway). Inbound truck traffic is designated to be west on County Road 8 (Erie Parkway)to County Road 7, south on County Road 7 to the intersection of County Roads 7 and 6, west on to County Road 6 to the HUB facility. In no event shall the haul route include CR 6 between CR 7 and the I-25 Frontage Road." 1 Also,with concurrence of the applicant,the Board further amended the Resolution to add a Condition(I assume to be added as Condition#1.M.16)that requires additional signage at the access point to CR 6 from the facility essentially stating what the haul route is and identifying they are not to be using CR 6 heading east to the Frontage Road.(Staff will need to formalize this language).
