RE: ACTION OF THE BOARD CONCERNING A SITE SPECIFIC DEVELOPMENT PLAN
AND USE BY SPECIAL REVIEW PERMIT, USR14-0036, FOR USES SIMILAR TO THE
USES LISTED IN SECTION 23-3-40 AS USES BY SPECIAL REVIEW (EQUIPMENT
STORAGE YARD RELATED TO CUSTOM FARMING OPERATIONS) AS LONG AS
THE USE COMPLIES WITH THE GENERAL INTENT OF THE A (AGRICULTURAL)
ZONE DISTRICT- KB CUSTOM AG SERVICES, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on October 22, 2014, the Board was presented with the application of KB
Custom Ag Services, LLC, P.O. Box 1086, Ault, Colorado 80610, USR14-0036, for Uses Similar
to the Uses Listed in Section 23-3-40 as Uses by Special Review (Equipment Storage Yard
Related to Custom Farming Operations) as Long as the Use Complies with the General Intent of
the A (Agricultural) Zone District, on the following described real estate, being more particularly
described as follows:
Lot A of Recorded Exemption, RE-4098; being part
of the W1/2 of Section 17, Township 7 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request and all of the exhibits and evidence presented
in this matter and, having been fully informed, deems it advisable to refer the matter back to the
Department of Planning Services to close the case since the use in question is considered to be
a Use by Right in the A (Agricultural) Zone District.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application for a Site Specific Development Plan and Use by
Special Review, USR14-0036, for Uses Similar to the Uses Listed in Section 23-3-40 as Uses
by Special Review (Equipment Storage Yard Related to Custom Farming Operations) as Long
as the Use Complies with the General Intent of the A (Agricultural) Zone District, from KB
Custom Ag Services, LLC, on the parcel of land described above be, and hereby is, referred
back to the Department of Planning Services to close the case since the use in question is
considered to be a Use by Right in the A (Agricultural) Zone District.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 22nd day of October, A.D., 2014.
