This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: The project is located on CR 60.5, west of CR 49. Access is off CR 60.5. An access permit application has been submitted and PW has issued the permit (AP14-00217). Tracking control is required to prevent tracking from the site onto the public roadways. Applicant has installed appropriate tracking control devices and recycled asphalt at the entrance and large radii for truck turning movements. A traffic narrative was submitted on 9/3/14 detailing the type and number of vehicles per day, expected haul routes, trip distribution along the haul route. The site will be unmanned. The applicant anticipates between 5 roundtrip truck trips per 8 hr shift up to 150 roundtrip truck trips per 24 hr period during peak use. The traffic is expected to be come from east and west equally but leaving 75% going east. Improvements/Road Maintenance Agreement: A draft of the agreement will be provided to the applicant after approval of the application at the BOCC hearing. Collateral is required to ensure the improvements are made. o Road Maintenance will be included as a section of the Improvements Agreement when the County feels that the site activities may impact the County roadways. Possible mitigations included in the road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage repairs, and future improvement triggers. The applicants will be required to maintain historic drainage flows and run-off amounts on the property. The applicant has submitted a drainage narrative and water quality feature calculation which has been accepted by Engineering. This site is Not in a State defined Municipal Separate Storm Sewer System (MS4)area. The applicant has submitted an application for a grading permit and a permit was issued (GRD14-00070) This site is Not in a Geologic Hazard Area. The site is within the floodplain boundaries but no construction is within the floodplain boundaries. CONDITIONS OF APPROVAL/REQUIREMENTS: 1. An Improvements Agreement and road maintenance agreement is required for this site. Road maintenance including damage repair, and triggers for improvements will be included. B. The plat shall be amended to delineate the following: 1. CR 60.5 (old SH 263) is a paved collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. The applicant shall verify the existing right-of-way and the documents creating the right-of-way and this information shall be noted on the plat. Pursuant to the definition of setback in the Weld County zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant shall delineate an additional 10-foot of right-of-way parallel to the right-of-way for future build-out. 2. Show the approved access on the plat and label with the approved access permit number(AP14-00217). 3. The applicant shall label the approved water quality feature on the plat as "Water Quality Feature, No Build/Storage Area", and label the required volume. 2. Prior to Construction: A. Right of way permit is required for any work within the public right of way. B. Special transport permit is required for any over size or over weight vehicles. 3. PARCEL: 096306300019-R4840907 COMMENT: The site is partially in the S. Platte River Floodplain. It appears that the development for the water depot is outside of the floodplain. If there is any development on this site in the floodplain a floodplain development permit(FHDP)will be required. This floodplain is zoned A. CONDITION OF APPROVAL: The applicant shall submit a Floodplain Development Permit (FHDP) for all development activities located within the special flood hazard area. The FEMA definition of development is any man-made change to improved or unimproved real estate, including by not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation, drilling operations, or storage of equipment and materials. All construction or improvements occurring in the floodplain or floodway as delineated on Federal Emergency Management Agency (FEMA) FIRM Community Panel Map # 080266-0635C and 645C dated September 28, 1982, shall comply with all applicable Weld County requirements, Colorado Water Conservation Board requirements as described in Rules and Regulations for Regulatory Floodplains in Colorado, and FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65. The application states on average up to 15 trucks per day could utilize the site. The following section is from Environmental Health Services, Weld County Department of Public Health & Environment, Septic Policies. 2.2.K Use of portable toilets and bottled water (revised 5/8/12) Purpose: To define when portable toilets and commercially bottled water are allowed. Policy: Portable toilets and bottled water from a commercial source are allowed in the following circumstances: 1. Temporary or seasonal uses that are utilized 6 months or less per year (for example recreational facilities, firework stands, farmers markets ) 2. Gravel mines 3. 10 or less customers or visitors per day and/or one of the following: 4. 2 or less full time (40 hour week) employees located on site 5. 4 or less part time (20 hour week) employees located on site 6. employees or contractors that are on site for less than 2 consecutive hours a day Note: Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. As indicated above, it is the policy of this Department that portable toilets are allowed when employees or contractors are on site for less than 2 consecutive hours a day. As personnel will be on site for a short duration, in accordance with Environmental Health Services policy the use of portable toilets is allowed. The dust abatement plan states that drives and loading areas will be constructed of road base and if necessary water will be utilized to control dust. The application states that waste will be collected and disposed of by a contracted waste disposal company such as Waste Management. We have no objections to the proposal; however, we recommend the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved Waste Handling Plan, at all times. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved Dust Abatement Plan, at all times. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Non Specified Zone as delineated in Section 14-9-30 of the Weld County Code. 6. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. As employees or contractors are on site for less than 2 consecutive hours a day portable toilets are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 2 7. The fresh water storage and loading system shall be operated in a manner to minimize spills. Fresh water spills should be captured in above-ground containment areas for reuse or allowed to infiltrate. There shall be no discharge from this process to surface waters or through the facility's stormwater management system, in accordance with the Rules and Regulations of the Colorado Water Quality Control Commission, and the Environmental Protection Agency. 8. Transportation Comments ❑ Advisory. The project site is not within City of Greeley limits but is in close proximity to the City of Greeley Growth Boundary. SH 263 just west of the site has a history of congestion and traffic problems resulting from the relatively high volume of truck traffic (about 30% of the total traffic)in combination with a roadway that seems to be inadequately improved for the current usage. To this point, SH 263 only provides 1 lane in each direction and is lacking auxiliary lanes at key road intersections. The existing roadway also does not provide generous shoulders. Although the proposed site shown in this application may not trigger specific improvements, it could be expected that the truck traffic associated with the proposed site would exacerbate the congestion. Please see the attached information regarding traffic counts, speed, and vehicle classifications for SH 263 (East 8th Street). This information was collected on East 8"' Street at the intersection of Fern Avenue from 8/18/14 through 8/25/14. The City of Greeley would be happy to meet with Weld County and CDOT to discuss traffic along SH 263. The roadway has definitely seen an increase of truck traffic, but as yet no increase in traffic accidents. As of this date we have no plans for any improvements on this highway except for a possible overlay. Water Division 1, Water District 1 Dear Mr. Gathman: The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. The applicant is seeking a Site Specific Development Plan and Use by Special Review permit for a mineral resource development facility, known as the River Ranch Water Load-Out Facility, on a parcel of approximately 31 acres identified as Lot A, RECX14-OO49. The subject 31-acre parcel appears to be a portion of the 49.44-acre parcel this office commented on as Lot B in the application for RECX14-0049. The site will not have any onsite full-time employees. The facility will be visited by approximately 15 water haulers and 1 employee per day. The site will not have potable water since there are no facilities located onsite. Portable toilets will be available for use by site visitors. The existing facility includes an existing 360,000-barrel lined storage pond. The pond is filled with non-potable water from a variety of water rights. Water from the pond is used to support oil and gas operations including drilling and hydraulic fracturing and also for augmentation purposes. The applicant will need to document that the water used to fill the pond was obtained from a legal source, or was diverted in priority under a water right decreed for such industrial/augmentation use. Based on the submitted Use by Special Review Plot Plan and its permitted location, the well with permit no. 280476 will be located within the subject 31-acre parcel identified as Lot A. Well permit no. 280476 was issued pursuant to § 37-92-602(3)(b)(II)(A), C.R.S. as the only well on a tract of land of 55 acres. The use of the well under permit no. 280476 is limited to the watering of livestock on a farm or ranch. Upon approval of this recorded exemption, the parcel on which the existing well is located will be smaller than the parcel identified on permit no. 280476. Therefore, the existing well must be re-permitted consistent with the new parcel on which it is located.
