RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
USR13-0018, FOR MINERAL RESOURCE DEVELOPMENT FACILITIES, OIL AND
GAS SUPPORT AND SERVICE (CRYOGENIC FACILITY FOR THE PROCESSING OF
NATURAL GAS PRODUCTS), AND RELATED EQUIPMENT AND STRUCTURES, AND
ONE COMMUNICATIONS TOWER (35 FEET IN HEIGHT) IN THE A (AGRICULTURAL)
ZONE DISTRICT-STERLING ENERGY INVESTMENTS, LLC
A public hearing was conducted on February 5, 2014, at 10:00 a.m., with the following present:

The following business was transacted:
e I hereby certify that pursuant to a notice dated January 2, 2014, and duly published
January 7, 2014, in the Greeley Tribune, a public hearing was conducted to consider the
request of Sterling Energy Investments, LLC, for a Site Specific Development Plan and Use by
Special Review Permit, USR13-0018, for Mineral Resource Development Facilities, Oil and Gas
Support and Service (cryogenic facility for the processing of natural gas products), and related
equipment and structures, and one communications tower (35 feet in height) in the
A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of
record.
Kim Ogle, Department of Planning Services, presented a brief summary of the proposal
and entered the favorable recommendation of the Planning Commission into the record as
written. He noted the project will be completely fenced after completion, showed images of the
property, and briefly reviewed a schematic of the proposed gas plant.
El Don Carroll, Department of Public Works, provided a brief overview of the transportation
plans and requirements, access, and drainage. Cattle guards will be required at both entrances.
He said they are proposing ten truck trips per day; most of the product will be transported via
pipelines. A grading permit has been submitted, and this is not in a flood zone.

Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions, noting there will be employees on site so they are putting in a septic system.
A Safety Pre-Task Plan Card (SPPC) is being done for the site, and there are no outstanding
issues.
ID Gordon Stevenson, and Daniel Worth, with Sterling Energy, explained the applicant is an
oil and gas midstream company which gathers natural gas from producers in the area, and they
have been in continuous operation in this area since the 1960s. He explained the location of
the low-pressure pipeline, and summarized the plant will bring unprocessed natural gas for
processing/separation; the products are delivered via two pipelines to the Southern Star and
Overland Pipelines.
la Commissioner Kirkmeyer noted she recently visited the pipeline out by Kersey to assess
the concerns of surrounding property owners, and asked about the project's size related to that
one. Mr. Worth stated this facility will be 1/5 that size. He said a lighting plan has been
submitted, but this site will not be manned 24 hours a day, so the lights will not be on at night,
except on a call-out basis. He said the nearest residence is over a mile away.
e No public testimony was offered concerning this matter.
El In response to Chair Rademacher, Mr. Worth said he and the applicant have reviewed,
and agree to abide by, the Conditions of Approval and Development Standards, as amended.
Commissioner Freeman moved to approve the request of Sterling Energy Investments,
LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0018, for
Mineral Resource Development Facilities, Oil and Gas Support and Service (cryogenic facility
for the processing of natural gas products), and related equipment and structures, and one
communications tower (35 feet in height) in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Conway, who noted these facilities are very important to the County to get
product to market and keep trucks off the roads.
e Commissioner Kirkmeyer noted the Board has been very supportive of the oil and gas
industry; however, everyone needs to be sensitive to the situation of the surrounding property
owners, because some of these operations are causing serious problems and if this was in a
residential area she would be requiring a lot more oversight.
The motion carried unanimously. There being no further discussion, the hearing was completed
at 11:10 a.m.
