RESOLUTION RE: APPROVAL OF SPECIAL USE PERMIT FOR TRI-STATE GENERATION AND TRANSMISSION ASSOCIATION, 12076 GRANT STREET, THORNTON, COLORADO 80241 WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, held a public hearing on the 24th day of August, 1977 , at the hour of 2 : 00 o' clock p.m. , for the purpose of hearing the application of Tri-State Generation and Transmission Association, 12076 Grant Street, Thornton, Colorado 80241, for the granting of a Special Use Permit for the Route Selection for Lone Tree 115 KV Project - Study Corridor, to be located along the north side of Weld County Road No. 48 in Section 6, Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado, and WHEREAS , the petitioner was present, and WHEREAS, evidence was presented in support of the grant of the Special Use Permit for the Route Selection for Lone Tree 115 KV Project - Study Corridor along the north side of Weld County Road No. 48 in Section 6 , Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado, and WHEREAS , Section 4-4 (A) (4) of the Weld County Home Rule Charter requires that the placement of utility transmission systems, be reviewed by the Weld County Planning Commission, and the Weld County Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed and satisfied that the request for a Special Use Permit for the Route Selection for Lone Tree 115 KV Project - Study Corridor, on the hereinabove described County Road, complies with all the conditions as set out in Section -4-4 (A) (4) of the Weld County Home Rule Charter, and having been fully informed and 770378 PL 113 I satisfied that the requested use complies with the Weld County Comprehensive Plan, NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com- missioners of Weld County, Colorado, that the application of Tri-State Generation and Transmission Association, 12076 Grant Street, Thornton, Colorado 80241, for the Route Selection for Lone Tree 115 KV Project - Study Corridor, on the above-described County Road, be, and hereby is, granted subject to the Develop- ment Standards contained in the Special Use Permit. BOX 1727 FORT COLLINS, COLORADO 80522 PHONE 482-2313 June 14, 1977 Mr. Ray MacWilliams Weld County Planning Greeley, Colorado 80631 Dear Mr. MacWilliams: Apparently, there has been some confusion concerning our proposed Lonetree Substation, the transmission facilities required to serve the Lonetree Sub- station, and the fact that Poudre Valley REA has not been involved in any of your hearings in Weld County. Poudre Valley REA owns and is responsible for the substations and the distribution system. Transmission lines and generation is furnished by Tri-State G & T. The only exceptions to this are the facilities to serve individual large industrial consumers or small projects that we can fund and complete to fit our schedule rather than Tri- State. The Lonetree Substation has been a part of our long-range plans since 1970. The exact location and size were not determined at that time, but the name was chosen because we knew it would be needed in the Lonetree-Welch Reservoir area. The south part of Larimer County as well as the west part of Weld County are presently being served from our Hygiene Substation located in Boulder -2- County and has been during the last 26 years. It is approximately 121/2 line miles from Hygiene to the proposed Lonetree site and another 121/2 line miles to the end of the circuit in the Johnstown area in Weld County. Our distri- bution voltage is 7200/12,470 volts. Rule of thumb design criteria says that it is practical to provide one mile of distribution length for each 1000 volts of distribution voltage or 12 to 13 miles for our system voltage. It is, therefore, obvious that the area from Berthoud east is not being served efficiently and the excess line exposure subjects this area to outages that it really should not have to experience. These outages create many difficulties for our irrigators in the Berthoud and east areas. The following is a listing of the electrical demands for the Hygiene Substation which winter peaks: 1970 3258 KW 3240 KW 1971 3744 KW 4068 KW 1972 2726 KW 3112 KW 1973 4860 KW 4248 KW 1974 4536 KW 5292 KW 1975 5652 KW 5652 KW 1976 5832 KW 6264 KW 1977 6912 KW By comparison, our total system demand was 24,978 KW in 1970 and 60,451 KW in 1976. Hygiene serves no industrial load so its growth rate reflects strictly farming, rural housing, and resort use. The recent trend by agriculture interests to conserve water and obtain more effective coverage of crops have developed further increases in our load growth by adding or converting existing irrigation systems .to high pressure center pivot irrigation systems. The above figures exemplify the reasoning for the proposed substation facilities. The only alterna- tive to this proposed construction would be to refuse new loads or to provide increase service for our existing consumers. In light of the increasing diffi- culties to obtain natural gas as an energy source for space heating, grain drying and etc; alternate forms of energy are in great demand. Poudre Valley does not -3- wish to prohibit these local requirements of our consumers. When Lonetree is in operation, the open points between substations will be located further east to allow immediate capacity to be released in the western Weld County and eastern Larimer County area. This release of capacity will blend with future long-range plans to insure adequate capacity with sufficient service reliability. One thing I have not specifically addressed is "Is it possible to serve the area without the Lonetree Substation?" If all economic and local impact considerations are ignored then yes it could be done. It would, however, require acquisition of a little distribution right-of-way. This along with the construction of multi circuit, large conductor lines. I call these lines christmas trees because of the many limbs and ornaments displayed. These lines would be greater in number, have greater impact on farming, ie. anchoring in fields, cause considerable visual impact over a large area as well as costing a great deal more money. The relatively short- single pole transmission line to be constructed, one mile in Weld County and two miles in Larimer County, would reduce all of the negative effects of a super-distribution system. Another consideration is that Colorado regulates all utilities via the State Public Utilities Commission. Under Commission rules, the State not only guarantees territorial integrity and rights of emminent domain but also regulates rates and operating procedures. Electric utilities must be ready, willing, and able to serve all requirements within their certificated service boundaries in accordance with the filed tariff and extension policy. Any refusal to supply full service to a customer, new or existing, would result in a commission order to serve. -4- So far as transmission line routing is concerned, Poudre Valley REA has no real say. Our contract with Tri-State makes it their obligation to supply transmission voltage to our rural load centers. I do know, however, that Tri-State has gone to considerable expense to provide double circuit capability along with the Platte River Power Authority Line along Weld County Road 3. It would have been cheaper to provide more single-circuit line from the Windsor, Loveland, Longmont, or Flatiron area which are the only tap points left in this area. Noting that these alternatives would have much more impact, both physical and visual , the decision to go joint with Platte River was made. I know other routes for this system have been investigated. One of the routes was along the half section line to the south of the proposed route. This was abandoned for the same reasons Platte River Power Authority switched from a half section line route to a section line route. There would be greater impact to agricultural land than would be if the line were located adjacent to a county road. The routing and substation site, , as proposed, has been approved by the Larimer County Planning Board. This was met with only one objection from the audience A Mr. Kerlind objected because of the visual impact; but as explained, there would be far less effect than a christmas tree distribution multi-circuit line with 20 poles to the mile compared to the transmissions 10 poles in that mile. Also, Mr. Kerlind wishes to develope his property as a religious recluse. This development would require additional electric service from Poudre Valley REA. This additional power is what we wish to make available with the least impacts to the residence of both Larimer and Weld Counties. -5- We, therefore, request that the hearing on this matter be reopened to rectify some of the erroneous information that might have surfaced during the last hearing and that we might have this imput be noted. Also, we would like the opportunity to openly discuss the matter and answer any questions that might arise. We feel the importance of this proposal very real to us and Larimer and Weld Counties considering the adverse effects that this would have to our consumers in the Berthoud to Johnstown and Windsor south areas. As I am sure you are well aware that as landowners of some of the prime farm ground in this area, we are not in favor of this type of construction for many reasons : 1. On prime farm ground as this is, we would have to farm around such a structure forever, thus creating more direct expense and problems once again to the landowner. It appears to us that a suitable site could be found in a waste area, that would not affect such prime farm areas. 2. On Weld County Road 46, there are now approxi- mately 14 residential dwellings, whereas just one mile North there are approximately 4 , thus affecting far fewer people. We realize that it takes great study to put such a structure through an area, and know many of the problems which you face. However, in the last few years farmers have faced many obstacles, and really have only one asset on which to depend for their livelihood, and that is their land and its value, and therefore must be very cautious of any activity affecting this land. Tri-State is a non-profit cooperative power supplier serving 25 member rural electric systems : eight in Colorado, six in Western Nebraska and eleven covering most of Wyoming. Tri-State was formed in 1952 by its members in order to provide themselves with a long-range, firm wholesale power supply at the lowest possible cost. Our inter- connecting generation and transmission system provides electrical power to more than 125,000 square miles. Our members are electric cooperatives and power districts who serve principally farms and ranches, small businesses, a few industries and small communities. Because of the large amount of electrical power involved and fluctuations in demand, supplying power to Tri-State's members is complex. Tri-State has always maintained cooperative efforts with publicly and privately owned utilities so that resources are used efficiently and economically. In this respect Tri-State is currently a participant, I along with Platte River Power Authority, with two other utilities in the construction of the Craig Station near Craig, Colorado. A portion of Tri-State's share will provide the additional power to the northern Colorado area. Thus Tri-State is taking the necessary steps in planning to assure Colorado's rural consumers that adeauate, economical , and reliable electrical energy will be provided for the future. Our Board of Directors is compiled of farmers and ranchers and rural electric system managers involved in agriculture. The Board of I-1 Directors are dedicated to the goals and philosophy of the cooperative rural electric program and concerned for the rural people that Tri-State serves. With this in mind, the following application is submitted to Weld County. This application is divided into three parts. This power line will tap the USBR's Flatiron - Weld 115 kV transmission line at the existing City of Loveland Boyd Lake transmission substation (Southwest Quarter of the Northeast Quarter of Section 19, Township 5 North, Range 68 West) . The line will extend south approximately four miles sharing transmission facilities (double circuit) with Platte River Power Authority's Loveland to Longmont 230 kV transmission line. This portion of the line will , for the most part, parallel the Larimer County Road 11 S. and Weld County Road 3. At Weld County Road 48, Tri- State will independently construct approximately four miles of 115 kV transmission line of which one mile of 115 kV line will be in Weld County. The 115 kV line will begin in the Southeast Quarter of Section 6, Township 4 North, Range 68 West; at this point the line will be constructed in a westerly direction adjacent to the north right-of-way line of Weld County Road 48 one mile to Larimer County line, then continuing to Poudre Valley Electric Association's proposed Lone Tree Substation located in the Northwest Quarter of the Southeast Quarter of Section 10, Township 4 North, Range 69 West in Larimer County. INC. t Full tension structures, 115 kV buses, 115 kV load break switch, 115 kV non-load switches, 96 kV surge arrestors, 115 kV wave trap, concrete footings , and eight-foot security fence (See Figure 2) . Type of Facilities The four miles of double circuit line to be constructed jointly by Tri-State and Platte River Power Authority will consist of single steel pole construction designed to support two circuits, whereas, each circuit will consist of three conductors and an overhead ground wire. 397.5 MCM ACSR 26/7 and 6-1780 KCMIL 84/19 conductors will be used by Tri-State and Platte River Power Authority. The pole structures will have maximum spans of 1,000 feet and require 100-foot right-of-ways (See Figure 3) . The proposed four miles of single cut 115 kV power line to be constructed by Tri-State will consist of single wood poles with upswept laminated arms (See Figure 4) . The wood poles will be approximately 60 to 70 feet tall depending on specific locations. Each pole will require a hole approximately two feet in diameter and approximately 9 to 10 feet deep. The poles will be 15 to 18 inches in diameter at the base, tapering to 7 to 8 inches in diameter at the top. Structures will be placed approximately 500 feet apart or approximately 10 structures per mile. Each structure will consist of a 3/8" overhead static wire and three 397.5 CM conductors. This 115 kV line will provide the source for the proposed Lone Tree distribution substation. This system support is necessary due to the rapid urbanization and industrialization of the area. Alternative Routes The economic and technical feasibility of one mile of underground transmission circuit at 115 kV was- investigated. The only advantage to be gained by underground transmission facilities would be to reduce the visual impact. There are numerous disadvantages found. Construction would entail excavation of a trench for one mile, resulting in a permanent scar to the land. No large vegetation can be permitted near the buried conductors. Line fault detection, isolation, and repair of underground lines would require days compared to hours for overhead facilities . An increase in capital investments, increased maintenance costs and line losses would result in excessive and unnecessary financial burdens on the consumer. Underground transmission cannot be considered a viable alternative except in those special cases where the visual impact of an overhead line would justify the inordinate construction, maintenance, and environmental costs, such as densely populated downtown city areas like Chicago, New York, etc. The second alternative route is located one-half mile south of Weld County Road 48. This alternative route would traverse the half section line in Section 7, Township 4 North, Range 68 West to the Larimer County II-7 line, then north adjacent with the County line to Weld County Road 48. There are no advantages for this route. The disadvantages would include one mile of additional poles and conductors and would also have a greater impact on crossing more farmland in addition to acquiring additional rights-of-way. All plausible transmission line routings were considered. The alternative routes were evaluated in terms of their environmental impact and sound engineering practices . The proposed route is deemed to minimize the impact with construction of a minimal number of miles of transmission line. Construction The transmission line will be constructed with modern techniques to minimize the adverse effects. It will also be designed for reliability to minimize the need for maintenance, which will cause less impact on the landscape. Modern single poles, with upswept laminated arms will be used on the single circuit line, instead of the traditional two-pole H-frame structures, which will reduce the impact with field cultivation. The construction practices used in this project will be in compliance with Tri-State's policies which require minimum disturbance to the area. Reclamation Procedures The design, clearing, construction, and maintenance of the proposed facilities and clean up and restoration of the area will follow all applicable criteria set forth by the U.S. Agriculture and Interior in the publication "Environmental Criteria for Electric Transmission Systems" and recommendations in "Environmental Guidelines". II-8 • Tri-State, by its contractual specifications, requires its contractor to limit necessary travel up and down the right-of-way during construction. In places where highly erodible soils are found, special care will be used in traversing them. Where possible, these areas will be by-passed to minimize damage to the soil and other vegetation. If during construction process rutting occurs, the ruts will be filled by the contractor before he leaves the area. When soil disturbance occurs, reseeding will be done to speed restoration process and to prevent erosion if natural vegetation is not sufficient. Should reseeding or land restoration be desired, the guidance of the Soil Conservation Service will be sought. Care will be taken to restore all lay-down areas used in construction and erection of the proposed facilities. II-9 3e EAEMML7 ACQUDZOTCM CHAPTER III EASEMENT ACQUISITION This portion of the application discusses Tri-State's methodology of easement acquisition. Also, attached as Appendix A is a copy of Tri-State's present Easement and Right-of-Way form. Tri-State will utilize the following guidelines in acquiring easements for the Lone Tree 115 kV delivery through Weld County: 1 . All easements will be purchased using the formula that is equivalent to 100 percent fair market value. 2. The easement will be a uniform width of 60 feet. However, due to the unique circumstances, Tri-State, with the permission of the County Commissioners and a written statement prohibiting abandonment of Weld County Road 48, will be able to split the 60-foot right-of-way to 30 feet for the landowner and a 30-foot overlap on Road 48, thus the pole facilities would be at the edge of the field and thereby minimize the interference with agricultural activities. 3. In compliance with the National Electric Safety Code, the landowner will not be permitted to build or maintain structures , hay stacks, or other similar obstructions within the bounds of the right-of-way. The landowner may use the land for all other purposes including farming and grazing, so long as either the property of the landowner or Tri-State is not endangered. III-1 4. Tri-State will build and maintain standard gates, if necessary, along the line route for construction and maintenance of the line. Attached as Appendix B is an illustration of this gate structure. Surveillance of the line will be done by air. Therefore, land compaction and soil erosion from maintenance efforts will be minimal at most. 5. The grantor will retain all mineral rights to the property. 6. Should Tri-State abandon the easement for an electrical transmission line, then the easement will revert to the landowner. . 7. Tri-State will pay the landowner for all damages caused by the surveying, construction, and maintenance of the line. This payment is not included within the right-of-way acquisition payment. Settlements for construction and surveying damage will be negotiated after the line is installed. One hundred percent of damage caused by construction is re- imbursable. The above somewhat simplifies the attached easement form and its inherent legal language. In any respect, each of the above numbered concepts correctly expresses Tri-State's intentions in easement acquisition. III-2 ,_ . . William Campton of the County Highway Department appeared before the Commission with information about County plans in regard to projections of road plans for the Berthoud area. Mr. Campton pointed out several ideas being pursued by the County involving Wilson Avenue and U.S. HIghway 287. He agreed to supply additional information with mapping of possible alternatives so that this subject may be discussed fully at the next meeting to obtain some input from the community. The minutes of the April 28, 1977, meeting were approved as read. After discussion of the proposed replat of Lots 1 through 6, Blk. 8, Welch 2nd Addition to the Town of Berthoud dividing the property into three lots, Tom Patterson moved to recommend approval with the provision that any alley requirement as to paving be met and all easements for utilities be worked out and shown on the final plat. Roger Banzhaf seconded with all members voting in favor of the motion. Rod Knox presented plans on the Starkey Subdivision located West of Berthoud. Dick Strachan moved to recommend to the Town Board that they approve the annexation of the Starkey Subdivision with the following provisions added: 1. All signatures be obtained on the plat and annexation petition before being forwarded to the Board, 2. That an historic water affadavit be furnished, 3. A statement be furnished that utility capacity to serve this area be limited to the Town's ability to serve, 4. These items be clarified in the petition itself. Tom Patterson moved that the final plat on the Starkey Subdivision be tabled to allow time for referral information to be received until the next meeting date. Kenneth Krieger moved that due to the concern shown by home owners from the area in attendance at the meeting that denial be recommended for the replating of Lot 9 in the Majestic View Estates also known as Park Meadows West because of testimony evidencing apparent restrictive covenants. Duane Ritchie of Poudre Valley Rural Electric Association and Wayne Water— man of Tri—State Generation and Transmission Association spoke on the proposed transmission line and substation north of the community. The line will run on the section line between Sec. 1 and 12 and Sec. 2 and 11 to the sub—station in the North West corner of Sec. 10. Dick Strachan moved that the Planning Commission express its concern relating' to the close proximity of the power line to the Town Reservoir and the effect that an easement might have on future expansion of the lake; that if the substation is located at the proposed site there be provisions for esthetic screening; and necessary setbacks for future widening of future right of ways be provided. On Weld County Road 5 immediately north of Highway 56, approximately one-fourth mile of roadway becomes very muddy and slippery when it rains or snows. Additional gravel on this portion of the road would be very helpful to those of us who use it often. 2. Also, on Road 5, I believe it would be a safety factor to post a speed limit of 20 or 25 miles an hour on the south side of the hill next to my home at the above address. Such action may help to avoid possible accidents with school buses which turn around on the north side of the hill each school day and with vehicles turning in and out of my yard. 3. It is my understanding that Tri-State wishes to erect a power line on Weld County Road 48 west from Weld County Road 3 where there is an existing line. I am part owner of property in the E' NW's 7-4N-68W. I wish to state that I feel it is not a good place for the power line because too many of our greenbelt areas are becoming pole and wire areas which are detrimental to both farming and wildlife. In fact, a State Wild Life Area (Lucy Murphy Property) is located at Road 1 and Road 48. It has been stated that Tri-State has plans to erect a line just south of Loveland. Since my nephew Timothy is in the Philippines with the U.S. Air Force and cannot be present here personally to represent himself and others, I sneak for him, as his agent in this regard. The land concerned is the 54 of the approximate 25 acre tract west of the McIntyre Lateral, in the SW.1z, of section 6. This parcel slopes down toward the lake at the west end and gives an especially attractive view of the mountains, with the Front Range and its high peaks standing out clearly, over the lake in the foreground. Until I gave the south half of the 25 acres to my nephews, I was continually bombarded with requests to buy this tract, because of its scenic appeal. That is its special feature. Now, a 60 to 70 foot-high row of poles and transmission cables along the road past it would damage the scenic value very decidedly. To make matters still worse, the poles and lines would be on that side of the road, as Tri-State requests it, on the edge of the tract. That is, on the property, itself. And the parcel is comparatively long and narrow, about 550 by 1,000 feet. With the long dimension along the road, it would suffer especially high-ratio damage from a power line on the south edge of the strip. All of this can be seen at a glance by a look at the property, by driving by it. Altogether, the impact of a high voltage transmission line there would severely damage this choice acreage and its special scenic value. We ask the Planning Department officials and the County Commissioners to observe and to consider the particular effect of Tri-State's proposed route over the edge of the property of Timothy Kirlin et al. We object most strongly to this proposal and plan of Tri-State's, because it would complete the ruin of the site for a religious and charitable establishment there. The location is already substantially damaged by the Platte Rive Power Authority's high voltage line on the east side of the place. Tri-State's addition would finish it off, would ruin the site! This is Tri-State's participation in Platte Rive-r 's line. And PRPA was the subject of special concern and a big issue in these communities from Fort Collins to Longmont in 1975, when Platte River wanted to slash through the middle of 11 sec- tions between Loveland and Longmont. They would gladly have done so, except that wise and just Commissioners of Weld and Larimer Counties, meeting in the Council of Governments sessions, forced PRPA out of the fields onto the County roads, instead! Only that action of the County Commissioners saved the farms for many miles from wholesale mutilation and permanent damage by PRPA. It should be remembered th-t Platte River's original plan was a single circuit, 115 KV line -- until Tri-State got interested and had them up it to a double circuit, 230 KV monster, to accomodate Tri-State as well. And it was a settled matter at that time that Pri-State would run their east-west line one mile farther south, along Sections 7 rL8. In the big community hassle with PRPA then, there was no question and no discussion of any other route for Tri-State. Now, we hear that Tri-State has considered various other routes. Even a PRPA engineer told me of this, expressing obvious irritation at Tri-State's uncertainty and repeated changes over a pericd of 21/2 years, as he stated it to me. Their route has apparently been something of a football, booted about considerably, in- fluenced by different interested parties. This is very much the case now. What unerring aim! The first location couldn't have been so damaging, couldn't have been so ruinous. This one would be completely so. PR-PA has given the roads along the 160 acres enclosing the site 50% coverage, traversing the east side of it, the east road. Now, Tri-State wants to give it 100; coverage -- 100% damage -- by passing on the south side, enclosing it along the only remaining road! We most strenuously protest and object to the Tri-State 'wrap-around' : We most urgently object to the Tri-State choking act! -- to the killing off of this unique and irreplaceable site, the finest site in the West -- simply for Tri -State's convenience! This site is for a re- _ .ous and charitable establishmc _, for a religious group of wcrld renown, the Benedictines of Solesmes, France,, as described in an earlier letter to ycu, in the spring of 1975, at the time that 'RPA was attempting to slash through the heart of the place and destroy the site -- their intended home-site in America. This is not a business interest or effort. It is not an individual matter of merely temporary concern, but a community affair, and more. It is an affair of state-wide importance, and even national significance. The purpose is not just for the local area and community, alone, but for Colorado and the West, as well, for the State and even the Nation, for America as a whole. T point ou that this question deserves consideration proportionately. It should be judged on that level, versus the minor, local and temporary reasons of virtually every party objecting to the original Tri-State route. Take into consideration the life, the continuance of the different individual interests and parties concerned here. A religious establishment, of this kind, an abbey, would normally endure for centuries. It could be longer than that, as Monte Cassino, extant since the early 500s. Also, their establishment here would preserve the place as a green isle, amid the inevitable housing developments that can be expected, for these centuries of time. Consider the ratio of distance -- perhaps a quarter of a mile, more or less, for various parties interested, versus the approximate mile and one half of high voltage transmission line enclosing this place and its site, which Tri-State proposes for it, in the Tri-State 'wrap-around' act. Platte River would gladly have ruined the site outright and immediately, if only the County Commissioners had let them do so. Now, Tri-State would like to complete the damage and destruction. i'latte River has inflicted severe da-^ar?e, by traversing the east edge of the place with their transmission line. But Tri-State's additional designs are still more menacing and critical. Tri-State would at once make the site and situation for the Religious c cnplete and simple ruin! Let Tri-State take the original route, rather than shoving it off on some ore else- where, rather than ruining something far mere significant and imorrt,ant. Sites are rare; routes are innumerable! There is plenty of room left elsewhere. Consider the religious, artistic and cultural values at stake here, too, in the final decision. Or, would the officials of Weld County prefer to sacrifice a charitable institution of special distinction and world-wide importance, for Colorado and even for America at large, in order to convenience a mere commercial power company?
