HomeMy WebLinkAbout20141648.tiff ' '1 • • RESOLUTION RE: ACKNOWLEDGE CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 2006-1981) FOR PARCEL #0963-21-2-29-001 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has received one (1) Tax Lien Sale Certificate (TS CERT 2006-1981) for parcel #0963-21-2-29-001, from the Weld County Treasurer, and WHEREAS, the facts as set forth on the Certificate of Cancellation, marked Exhibit A, a copy of which is attached hereto and incorporated herein by reference, require the cancellation of TS CERT 2006-1981, and WHEREAS, the facts as set forth on Exhibit A further authorize the denial of a refund to the holder of said certificate, and WHEREAS, after review, the Board deems it advisable to acknowledge the cancellation of the Tax Lien Sale Certificate (TS CERT 2006-1981) for the property described above and to deny a refund to the holder of the Certificate. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that cancellation of the Tax Lien Sale Certificate (TS CERT 2006-1981), on parcel #0963-21-2-29-001, by the Weld County Treasurer, be, and hereby is, acknowledged. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 2nd day of June, A.D., 2014. Lefebvre, Jr. May 27, 2014 MEMO TO: WELD COUNTY COMMISSIONERS REQUESTING CANCELLATION OF TAX LIEN SALE CERTIFICATE OF PURCHASE NUMBER-20061981 ACCOUNT#R3394305 PARCEL#0963-21-2-29-001 LEGAL DESCRIPTION: KER KFP LI BLK3 KOHLER FARM PUD Tax Sale Certificate number 20061981 was purchased by JAMES P BOYLE on NOVEMBER 1, 2006, and whereas, the said JAMES P BOYLE was notified and given the opportunity to endorse all subsequent taxes onto his certificate and make application for a Treasurer's Deed himself. JAMES P BOYLE chose not to take any action. Therefore, I am hereby asking for Tax Sale Certificate 20061981 to be cancelled due to a second Tax Lien Sale Certificate of Purchase being struck off to Weld County on NOVEMBER 2, 2009 and said duly assigned the Tax Sale Certificate of Purchase to MCB TRUST LLC. The said MCB TRUST LLC then made application for a Treasurer's deed to the property. A Treasurer's Deed was issued to MCB TRUST LLC on MAY 15, 2014. This creates the need of a resolution by the Board of County Commissioners to cancel TS CERT 20061981 per C.R.S. §39-11-120, see annotation 7, Benedict v. Coriolanus Corp., 30 Colo.
