The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by
Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments
made during this phase of the Use by Special Review process may not be all inclusive; as other issues may
arise during the remaining application process.
COMMENTS:
CR 49 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant
shall delineate or dedicate an additional 40-foot of right-of-way parallel to the CR 49 right-of-way for full build-
out.
CR 10 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
REQUIREMENTS:
Access:
A vehicle tracking control pad will be maintained through the life of the site to prevent tracking of debris on to
County roadway (gravel base, recycled asphalt or equivalent).
There shall be no net increase in the number of accesses to a public road. The site currently has two
accesses.
Noxious Weeds:
Should noxious weeds exist on the property or become established as a result of the proposed development,
the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of
the Weld County Code.
Traffic Study:
The applicant in the questionnaire is indicating that there will be 3-4 people on site with a forklift, boom lifts,
trailers, 1 semi and service pickup.
Drainage Report:
The historical flow patterns and run-off amounts will be maintained on site.
Grading Permit: If more than one acre is to be disturbed, a Weld County Grading Permit will be required prior
to the start of construction.
Flood Hazard Development Standards:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).

Environmental Health Services has reviewed this proposal for any use permitted as
a Use by Right, an accessory use, or a Use by Special Review in the Commercial or
Industrial Zone Districts, (Storage and Staging of Construction Equipment) in the A
(Agricultural) Zone District.
The application states 3 to 4 people will utilize the site. No employees will be stationed
at the location.
The following section is from Environmental Health Services, Weld County Department
of Public Health & Environment, Septic Policies.
2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Portable toilets and bottled water from a commercial source are allowed
in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.
As indicated above, it is the policy of this Department that portable toilets are allowed
when employees or contractors are on site for less than 2 consecutive hours a day. As
personnel will be on site for a short duration, in accordance with Environmental Health
Services policy the use of portable toilets is allowed.
The dust abatement plan stipulates that the access drive, circulation and parking areas
will be surfaced with recycled concrete. Water obtained from the Town of Hudson will
be utilized for dust control if necessary.
There is a dumpster on site that is serviced by Best Cleaner Disposal. There will be no
maintenance or washing of vehicles or equipment on the site.
We have no objections to the proposal; however, we recommend that the following
requirements be incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The facility shall operate in accordance with the
approved "waste handling plan", at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall operate in accordance with the approved "dust abatement
plan", at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in
the non-specified Zone District as delineated in Section 14-9-30 of the Weld
County Code.
6. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. As employees or contractors
are on site for less than 2 consecutive hours a day portable toilets and bottled

water are acceptable. Records of maintenance and proper disposal for portable
toilets shall be retained on a quarterly basis and available for review by the
Weld County Department of Public Health and Environment. Portable toilets
shall be serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
7. The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

Upon review of my case files and computer, an active Zoning Violation (ZCV13-00161)was noted. This
violation was initiated due to the operation of a commercial business without first completing the necessary
Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate
through the Violation Hearing process. Since this application was submitted prior to an actual court date
being scheduled, NO investigation fee is required.
Due to records release laws,staff no longer tracks complainant information,but please be aware it is staffs
policy to no longer accept staff initiated complaints.
If this application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied, the commercial vehicles, storage and all
operations shall be removed from the property within 60(thirty)days of denial or the violation will proceed in
court accordingly.

Dear Mr. Gathman:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011
memorandums to county planning directors, this office will only perform a cursory review of the referral
information and provide informal comments. The comments do not address the adequacy of the water
supply plan for this project or the ability of the water supply plan to satisfy any County regulations or
requirements. In addition, the comments provided herein cannot be used to guarantee a viable water
supply plan or infrastructure, the issuance of a well permit, or physical availability of water.
The application is for a Site Specific Development Plan and Use by Special Review Permit for
outside storage and staging of construction trucks and equipment. The current water supply for the
property is provided by an existing well, permit no. 256952. Well permit no. 256952 was issued on May
13, 2004 and the use of the ground water from this well is limited for ordinary household purposes inside
two (2) single family dwellings, the watering of not more than four (4) large non-commercial domestic
animals, and the irrigation of not more than 10,000 square feet of home gardens and lawns. The
Applicant indicated that water from the well will not be used for the employees coming to the site. Bottled
water and portable toilets will be provided for employees coming to the site. In addition the Applicant
indicated that any water needed for dust control on the property will be purchased from the Town of
Hudson. This office has no objection to the proposal, provided water from well permit no. 256952 is not
used as a water supply for the proposed storage operation and its employees unless a new permit
allowing for such commercial use is obtained. In addition, as long as the water used for dust control is
obtained from a source legally permitted or decreed for such use, this office has no objection to the
proposal.
