Description of Proposed Use This USR application is referred to as the KMG 19-3i Communications Tower and is from Kerr-McGee Oil and Gas Onshore, LP, (KMG) a wholly owned subsidiary of the Anadarko Petroleum Corporation. Anadarko/Kerr-McGee operates over 5,000 oil and gas wells in the Denver-Julesburg(DJ) Basin with the vast majority being located in Weld County, Colorado. In addition, KMG owns and operates a Salt Water Injection Facility(KMG I9-3i). All of these sites require towers to bring essential safety and business related communications to and from the Integrated Operations Center located in Evans, CO. Further, these towers are crucial in emergency response efforts and are a key piece in protecting the health and safety of the public during a catastrophic event, such as the recent flood of 2013. KMG currently performs these communication and monitoring functions through space leased with American Tower. American Tower has notified KMG that they will have to vacate the tower in February 2014. In response to this recent development,KMG is proposing the installation of a new tower to facilitate the company's communication needs. This application addresses the development of the KMG I9-3i Communications Tower. KMG proposes to place the new communications tower within the parcel containing the existing KMG 19-3i Salt Water Disposal Facility. The proposed site will be less than one acre in size. It is located in the W/2SW/4 of Section 3, Township 1 North, Range 68 West,just North of the intersection of WCR 7 and WCR 12. The site is currently zoned Agricultural and is surrounded by Agricultural zoned properties. The proposed equipment to be installed on site includes a 190' communications tower with an additional 2' lightening rod attached. In addition,there will be a 35' x 35' foundation pad with a shelter. Please see the Site Plan in the Appendix for a more detailed layout of the proposed equipment to be installed on site. The communication tower will be functional 24 hours a day, 7 days a week, 365 days a year. KMG obtained an access permit and accompanying road maintenance agreement from the Town of Erie on October 21, 2009 for access off of Weld County Road 12 to the property. This agreement is still in effect as long as KMG is conducting oil and gas operations on the Property. Please see the appendix for copies of both agreements. Consistency with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan Section 22-2-10 (D) emphasizes the extraction of natural resources as an important part of the economy of the County. The development of this site contributes to the expansion of the county's industrial economic base by providing an essential safety function in the operation of oil and gas wells and related industry operations. The Weld County Comprehensive plan addresses goals and policies for agriculturally zoned properties and oil and gas deposits. The Comprehensive Plan also addresses the presence of oil and gas deposits in the County and encourages the extraction of oil and gas resources that conserve the land and minimize the impact on surrounding land and the existing surrounding land uses. The proposed facility will ensure that these operations are done so in the safest way possible. 3. Consistency with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. Oil and gas facilities are allowed as a use by right in the A (Agricultural) Zone District. However, oil and gas support service operations such as this proposed communication tower require the approval of a Use by Special Review Permit(Section 23-3-40(A)). 4. Surrounding uses and compatibility with surrounding uses. The KMG 193i communications tower is surrounded primarily by agricultural lands. Consideration has been taken to ensure that the communications tower will operate in a manner that is compatible with existing and planned uses in the area. The safe operation of our operations is a crucial component of the production of this valuable resource. Safe operations will not only foster the development of an important economic base but will also contribute to the convenience and general welfare of the residents of the County. The site contributes of the County's tax base with little or no adverse impact in terms of additional roads or other governmental expenditures. 5. Describe the following: a. Number of people who will use this site The tower will be in continual communication with the Integrated Operations Center located in Evans, CO 24 hours a day/365 days a year. b. Number of employees proposed to be employed at this site There will be approximately one part-time employee assigned to the Salt Water Injection facility where the tower will be located. During construction additional personnel will be on site until completion. c. Hours of operation The tower will be in operation 24 hours a day,7 days a week, 365 days a year. d. Type and number of structures to be built on this site There will be a 35' by 35' foundation pad with shelter for the 192' communications tower. e. Type and number of animals, if any, to be on this site There are no animals on site. f Kind of vehicles that will access the site and how often The tower will be visited on an as-needed basis. g. Who will provide fire protection to the site The Fort Lupton Fire Protection District will provide fire protection to the site. A referral packet will be sent to the District by the County. Once an approval letter is received it will be placed in the Appendix. h. Water source on the property The KMG communication tower will not have potable water but the KMG 19-3i salt water injection site it is located on will be serviced by Deep Rock Water service for potable drinking water. i. Sewage disposal system The KMG I 9-3i salt water injection site will be equipped with a port-a-pottie (contact information for companies providing the service can be found under the waste handling plan). j. Storage or warehousing There is no storage proposed with this communication tower. 6. Proposed Landscaping There is no existing screening and no additional landscaping is being proposed with this application. 7. Reclamation Procedures Should the site no longer be needed by Anadarko, all equipment will be removed and the ground re- graded to accommodate agricultural uses. 8. Storm Water Drainage A drainage report is not required for this site. 9. Construction Period Construction of the site is anticipated to commence soon upon approval of this requested USR. Construction is estimated to take approximately three weeks. 10. Waste Handling Plan KMG has a Waste Handling Plan (Plan)that covers all operations. This plan is used to determine how to best manage waste generated as part of our operations. The objective of the Waste Handling Plan is to ensure waste generated around the Communications Tower is managed in accordance with all Local, State and Federal regulations. Additionally, the Plan identifies operational chemicals used or stored on site regarding specific disposal pathways. Kerr- McGee/Anadarko personnel are trained annually with regards to proper Waste Management practices. The facility will be serviced by Waste Management for solid waste removal. A small dumpster will be located onsite. All liquids will be managed and disposed or re-cycled. The municipal waste dumpster will be managed and disposed of by a contract waste management company. The dumpster will be emptied either weekly or every two weeks. Non-routine waste(e.g. spills or releases)will be managed in accordance with Anadarko's Emergency Response and Oil Spill Contigency Plan. Spills, as appropriate, will be reported to the proper regulatory agency(s). Additionally, a site specific Spill Prevention Control and Countermeasure(SPCC) Plan will be developed to outline appropriate actions to be taken in the event of a spill or release. The SPCC Plan in conjunction with the Emergency Response/Oil Spill Contingency Plan will ensure that all appropriate response actions are taken and that all waste will be handled in accordance with applicable rules and regulations. Both documents are written in accordance with requirements set forth by the Environmental Protection Agency. Regarding a motor vehicle oil leak(potentially during construction), Anadarko standard operating procedures are to excavate the impacted soil and haul it to the Buffalo Ridge Facility in Keensburg, CO or other similar facility. Once the impacts are removed, Anadarko back fills the excavation with clean fill. Dust Abatement Plan During the construction phase of the project, Anadarko will utilize water trucks to maintain dust suppression. After construction is completed the site will be stabilized using native vegetation in allowed areas, which will not be allowed to grow over 12" high. Additionally, Anadarko will gravel the access drive and circulation pattern. In addition, a water truck will be utilized to control dust after construction, if required. Kerr! Additionally, Federal Aviation Administration Form 7460-1 is being submitted as part of this application and addresses this concern. 3. This site will be un-manned and will only require traffic during maintenance activities. Most maintenance activities require access by a couple ofl ton pickup trucks. All traffic during construction and normal operation is expected to come from the West on WCR 7 to WCR 12 where the access road is located. Operational Standards NOISE CONTROL: The operation of the KMG I 9-3i Communications Tower shall comply with the noise standards enumerated in Section 802 of the COGCC Amended Rules 2008. It is anticipated that the proposed equipment will actually have minimal noise emissions. Additionally, the rural nature of these sites is preferred to mitigate the effects of noise emissions on the surrounding property owners. AIR AND WATER QUALITY: All activities will be in compliance with the permit and control provisions of the Colorado Air Quality Control Program, Title 25,Article 7, C.R.S. as applicable. All water and waste will be carried by vehicle off site. LIGHTING: There is no lighting currently proposed on the Communications Tower, however the FAA could potentially require lighting to be added to the tower at some point in the future. WEED CONTROL: The Communication's Tower area will be kept free of weeds, rubbish and other material. The area shall be treated if necessary and as practicable to prevent invasion of undesirable species and noxious weeds. Required Permits Weld County: A Use by Special Review Permit is required to be approved by the Board of County Commissioners prior to construction of this facility. Kerr McGee/Anadarko will submit any additional permits necessary for county approval prior to the commencement of construction on site. Fort Lupton Fire Protection District: The Site Plan and Special Review Use Application will be refered to and reviewed by the Fort Lupton Fire Protection District. Approval of the plan is expected. A letter from the fire district regarding this proposal will be added to the Appendix once it is received. Oversize Load Permits: If necessary, oversize load permits will be obtained prior to moving any new equipment onto the site. Access Permits: Traffic plans are not required to be submitted as part of this application. In addition to the above- referenced rules and regulations, Anadarko is also subject to COGCC Rule 6064 pertaining to Fire Prevention and Protection. Colorado (the "Property -) and certain oil and gas leases covering the Property on which KMG plans to drill one or more. oil and gas wells and install pipelines. gathering systems and other facilities on the Property. and Whereas. the portion of the right-of-way of WCR I2 adjacent to the Property is located within the boundary of Erie and Erie has the maintenance responsibility for such right-of-way. and Whereas. KMG has constructed an injection well facility on the Property and KNIG will construct other oil and gas wells. roads and facilities on the Property and has applied for an access permit from the Erie Department of Public Works to access the Property from WCR 12 (the "Original Road') for all of its operations on the Property, and Whereas. Erie has requested that KMG enter into a Road Maintenance agreement for the use of Weld County Road 12 between Weld County Road 7 and the east line of the S'2SW14 of the Section 3 above described, including the intersection of WCR 12 and WCR 7 (the "Maintenance Segment"). Now. therefore. for and in consideration of the premises and the mutual obligations contained herein. the Parties agree as follows: 1 . Except as provided in this Agreement. the surface of the Original Road shall remain at its existing approximate width and construction material. No widening or narrowing of the road shall be done without the Town of Erie notifying KMG 90 days prior to the construction. Prior to using the Original Road for access to the Property, KMG will improve the Maintenance Segment by adding nine (9) inches of class 6 road base (the -Improved Standard-). KMG will keep the Maintenance Segment free and clear of mud caused by KMG's operations on the Property. K\IG's private access drive on the Property from WCR 12 shall be improved as a hard surface (concrete or asphalt) for the first fifty feet (50) from the street and then improved as a crushed surface (concrete or asphalt) for one-hundred and fifty feet ( 150') past the hard surface according to the Improved Standard pursuant to paragraph 1. above. 4. KM(i and Erie recognize that as a prerequisite to KMG's commencement of the improvements referred to in paragraph 1 hereof.
