This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all inclusive; as other issues may arise during the remaining application process. COMMENTS: CR 126 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant shall delineate or dedicate an additional 10-foot of right-of-way parallel to the CR 105 right-of-way for future build-out. Section Line: CR 19 (NO right-of-way for the first one-half mile north of CR 126) REQUIREMENTS: Access Permit Application Form: The applicant has supplied this form identifying that a 12" pipe (CMP) shall be placed at the entrance as a part of the tracking pad with double cattle guards across both lanes of the entrance. Weld County has a minimum standard of a 15' CMP. Pictures at the proposed entrance have never been supplied as a part of the application. Our Traffic Engineer will evaluate the Access Permit Application and accompanying documents. The fee is $150.00 (large commercial) for your new access permit. Show the approved access on the plat and label it with the approved access permit number (AP14- 00043). Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code. Traffic Study: The applicant in the traffic narrative is indicating that there will be truck traffic (out and back) at 80 trucks per day. The road connects 1-25 to the west with US Highway 85 to the east. The number of trucks traveling east or west from the site will be based on customer location and product need. Drainage Report: The applicant submitted a Drainage Narrative from Blue Earth Solutions dated Oct. 21, 2013. The historical flow patterns and run-off amounts will be maintained on site. Flood Hazard Development Standards: This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA), but Lone Tree Creek was not mapped at this location. Mining will not occur within the Lone Tree Creek channel. Improvements and Road Maintenance Agreement: This document is required for this site. Road maintenance including repair and triggers for improvement will be included. This is a new location for the Connell Carr Pit. The site entrance is to be located on County Road 126. A new Road Maintenance and Improvements Agreement for CR 126 (haul route) with triggers: (1) 10 vph during peak hour turning left into the facility-left deceleration lane. (2) 25 vph during peak hour turning right into the facility-right deceleration lane.(3) 50 vph during peak hour turning right out of the facility-right acceleration lane. As this is a temporary use, portable toilets and bottled water are acceptable for sanitary uses. Noise will be restricted to the level allowed in the industrial zone district. Noise can be limited by utilizing haystacks, white noise backup beepers, equipment located at bottom of pit and a circular mining pattern. Dust abatement will consist of watering roads and not mining when there are high winds. Water for dust control will be trucked in. Waste will be placed in covered containers and taken to the landfill as needed. Fuels and lubricants will be stored in sealed containers and disposed of or recycled according to appropriate regulations. The State does not require registration of aboveground fuel storage tanks associated with gravel pits as long as the following requirement is adhered to: "Aboveground storage tanks used to store flammable and combustible liquids at mining facilities and construction and earthmoving projects, including gravel pits, quarries, and borrow pits where, in the opinion of the state inspector of oils, tight control by the owner or contractor and isolation from other structures make it unnecessary to meet the requirements of this article." The fuel tank shall be contained within a secondary containment berm. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirement be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. Alternately, the applicant can provide evidence from the Air Pollution Control Division, Colorado Department of Health and Environment that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 4. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code. 2 7. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. Portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 8. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 9. All potentially hazardous chemicals must be handled in a safe manner, in accordance with product labeling, and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 10.The facility shall be operated in a manner to prevent odors. Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. Additional controls shall be implemented at the request of the Weld County Department of Public Health and Environment in the event odor levels detected off site of the facility meet or exceed the level of fifteen-to-one dilution threshold, or in the judgment of the Weld County Health Officer, there exists an odor condition requiring abatement. 11.The applicant shall obtain a Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, as applicable. 12.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. 3 From: Kristine Ranslem To: Kim Oale Subject: FW: U5R14-0005 Referral Date: Tuesday,February 11,2014 8:52:17 AM Please see the referral comments below. Platte River is a Colorado political subdivision formed under C.R.S. § 29-1-204. Platte River operates as a wholesale electric generation and transmission provider for the communities of Estes Park, Fort Collins, Longmont, and Loveland. Its generation resources include a number of natural gas turbines located at the Rawhide Energy Station in Larimer County. Platte River operates a 16 inch underground natural gas pipeline that borders the west side of the subject property of this permit application. This natural gas pipeline is essential to the reliable operation of the Platte River system. Moreover, any damage to this pipeline could result in serious injury and significant property damage due to the high operational pressure of the line and the volatility of the natural gas. Based on information sent to Platte River by Blue Earth Solutions (consultant for Connell Resources, Inc.), the project proposal notes a setback from the Platte River pipeline Right of Way of 25 feet. To ensure the integrity of our pipeline and to accommodate any future expansion of Platte River's pipeline system, Platte River suggests this setback be extended an additional 25 feet, effectively eliminating any mining activity within 50 feet of the boundary of the existing Right of Way. Water Division 1, Water District 1 Dear Mr. Ogle: The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. The application seeks a site specific development plan and use by special review permit for mineral resource development facilities associated with open pit mining. The site is known as the Connell Carr Pit and will be operated under DRMS permit no. M-2014-001. This will be a surface mining operation on 456.0 permitted acres. The primary commodities to be mined at the site are sand and gravel. The site facilities will include a mine office/scale house trailer, equipment maintenance building, portable processing plant, and possibly a portable asphalt plant. The site is anticipated to have up to five or six on-site employees during mining and processing operations. Domestic water will be provided by bottled water, and on-site sanitary disposal will be provided by use of portable toilet facilities. Water is not anticipated to be required for the washing of product materials. Water required for dust control purposes will be trucked in from off-site sources. The Applicant should document that this water was obtained from a legal source that allows for such industrial use. The Applicant does not expect to encounter ground water during mining. Therefore, exposure of ground water must not occur during or after mining operations. During mining operations, storm water runoff from disturbed areas is expected to be contained within the mine pit. Any storm water runoff intercepted by this operation that is not diverted or captured in priority must infiltrate into the ground or be released to the stream system within 72 hours; otherwise a substitute water supply plan or augmentation plan approved by water court must be obtained. I don't have any concerns with the truck traffic from this site going westbound since they will be entering I-25 at an interchange. I do have some problems with the site's US 85/WCR126 intersection. It doesn't appear that there are any turn lanes at that location. If traffic to the site is coming from the south on US 85 to CR 126, they will be required to make a left turn lanes. Per the Access Code, it would only take 10 vehicles/day to warrant the construction of that lane. Because it is an off-system development CDOT does not have the ability to require the construction. We would need the County's assistance with that. However, since the development intensity is unclear and the location so far away from the intersection, the County may have a different perspective.
