Subject: Solid Waste Disposal Compliance Assistance Related to the May 1, 2014 and May 18, 2014 Inspections at
12823 CR 24, Ft Lupton, Colorado 80621 (Parcel 130906000019)
Dear Mr. Nelsen,
The Weld County Department of Public Health and Environment(WCPHE) received a complaint that you are disposing of
solid wastes at a property owned by you, located at 12823 CR 24, Ft Lupton, Colorado("the Property"). This letter
provides notice related to information gained during inspections conducted by the WCDPHE on May 1, 2014 and May
18, 2014 at the Property.The purpose of the inspections was to evaluate compliance with the Solid Wastes Disposal
Sites and Facilities Act,Colorado Revised Statutes(CRS)Title 30,Article 20, Part 1 ("the Act"), and the Regulations
Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2, Part 1 ("the Regulations"). According to the Act and the
Regulations, it is unlawful to dispose of solid wastes on your property without a Certificate of Designation issued under
the provisions of the Regulations.
On May 1, 2014, an inspection revealed that solid waste, consisting of concrete,tires,and spray paint cans was present
at the Property. You indicated to WCPHE that this material had been dumped at its location by unknown parties without
your consent. WCPHE discussed with you the requirement for you to remove all solid wastes from the Property in
accordance with the Regulations should you choose not to permit the Property for solid waste disposal in accordance
with the Regulations.
On May 18, 2014, an additional inspection was conducted by WCDPHE following the observation that a large amount of
sludge was present on the Property. You indicated that this material was silt from a pond. As discussed with you,
Section 1 of the Regulations defines environmental media as "earth materials including soil,sand, silt,gravel, rock,
stone, sediment, and other naturally occurring solids." Uncontaminated environmental media is not subject to
regulatory authority. However, it is recommended that an acceptance plan be in place to ensure material being placed
at the Property is uncontaminated. It is recommended that the acceptance plan include visual and odor tests of
incoming soils, a verification plan of source of material, a rejection plan for materials not acceptable for backfill or
containing solid wastes, and documentation showing sources of material.
Copies of inspection photographic logs are attached.Additionally, it is expected that you comply with all applicable
regulations. WCDPHE urges you to consider the benefits of environmental stewardship and implementation of best
management practices,which could include reducing your costs, limiting your exposure to future environmental
liabilities, and improving community relations.
Please be advised,the notifications in this letter do not preclude the WCDPHE and/or the Colorado Department of Public
Health and Environment from initiating appropriate legal action in accordance with the Colorado Revised Statutes or any
applicable regulations.
