The current application, SPR14-0016 is for office facilities, storage of vehicles and equipment, maintenance and parking for trucks and related equipment associated with the oilfield industry in the 1-3, Industrial Zone District. The Weld County Zoning Compliance Officer in the referral dated August 22, 2014 indicates an active Zoning Violation (ZCV14-00009) was initiated due to the operation of a commercial business without first completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process. If this application is approved, and once a map is recorded, the outstanding violation will be corrected. If this application is denied, all commercial vehicles and storage shall be removed from the property within 30 (thirty) days of the recommendation of denial or the violation will proceed in court accordingly. This site plan review is approved with the attached conditions: 1. The Site Plan Review Map shall be prepared in accordance with Sections 23-2-160.W and Section 23-2-160.X of the Weld County Code. More than one sheet may be required to adequately address the components associated with this development site. (Department of Planning Services) 2. Prior to recording the Site Plan Review map, the applicant shall address the following to the Department of Planning Services' satisfaction: A. The applicant shall attempt to address the requirements of the City of Greeley as stated in the referral response dated September 16, 2014 including the Water and Sewer requirements, their referral states: 1. The subject property is within the City of Greeley's Long Range Expected Growth Area (LREGA). The LREGA is the range in which the community anticipates development occurring within the coming 20+ years. Particular care in site design is encouraged to increase compatibility with the urbanizing nature of this area. If in the future, City of Greeley water and sanitary sewer are extended to the property, then it will be a requirement to annex into the City of Greeley, prior to City of Greeley providing utility service. 2. The City of Greeley and North Weld County Water District have adopted a Water Service Agreement for providing water in this area. The City of Greeley is agreeable to North Weld County Water District providing water service for the current residence, however, please note that if additional water service is requested then the City of Greeley will decide if water will be provided by the City of Greeley or North Weld County Water District in accordance to the executed Water Service Agreement. B. The applicant shall address the requirements of the Weld County Department of Public Health and Environment, as stated in the referral response dated September 9, 2014 that states: 1. The applicant shall submit written evidence that all septic systems located on the property have appropriate permits/documentation from the Weld County Department of Public Health & Environment. The Environmental Health Division of the Weld County Department of Public Health & Environment was unable to locate a septic permit for the existing residence. Any existing septic system which is not currently permitted/ documented through the Weld County Department of Public Health & Environment will require an On Site Wastewater SPR14-0016 Elite Oil Field Services, Inc., page 2 Treatment System (OWTS) evaluation prior to the issuance of the required septic permit/documentation. In the event the system is found to be inadequate, the system must be brought into compliance with current OWTS regulations. (Weld County Department of Public Health and Environment) 2. The applicant shall submit evidence of an Aboveground Storage Tank permit from the Colorado Department of Labor and Employment (CDL&E), Oil Inspection Section for any aboveground storage tanks located on the site. Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection Section that they are not subject to these requirements (Weld County Department of Public Health and Environment) C. The applicant shall submit evidence the Greeley Fire Department has permitted the above ground tanks associated with the business. Written evidence of the approved permit shall to be submitted to the Department of Planning Services. (Greeley Fire Department, Department of Planning Services) D. An Improvements Agreement for off-site improvements may be required for this site. Possible mitigations may include but are not limited to; dust control (access road), specified haul routes, damage repairs, and future improvement triggers. (Department of Public Works) E. The map shall be amended to delineate the following: 1. All sheets of the map shall be labeled Site Plan Review SPR14-0016. (Department of Planning Services) 2. The Site Plan Review Map shall be prepared in accordance with Section 23-2- 160.W and Section 23-2-160.X of the Weld County Code. More than one sheet may be required to adequately address the components associated with this development site. (Department of Planning Services) 3. The City of Greeley in their referral dated September 16, 2014 indicates that East 16th Street is identified as a collector in the 2035 Comprehensive Transportation Plan. With future development of the property, as a part of the subdivision process, a minimum of fifteen (15) feet of additional right of way will be required for future East 16th Street. Any proposed and future improvements for this site should be located outside of the future right of way. (City of Greeley) 4. East 16th Street is designated on the Weld County Road Classification Plan as a local paved road, which requires 60 feet of right-of-way at full build out. The applicant shall verify the existing right-of-way and the documents creating the right-of-way and this information shall be noted on the map. All setbacks shall be measured from the edge of future right-of-way. If the right-of-way cannot be verified, it shall be dedicated. This road is maintained by Weld County. Please delineate the road surface material, gravel/recycle asphalt base areas, on the site for parking and tracking control at the entrance, main parking areas, and all areas where truck movements for circulation and parking will occur. Please delineate all vehicular parking spaces, including the ADA parking spaces, SPR14-0016 Elite Oil Field Services, Inc., page employee parking areas, Class A trucks and trailers, pick-ups and similar equipment to be parked on site. Also, include curb stops on all paved areas. (Department of Planning Services) 7. Please delineate the access permit information on the map AP14-00408. (Department of Planning Services) 8. The applicant has supplied a Drainage Narrative; the overall site imperviousness is 3.36%. A water quality feature of an existing ditch on the north end of the property will be re-excavated, cleaned out and used to collect stormwater and run-off prior to leaving the property. The historical flow patterns and run-off amounts will be maintained. (Department of Public Works) 9. Please delineate the extent of the landscape component on site, including edge of landscape area by material, type of vegetation, and type of surface treatment associated with the landscape component. (Department of Planning Services) 10. Please delineate the location of the proposed septic system(s) on the site plan. No vehicle access drives, vehicle parking or equipment storage shall be located in the area of the septic system. The septic system must be protected from vehicle traffic. Section 23-3-350.B Parking. Sufficient screened, off-street, paved parking areas shall be provided in the Industrial Zone Districts to meet the requirements of employees, company vehicles, visitors and customers. By calculation, there are thirty-nine parking spaces located on site. There are also 17 company vehicles parked on site, leaving twenty two parking spaces for the two full time employees. Total parking as calculated for the building square footage and the employees on site is thirty nine (39) parking spaces, one of which must meet the American with Disabilities Act requirements. (Department of Planning Services) 13. Section 23-3-350.D Street Access. Lots in the Industrial Zone Districts shall have safe access to an approved public or private street. US Highway 34 Business route is maintained by the Colorado Department of Transportation (CDOT). Contact their office to mitigate any jurisdictional concerns regarding the roadway. Please verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. (Department of Public Works) 14. Section 23-3-350.G.1 Required Landscape Areas. No more than eighty-five percent (85%) of the total area of a Lot in any Commercial Zone District shall be covered. Land shall not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by decorative gravel or wood chips, or if it is otherwise suitably landscaped, and Section 23-3-350.G.2 Required Landscape Areas. That portion of a Lot in any Industrial Zone District which abuts a public or private street right-of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from the Lot line towards the interior of the Lot. Sidewalks and driveways may pass through the required landscaped areas. The Site Plan drawing submitted with the application did not provide clear definition as to the extent of the landscape SPR14-0016 Elite Oil Field Services, Inc.. page treatment. Please provide additional comment on the Landscape component associated with the property. (Department of Planning Services) 15. Section 23-3-35O.H Areas used for trash collection shall be screened from public rights-of-way and all adjacent properties. These areas shall be designed and used in a manner that will prevent wind-or-animal-scattered trash. Please describe the placement of the trash receptacles, including dumpster(s) and how these receptacles will be located on site and method of screening. (Department of Planning Services) 16. Section 23-3-360.F Light. Any lighting, including light from high temperature processes such as welding or combustion, shall be designed, located and operated in such as manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties; neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets; and no colored lights may be used which may be confused with or construed as traffic control devices. The Site Plan drawing submitted with the application did not identify or delineate any service yard lights, wall mounted lights or lighting on structures, including man doors. As proposed there is not a light at the fueling station. Please provide "cut-sheets" describing the lights proposed and provide a narrative addressing the lighting component, including height of fixtures, the operation of the lights, e.g., dawn to dusk, motion sensors, or other means of site lighting. Also describe the methods to be employed to restrict transient light from these proposed fixtures onto adjacent property and public rights-of-way. (Department of Planning Services) F. The following notes shall be placed on the map: 1. All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. (Department of Planning Services) 2. In the event that a portion of the building is proposed to be leased or sold to another party in the future, the applicant shall contact the Department of Planning Services. Based upon the proposed use and/or impacts of the leased portion, the Department of Planning Services may require an Amendment to the Site Plan Review permit. (Department of Planning Services) 3. In accordance with the Weld County Code, no land, building or structure shall be changed in use or type of occupancy, developed, erected, constructed, reconstructed, moved or structurally altered or operated in the Commercial and Industrial Zone District until a Site Plan Review has been approved by the Department of Planning Services. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. (Department of Public Health & Environment) 5. No permanent disposal of wastes shall be permitted at this site. This is not SPR14-0016 Elite Oil Field Services, Inc., page meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with the approved Waste Handling Plan, at all times. (Department of Public Health & Environment) 7. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. (Department of Public Health & Environment) 8. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall operate in accordance with the approved Dust Abatement Plan, at all times. (Department of Public Health & Environment) 9. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code. (Department of Public Health & Environment) 10. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. As employees or contractors are on site for less than 2 consecutive hours a day and there are no more than 2 full time employees located on site, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. (Department of Public Health & Environment) 11. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. (Department of Public Health & Environment) 12. Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal. Currently the following has been adopted by Weld County: 2012 International Building Code; 2012 International Mechanical Code; 2012 International Plumbing Code: 2012 International Energy Code; 2006 International Fuel Gas Code; 2011 National Electrical Code; 2009 ANSI 117.1 Accessibility Code the 2012 International Plumbing Code. and Chapter 29 of the Weld County Code. Upon completion of Condition of Approval #1 and #2, above, the applicant shall submit one (1) paper copies or one (1) electronic copy (.pdf) of the Site Plan Review map for preliminary approval to the Weld County Department of Planning Services. Upon approval of the map the applicant shall submit a Mylar map along with all other documentation required as Conditions of Approval. The Mylar map shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The map shall be prepared in accordance with the requirements of Section 23-2-160.X of the Weld County Code. The Mylar map and additional requirements shall be submitted within one hundred twenty (120) days from the date of the date of approval. Elite Oil Field Services, Inc is a service company that provides on-call service to the oilfield industry. The property located at 485 East 16th, Greeley, CO is leased from Briggs Trucking & Equipment Co. The intended use of the leased property is to store equipment and vehicles necessary for field work on a daily basis. The one (1) bay of the shop that is leased from Briggs Trucking & Equipment Co is used for minor vehicle and equipment repairs. The satellite office trailer that sets to the north of the shop is mobile and is currently on axles and tires; its use is strictly clerical, with normal daily activity including: incoming and outgoing phone calls, incoming and outgoing facsimiles, brief computer utilization, and time clock punching for employees. 2. Currently, the number of employees associated with the use of the leased property is sixty (60). Of those 60 employees two (2) utilize the property full-time, working approximately forty (40) hours a week at the property. The other fifty-eight (58) employees spend less than two (2) hours a day at the property. 3. The minimum distance any building on the property sets is approximately one hundred thirty-five ( 135) feet from the right-of-way of East 16t1 Street. There are no intentions to construct or use this area for storage of vehicles, equipment, or parking. This one hundred thirty-five (135) feet setback well exceeds the required twenty-five (25) feet minimum for any setback. This area will be maintained as native grass to also aid in meeting the maximum lot coverage requirements for the property zoned Industrial-3. All existing buildings currently meet the requirement for offset on the property; the area designated for employee parking that will be installed directly east of the shop will also utilize a ten (10) foot offset from the eastern property line. 4. Please see the attached drawings of details of buildings on site. 5. Due to nature of the work performed by Elite Oil Field Services Inc there is a minimal need for signage on the property. No advertising signage will exist. An 18" x 24" aluminum sign is mounted on the wooden brace of the double ten (10) foot long gate, its placement is approximately one hundred (100) feet from East 16`h Street. The sign reads "NO ENTRY WITHOUT AUTHORIZATION (719) 688-8114". 6. (a) The southern one hundred thirty-five ( 135) feet just north from the right-of-way of East 16th Street running the complete width East and West except for what is designated as the property entrance or access road, shall be maintained in its native grass to ensure compliance with the Maximum Lot Coverage requirements of zone Industrial-3. The trees on the property will remain in place until they have reached their useful life and at that point are no longer viable. The requirement is no more than eighty-five (85) percent coverage on property; the property is approximately 221 ,686 square feet in area, the southern portion dedicated for Maximum Lot Coverage requirements will have an area of 46, 161 square feet. This will allow for a Maximum Lot Coverage of seventy-nine (79) percent on the property. (c) The southern one hundred thirty-five (135) feet just north from the right-of-way of East 16`" Street running the complete width East and West except for what is designated as the property entrance or access road, shall be maintained in its native grass to help buffer the parking area from East 16`'' Street. A fence shall be erected and placed at the south end of the parking lot to limit sight from roadway. This fence will also act as barrier to prevent trash or materials from blowing into to the road way. (d) No new landscaping will take place. There are six (6) Elm trees located on the property, none of which at this time are scheduled to be removed. The remainder of the property is covered in native grass, all of which is not irrigated; all native grass located south of proposed fence and existing shop is scheduled to remain in place. (e) Elite Oil Field Services Inc management has many years planting native grass in Colorado and surrounding states, adjacent to roads, highways, interstates, and toll roads. The use of native grass eliminates the need for weekly maintenance. The native grass utilizes the natural precipitation for growth, mowing will be done periodically to ensure an attractive and pest-free environment. This area shall be maintained at less than twelve (12) inches at all times, native grass will exclude any noxious weed. A maintenance plan is attached. 7. An existing ditch that runs along the north edge of the property will be re-excavated, cleaned out and used as water quality feature to capture stormwater and contaminants prior to flowing offsite. The feature will be used instead of detention pond because the stormwater drainage impacts of the project, proposed in this site plan review, will be insignificant. 8. The off-street parking on property is screened on the south and east to block site of parking from roadway and to prevent trash and materials from blowing into adjacent property and/or roadway. The lot will be constructed from gravel, graded to the north to prevent drainage problems. The lot shall consist of forty-five (45) 9 feet by 19 feet parking spaces of 90 degree angle. The aisles between parking lanes shall be no more than thirty-four (34) feet wide. Total width of parking lot shall be one hundred sixty (160) feet wide, which will allow for a ten (10) foot offset on the east property line. Although customers rarely visit the office trailer, a designated handicap parking spot will be placed to the immediate west of the office trailer. The parking lot will be directly east of the shop allowing employees easy access to company vehicles and equipment. 9. The loading area of the property will be located in the northeast corner, offset from the north and east property lines by ten (10) feet. The area is clear from overhead obstructions. The area will be paved with gravel and graded to the north to prevent drainage problems. The loading area will be at the minimum thirty-five (35) feet in length and at the minimum ten (10) feet wide. Landscaping timbers will be placed along the east side to act as a guide and prevent the loaded vehicle from entering the ten ( 10) foot offset. The ten (10) offset should be adequate space to prevent the loading space from being a nuisance to property lines or right-of-way. The northeast corner offers, the easiest loading space due to the fact that most equipment that is unloaded is unloaded off the back of such trailers and is stored, when not in use along the north and west property line. 10. The existing entrance road will continue to be utilized by Elite Oil Field Services Inc and does not require the construction of a street or highway. 11 . Elite Oil Field Services Inc will not be constructing any new or alternating existing roadways allowing access to and from East 16th Street. 12. At this time, acceleration/deceleration lanes do not exist on East 16'" Street. 13. Northern Colorado Disposal picks up the trash regularly at the property. The dumpster is located directly west of the office trailer. The dumpster is bordered by a chain-link fence on the west side to prevent trash from blowing into adjacent property; the dumpster sets behind a garage that belongs to the unknown tenant renting the house, this allows it to be screened from sight on East 16`'' Street and prevents trash, if applicable, from blowing into street. 14. It is the intention of Elite Oil Field Services Inc to use the property in a manner that is in alignment with the zoning of the property, and be harmonious as possible to the surrounding areas. (a) Early decibel readings along the property lines during hours with peak employees have shown to be less than seventy-five (75) decibels, which is well within limits set forth by C.R.S. Section 25-12-101 and C.R.S. Section 25-12-103. (b) All vehicles and equipment are in compliance with emissions regulations of Weld County. None of the proposed activity at the property site will generate problems with air quality for the surrounding areas. (c) Elite Oil Field Services Inc has committed to installing a water quality feature to protect adjacent properties from contaminates in stormwater; have in place a waste handling plan to prevent damage to water quality; prohibit vehicles and equipment from being washed on the property. (d) No radioactive material will be handled, used, stored, and or processed on the property. The most serve heat generating operations would include welding and cutting with oxy-acetylene torch, all of which is done in the shop. Recently cut and or welded material will not be stored along any of the property lines. (0 No lighting will be installed in the parking area, all exterior yard lights and lights on the office trailer are fitted with fixtures to prevent glare to adjacent properties and East 16t1' Street. All welding and cutting shall take place in the shop to prevent glare on adjacent properties and or East 16th Street. When it is necessary for welding or cutting to be done in the yard, away from the shop, a protective curtain will be used around to prevent glare on to adjacent properties and or East 16`h Street. (g) As listed in the landscaping maintenance plan, the native grass shall be mowed at the minimum of once (1 ) a month, during the growing season or more often if grasses reach twelve (12) inches tall, and as needed during the non-growing season. A licensed chemical applicator will be utilized periodically to examine the structure and species of the noxious weeds to determine the best application, pre-emergent and or post-emergent. 15. The property's landscaping consists of the following: Native Grass (existing) (6) Elm Trees (existing) The use of native grass allows the property to be landscaped with vegetation that is well suited for thriving in the climate around Greeley; this can be done without the necessity of additional irrigation systems and annual fertilizations. Elite Oil Field Services Inc's management has many years designing mix blends and planting native grass in Colorado and surrounding states; adjacent to roads, highways, interstates, and toll roads. The native grass will rely on annual precipitation and has no additional irrigation provided for it. During the growing season it will be mulched mowed once (1 ) a month, or as needed to prevent it from growing past twelve (12) inches in height, this will allow for not only an attractive sustainable landscape but limit pest problems. During the non-growing season it will be mulched mowed as needed. There may come a time that noxious weeds may exist in and around the property. All herbicide applications will be completed by a person who is a licensed USDA approved chemical applicator. The chemical applicator will be utilized to determine the species, structure (broadleaf or grassy), and the best application to eradicate or prevent re-growth. It may be necessary for a broadleaf pre-emergent to be applied annually in late February or early March to prevent noxious weeds. The elm trees on the property are approximately twenty-five (25) feet tall. These trees are mature and well rooted and need little up-keep to stay viable. The elm trees will be pruned in early spring at the minimum once every three (3) years. Pruning will consist of cutting dead and or undesirable growth out of the tree. This effort is maximized during early spring when callus tissue develops rapidly over the areas that was pruned. The trees shall be pruned in such a matter: the one (1) elm tree located directly west of the shop does not cause an over head obstacle for incoming and outgoing traffic; the one (1) elm tree in closest proximity to the road does not lead to blind spots for entering and exiting traffic; all others will be pruned for maximum shade coverage without overhead obstacles. Once a tree has reached its useful life and is deemed dead, it will be removed, and if applicable, a replacement shall be planted. In the event of serve drought conditions it may be necessary for additional irrigation to be applied to the landscaping; this may be done with hose and hydrant and or water tank mounted on a truck. Additional irrigation is to only take place during designated watering days and or hours. DRAINAGE NARRATIVE There is no evidence of water entering the property from an offsite source. The water flows towards a drainage ditch located around Varra Companies gravel pit, located just north of the property. The historic water flow on the property is towards the northeast corner. There are currently no drainage problems on the property. The overall site imperviousness is 3.36%. The construction of an Employee Parking Lot and Load/Unloading zone will be paved with gravel and will require each area to be graded to the northeast towards the water quality feature; allowing contaminates to be collected prior to leaving the property and eliminate any potential drainage problems. A water quality feature, of an existing ditch on the north end of the property, will be re-excavated, cleared out, and used to collect stormwater and runoff prior to leaving the property. TRAFFIC NARRATIVE Elite Oil Field Services Inc has a fleet of seventeen (17) motorized vehicles. Those 17 vehicles were observed entering and exiting on to East 16th Street for several weeks to collect enough data to complete this narrative. Of those 17 vehicles, on the average, four (4) vehicles head east on East 16`h Street and thirteen (13) head west on East 16th Street, daily. The observation broke down the vehicles into several categories: vehicles with trailer, vehicles without trailer, tractor/semi/truck, and pickup. The detailed categories made no difference on the outcome; it still averaged 4 vehicle to the east and 13 vehicles to the west. All vehicles entering and exiting on the access road are required to obey all traffic law ordnances, not limited to speed limits, turn signals, and faulty equipment. As outlined by the Department of Transportation all commercial drivers of Elite Oil Field Services Inc, driving vehicles, are required to complete a vehicle inspection report daily. What is stored on site: 100 gallons of oil used for oil changes in vehicles and equipment 100 gallons of hydraulic oil used in equipment 1 -500 gallon tank on skid used for collecting waste oil How waste is disposed of: All solid household waste is placed in a dumpster maintained by Northern Colorado Disposal. All personal waste is deposited into a portable toilet maintained by Reck Flyers. All vehicles and pieces of equipment are washed off site currently. All used oil is picked up by Mesa Environmental All used filters are disposed of at South Central Greeley Wal-Mart. In the event of an oil leak from a piece of equipment, the contaminated soil is removed, hauled by tandem axle dump truck, and disposed of at Waste Management Landfill. All used batteries are returned to the store to collect refund on core charge. The current service provides a Full Standard Tap (water allocation of 1 and plant investment allocation of 1 ) through a 3/4" meter. Elite Oilfield Services has stated they use the facility for a shop and storage yard. Water is primarily used for dust control and washout. The District has no conflict with the proposed use of the property by Elite Oilfield Services. Water tap/service is placed on the physical property, defined by a legal description. In case of a Recorded Exemption, the water tap shall only serve the parcel that the water tap is located on. Service shall NOT cross the legal description of one parcel to serve the other parcel, unless an easement has been recorded for the water service and has been approved by the District. The District guarantees treatment and delivery of water purchased. All water that is delivered with surcharge is subject to water availability. Water purchased through the District shall be 70% delivery of an Acre-Foot of water (228,000 gallons), if the allotment for Colorado-Big Thompson (CBT) project water, which is determined by the Northern Colorado Water Conservancy District, is 50% or greater. North Weld County Water District will restrict the delivery as necessary when the CBT allotment is less than 50%. A portion of the Raw Water Fee is utilized by the District to construct storage reservoirs. The Plant Investment Fee pays for the infrastructure required to deliver 1 AFU (228,000 gallons). If usage exceeds the number of Plant Investments that were purchased, an additional Plant Investment Surcharge will be applied to your account. Plant Investments may be purchased to increase the amount of water to be delivered and avoid the Plant Investment Surcharge. Refer to table below for current Plant Investment Surcharge schedule. Water Surcharge Surcharge will be assessed when an account's year to date usage exceeds their annual allotment. Currently surcharge is $1 .50 per 1 ,000 gallons. This fee is to recover the District's cost to obtain additional water rights for delivery. All water that is delivered with surcharge is subject to water availability. Sufficient screened, off-street, paved parking areas shall be provided in the Industrial Zone Districts to meet the requirements of employees, company vehicles, visitors and customers. According to the application, there will be 60 employees but only two are located on the property full time. The other workers come to the site to get their trucks and proceed to their work assignment. North Weld County Water District serves the residence located on the parcel. Although the residence is not associated with the business, it is included in the USR boundaries. A statement of existing and evaluation must be applied for through this Department. The business utilizes a portable toilet which is acceptable as long as there are no more than 2 full time employees located on the site and none of the other employees stay on site more than 2 consecutive hours. The applicant submitted a dust abatement plan which was adequate. The applicant submitted a waste handling plan which was adequate. Any floor drain wastes in the maintenance shop must be captured in a watertight vault and hauled off for proper disposal. Floor drains in vehicle maintenance areas must not discharge to a septic system. The application states that vehicles and equipment are not washed on the property. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1 . All septic systems located on the property shall have appropriate permits/documentation from the Weld County Department of Public Health & Environment. The Environmental Health Division of the Weld County Department of Public Health & Environment was unable to locate a septic permit for the existing residence. Any existing septic system which is not currently permitted/documented through the Weld County Department of Public Health & Environment will require an On Site Wastewater Treatment System (OWTS) evaluation prior to the issuance of the required septic permit/documentation. In the event the system is found to be inadequate, the system must be brought into compliance with current OWTS regulations. 2. The applicant shall submit evidence of an Aboveground Storage Tank permit from the Colorado Department of Labor and Employment (CDL&E), Oil Inspection Section for any aboveground storage tanks located on the site. Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection Section that they are not subject to these requirements. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with the approved Waste Handling Plan, at all times. 4. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 9 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall operate in accordance with the approved Dust Abatement Plan, at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times.
