MENT. OF ENGINEERING, for the benefit and on behalf of the Board of
County Commissioners , Weld County, Colorado, hereinafter referred
to as Weld County.

• WHEREAS , Weld County is in need of ) XX material for the
construction of 'county roads , and

WHEREAS , Owner owns certain land on Which there is UNXIX
material suitable for use in construction of county roads.
NOW, THEREFORE, Owner and Weld County agree that Weld

County may use its equipment to remove the WM material from
_Owner ' s land. •
Owner. and Weld County also agree to the following provisions :

10 cents per cubic yard. Weld County will pay 1/2 of permit
cost and reclamation cost to Morgan County . Weld County will
agree to abide by agreement with Morgan County and that agreement '
copy is hereby attached and becomes a part of this agreement .

THIS LEASE is made and entered into by and between HARVEY GREEN of
Snyder, Colorado, hereinafter referred to as "Lessor" and MORf1AN COUNTY,
* COLORADO, hereinafter referred to as "Lessee" and it is agreed as follows:
"A
That verbal arrangement, Lessor has allowed the County to remove sand
a and gravel from the SEh of Section 24, Township 6 North, Range 56 West of the
6th P.M. at the agreed rate of 50 cents per truck load, (approximately 5 yards),
and as the arrangement has been satisfactory and the County at its :rail cx_,=ese
has made or will make a road into the sand and gravel areas and as it is the
desire of the parties to continue this on a year to year basis with this lease to
be effective February 1, 1978, and expiring on February 1, 1979, accordingly:
Lessor agrees:
1. That he has good title and will protect Lessee's right to obtain
sand and gravel during the term of this lease.
2. That he will allow Lessee to make such roads and trails that may
3 be necessary to the gravel area provided the same does not interfere with
Lessor's use of the land.
Lessee agrees:
1. To pay fifty cents ($. 50) per load for all sand and gravel ex—
tracted and to at all times account to the Lessor. Payment shall be made on a
monthly basis or such other basis as may be mutually agreed.
2. They will take care to have all employees and the truck driver:;
close gates and observe following of such roads and trails as may be mutually
acceptable between parties hereto.
3. Not to interfere with agricultural or grazing pursuits of the
Lessor.
4. To cease removal of gravel and sand under this agreement promptly
on February 1, 1979, unless this Lease Agreement is extended between the parties
hereto.
5. Any gravel removed from this pit by other parties will have to
be agreed upon by both parties of the Contract.

19 IT IS FURTHER AGREED and understood between the parties hereto that
the Lessee is using the sand and gravel for roads and other uses common to
Morgan County and that the Lessee has no other right to the sand and gravel
other than as herein stated and shall not commercialize or sell to third per—
