WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado , and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 18th day of June, 1979 at the hour of 9 :00 o 'clock a.m. for the purpose of hearing the application of Darrell and Donna Uhrig for the granting of a Conditional Use Permit for a single family residence on a° parcel under the minimum lot size, said parcel being described as follows : A part of the North One-Half of the South- east One-Quarter of Section 18 , Township 2 North, Range 67 West of the 6th P.M. , Weld County, Colorado, more particularly described as: Beginning at the East Quarter corner of said Section 18, thence South 00°00 '00 " East on an assumed bearing along the East line of said Section 18, a distance of 50 .00 feet; thence North 89°05 ' 43" West parallel with the East-West centerline of said Section 18 a distance of 1372. 58 feet; thence South 00°00 '00" East parallel to the East line of said Sec- tion 18 a distance of 1268 .03 feet to a point on the South line of said North One-Half, Southeast One-Quarter, Section 18; thence North 88°56 '00 " West along said South line a distance of 1269 .03 feet to the Southwest corner of said North One-Half Southeast One- Quarter, Section 18; thence North 00°16 ' 54" West along the North-South centerline of said Section 18 a distance of 1314 . 55 feet to the center of said Section 18, thence South 89°05 ' 43 " East along the East-West line of said Section 18, a distance of 2648.01 feet, to the Point of Beginning. WHEREAS, the petitioners were present, and WHEREAS, evidence was presented in support of the granting of the Conditional Use Permit for a single family residence on a parcel under the minimum lot size, and WHEREAS, Section 3. 3,D. of the Weld County Zoning Resolution authorizes such a use in an Agricultural Zone District upon the granting of a Conditional Use Permit by the Board of County / /'ert2 Pt 790470 Commissioners, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request fora Conditional Use Permit for a single family residence on a parcel under the minimum lot size as hereinabove described, complies with all of the conditions as set forth'in Section 3 . 3.D. (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Darrell and Donna Uhrig for a Conditional Use Permit for a single family residence on a parcel under the minimum lot size as hereinabove described be, and hereby is, granted subject to the following: 1. The development standards contained in the Conditional Use Permit. 2. No building or electrical permits shall be issued on the Conditional Use Permit area until the development standards for the Conditional Use Permit have been placed on the Conditional Use Permit plat and said plat has been delivered to the office of the Department of Planning Services. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reasons for approval contained in the Planning Commission recommendations dated June 5, 1979 be, and hereby are, incorporated as the findings of fact of the Board of County Commissioners in this matter. Roll Call was as. follows : Chuck'Carlson Present Frank Suckle Present Fred Otis Present Ben Nix Present Percy Hiatt Present Bette Kountz Present Jerry Kiefer Present Jim Gilbert Absent Irma White Absent I Also present were: Tom Honn, Zoning Administrator Russ Anson, Assistant County Attorney As a quorum was present the meeting proceeded as scheduled. Chairman Carlson called for a motion to approve the minutes of May 15 , 1979 . Jerry Kiefer made a motion to accept the minutes as presented. The motion was seconded by Percy Hiatt. All present case a unanimous vote of "aye" to accept the minutes . APPLICANT: Lowell Adams CASE NUMBER: Z-321 : 79 :5 SUBJECT : Change of Zone from "A" Agricultural Zone District to "C" Commercial Zone District LEGAL DESCRIPTION: Pt. SW4i Section 29, T6N, R65W LOCATION: Northeast corner of North 11th Avenue and "0" Street (County Road 64) at Mumper Hill, approximately Z mile north of the City of Greeley DISCUSSION: Tom Honn stated that the applicant has requested additional time in order to meet with the Planning staff to discuss the possibility of a unit development in addition to the change of zone request to comply with the recommendation of the City of Greeley. The Planning staff' s recommendation was to continue the request to the June 19 , 1979 Planning Commission meeting. MOTION: Be it therefore resolved to continue the request to the June 19 , 1979 Planning Commission meeting based on the staff' s recommendation. Motion by Percy Hiatt, seconded by Fred Otis . NW4 SW4, Section 36, T6N, R66W LOCATION: Northeast of the intersection of 35th Avenue and F Street, south and west of the railroad tracks APPEARANCE: Glenn Billings DISCUSSION: Mr•. Billings stated that Mr. Erickson is in the housing construction business and is presently renting office space, but does not have adequate facilities to store his equipment and material. The remainder of the buildings to be built in the future will be for dry storage. He then discussed the recommendations by the City of Greeley as regards the entrance to the site and comments by the Colorado and Southern Railroad Company. There being no questions at this time, Tom Honn read the Planning Staff' s recommendation for approval and the Development Standards . Mr. Otis then asked if Mr. Erickson was willing to bear the cost of some of the items as stipulated in the Development Standards (i. e. , landscaping) . Mr. Erickson stated he felt there would be no problem concerning this . Mr. Otis was also concerned that this could perhaps --have a junkyard appearance, but this will be screened from surrounding neighbors. MOTION: Be it: therefore resolved to recommend approval based on the staff' s recommendation with the Development Standards to the Board of County Commissioners. -Motion by Jerry Kiefer, seconded by Fred Otis . A vote of "aye" was cast by Percy Hiatt, Ben Nix, Fred Otis , Jerry Kiefer, Frank Suckle, and Bette Kountz.• Chuck Carlson cast an abstention vote.. Motion carried. - APPLICANT: Darrell and Donna Uhrig CASE NUMBER: CUP-48 :79 :8 SUBJECT: Single Family Residence on a Parcel Under the Minimum Lot Si e LEGAL DESCRIPTION: Pt.- -NZ SE4j Section 18, T2N, R67W LOCATION: Approximately 1 mile- north of Firestone APPEARANCE: John Dent DISCUSSION: Mr. Dent stated that the Uhrig' s wish to construct a resi enc on this 40 acre parcel and also wish to conduct a .swine farrowing oper tion of approximately 30 sows . He stated that to- his knowledge he knows of no objections Zrom surrounding neighbors and feels the- use is consiste • t with the surrounding uses . There being no questions at this time, Tom Honn read the staff' s recommendation for approval and the Development Standards . Mr. Dent then commented on one of the comments in the staf recommendation regarding the septic system. He stated that there has been some confusion regarding this in that there is presently no septi system on the property., - The Uhrig' s are waiting for approval or denia of the Conditional -Use "Permit before proceeding with the installation of a system. The Health Department had inspected the property in front -of the Uhrig' s which is completed.. Mr. Suckle commented that he had viewed the property and feels the Uhrig' s are doing a good job and that the request should be granted. . . Ben.Nix expressed concern that the operation could enlarge in the future. Mr. Uhrig assured him he has no intention of- enlarging it- any more than 100 head. It will be operated on: a -limited basis . MOTION: Be it therefore resolved to recommend approval with the Development Standards to the,.Board of. County Commissioners based on the staff' s recommendation. Motion by -Frank Suckla, seconded by Percy Hiatt. Motion carried. -Planning Commissio, 'finutes Page 3 June 5, 1979 APPLICANT: Wyoming Mineral Corporation CASE NUMBER: SUP-390:79 : SUBJECT: Amendment. to SUP-353 Development Standard #1 for a 6 Month Time Extension LEGAL DESCRIPTION: Pt. EZ, Section 24, T10N, R62W LOCATION: Approximately 3 miles south and 2 miles west of Grover APPEARANCE : Frances Ryan, Licensing Engineer DISCUSSION: Ms . Ryan first brought the Planning Commission up-to-date as to what has, been occurring at the Grover test test and what is anticipated in the next 6 to 8 months and 1 to 5 years. The present request is to amend Development Standard #1 for a six month extension to allow for the conclusion of aquifer restoration and the commencement of surface reclamation. Ms. Ryan then explained the procedure for reclamation. Wyoming Mineral Corporation is in its final stages of groundwater restoration. It is anticipated that a final public hearing with the Colorado Water Quality Control Commission will occur in mid- late summer of 1979, with surface reclamation commencing in the fall. If Wyoming Mineral Corporation needs to remain on the site for the continued groundwater restoration program, then this permit extension will allow them to do so. There being no questions at this time, Tom Honn read the staff ' s recommendation for approval. General discussion followed regarding plugging the holes in the area. MOTION: Be it therefore resolved to recommend approval based on the staff' s recommendation to the Board of County Commissioners. Motion by Percy Hiatt, seconded by Jerry Kiefer. APPLICANT: Virgil Ottinger CASE NUMBER: SUP-391:79 :13 SUBJECT : Swine Farrowing and Finishing Operation LEGAL DESCRIPTION: Pt. SZ, Section 22, T6N, R64W LOCATION: Approximately 3/4 mile northeast of Gill APPEARANCE: Virgil Ottinger DISCUSSION: Mr. Ottinger had applied for a Special Use Permit for this type of operation several months ago and withdrew the application because of a great deal of opposition from surrounding neighbors . Since that time, Mr. Ottinger has found this 75 acre tract of land and would like to have the swine operation on it. The hog confinement operation will be for approximately 1,800 head. Both Mr. Ottinger and his plan plan to build a residence on the property. Tom Honn then read the staff' s recommendation for approval and the Development Standards . Discussion followed regarding the letter the Planning Staff received from W. S. Howard and his concern for a clean operation with odor controlled. Mr. Honn stated he felt this concern was adequately addressed in the Development Standards . MOTION: Be it therefore resolved to recommend approval with the Development Standards based on the Staff ' s recommendation to the Board of County Commissioners . Motion by Ben Nix, seconded by Bette Kountz. A vote of "aye" was cast by Percy Hiatt, Ben Nix, Fred Otis , Jerry Kiefer, Frank Suckla, and Bette Kountz. Chuck Carlson cast an abstention vote. Motion carried. ,Planning Commissic-: Minutes Page 4 June 5 , 1979 APPLICANT : Vernon and Alice Noble CASE NUMBER: SUP-393 :79 :15 SUBJECT: Hog Operation LEGAL DESCRIPTION: Pt. SW4, Section 5, T3N, R68W LOCATION: Approximately z mile north and 2 miles west of the Town of Mead APPEARANCE: Vernon Noble DISCUSSION: Mr. Noble stated that he needs to expand his operation which is in another county at the present time. Mr. Noble' s operation will eventually be approximately 600 head. A controversial issue has been brought up regarding the sale of water on the property. Mr. Noble stated he is in no way connected with the sale of this water. He also stated he has a letter from the Little Thompson Valley Water District which states they will furnish him adequate water service to the site. The subject was then brought up of how the property had come to be split over the years : This process was explained by Mr. Leonard Hergenreter regarding his personal involvement in the property. Mr. Hergenreter also stated he is opposed to this operation as he does not feel prime agricultural cropland should be changed for hog production. Discussion followed regarding other possible sites for the operation and drainage on the property: Robert Hodgson then explained the problem he has been experiencing regarding water for his property. He has been told by Little Thompson Valley Water District that a larger line will be installed, but so far has not yet received it. Discussion followed in this regard. , Tom Honn then read the staff' s recommendation for approval and the Development Standards. Discussion again followed regarding the water situation. MOTION: Be it therefore resolved to recommend approval based on the staff' s recommendation to the Board of County Commissioners with the addition of a condition of approval being that the request is approved subject to the applicant showing the Board of County Commissioners that Mr. Noble has written assurance of an adequate water supply for the operation in the form of a certified letter from Little Thompson Valley Water District and further than an additional. Development Standard be added which would not allow a tap into the existing Little Thompson Valley Water District line until it is enlarged. Motion by Jerry Kiefer, seconded by Fred Otis . A vote of "aye" was cast by Percy Hiatt, Fred Otis, Jerry Kiefer, and Chuck Carlson. A vote of "no" was cast by Ben Nix, Frank Suckla, •and Bette Kountz. Motion carried for. approval 4 to 3 . It is the opinion of the Planning Commissionthat the proposed use will be located on land which is not considered to be prime agricultural land. The SCS Soil ' s Classification of the area under consideration indicates the soils on the site are predominantly Class III , IV and VI irrigated and non-irrigated soils with reference to the agricultural capability classification. The SCS capability classifications indicates that Class III soils have severe limitations that reduce the choice of plants, require special conservation practices, or both. Class IV soils have severe 'limitations that reduce the choice of plants and require very; careful management . Class VI soils have severe limitations 'plat make them generally unsuited to cultivation and limit their 'use largely to pasture or range, woodland, or wildlife food and cover. 3. The soils information is from the Weld County Soil Survey done by the Soil Conservation Service. The soils are classified as Vona loamy sand and Olney loamy sand with an agricultural land use classification of Class III & IV. These soils are ideal for the proposed use. Care should be taken in the design of the swine confinement area to properly dispose of any content-ration of livestock waste. l 2. Septic tanks should function properly in this type of soil , but a percolation test would be necessary to design the leach' field. 3. The, site is not located in a 100 year floodplain. 4.
