RESOLUTION RE: APPROVE QUIT CLAIM MINERAL DEED AND AUTHORIZE CHAIR TO SIGN - VICTOR HANSON LIVING TRUST - VICTOR HANSON, TRUSTEE, C/O VICKIE GREEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Quit Claim Mineral Deed from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, to the Victor Hanson Living Trust - Victor Hanson, Trustee, c/o Vickie Green, 2318 Sunset Lane, Greeley, Colorado 80634, commencing upon full execution, with further terms and conditions being as stated in said Quit Claim Deed; said property being described as: The SW1/4 of Section 21, Township 7 North, Range 57 West of the 6th P.M., Weld County, Colorado, and WHEREAS, after review, the Board deems it advisable to approve said Quit Claim Mineral Deed, a copy of which is attached hereto and incorporated herein by reference. The attached Letter from attorney Glen Droegemueller addressed to Bruce Barker, contained a Summons, Complaint, and Decree affecting the property described as : The Southwest Quarter(SW1/4) of Section Twenty-one (21)Township Seven (7) North, Range Fifty-seven (57) West of the Sixth Principal Meridian,Weld County, Colorado. The documents reflect that whatever interest Weld County may have had in the property was extinguished by the Court Decree.The Clerk to the Board researched the matter to see that the County had no mineral leases in the property described.They found that there had been a lease in the early 1970's, but that lease was terminated.There were no notes in the file to indicate why that was done. The Trust has been approached to lease oil and gas minerals beneath the property just described;however, prior to any lease being signed,my client has been informed there is a title issue involving Weld County which must be resolved. The relevant title history regarding the real property in question is as follows: On November 6, 1944,a Treasurer's Deed was recorded in Weld County transferring this property to Charles H.or Mary L.Avey. The Treasurer's Deed contained a reservation of all oil,gas and other minerals underneath the real property.I have attached a copy of that Deed for your review. In 1956 Charles H.Avey filed a Quiet Title action in the Weld County District Court to Quiet Title to the property and for a determination of the heirs of Mary Loretta Avey. The Weld County Commissioners and the Treasurer of Weld County were named as Defendants in that action.I have included a copy of the Summons showing service was obtained on the County by the Weld.County Sheriff on July 17, 1956. On September 24, 1956,an Order for Default and Entry of Judgment was signed by Judge Dooley indicating each and every Defendant with the exception of two Defendants had failed to appear within the time permitted for Defendant to Answer and a Default Judgment was Ordered against those Defendants. Weld County did not file an Answer in the matter, and was subject to the Order for Default and Entry of Judgment. On September 24, 1956,Judge Dooley entered a Decree in the Quiet Title action.Paragraph 1 noted that each and every Defendant was properly served,that Weld County and other Defendants were in default and the Default Judgment should be reflected as identified in paragraph 5. The Quiet Title action was an action in rem affecting specific real property; and,the Court has jurisdiction of all the parties as identified in paragraph 6. In paragraph 8 the Judge determined that Charles H.Avey was the owner in fee simple and entitled to possession of the real property involved in the Quiet Title action.Paragraph 8 further stated that Mr.Avey 1035 37th Avenue Court,Greeley,Colorado 80634 Telephone: (970)304-0362 Fax: (970)353-4040 a Page 2 December 2,2013 was entitled to a decree quieting his title thereto and every claim of the defendants,or any them;Was unlawful and without right;and,that no defendant has any right,title.or interest in or to the property which was subject of the.Quiet Title action. Judge Dooley in paragraph III of the Order indicated all defendants had no estate,right,title,claim or interest and that complete fee simple title in and to the above-described property and every part thereof, • • was quieted in and to Charles H.Avey. :I Subsequent to the Quiet Title action,Mr.Avey conveyed ownership of the property to Howard Faber purporting to reserve an undivided'A interest'in all oil,gas and minerals and conveyingahe remaining half to Mr.Faber.Howard Faber then transferred titteto Lorraine Faber with no mineral reservation who in turned transferred title to Victor and Robert Hanson with no mineral reservation.Victor Hanson then obtained the interest of his brother,Robert Hanson,with no mineral reservation after Robert Hanson passed away.Mr.Hanson then transferred property to the Revocable Trust described earlier in this letter. Therefore,it appears that the undivided Y2 interest should have become vested in Victor Hanson's Trust. On behalf of Mr.Hanson,1 am asking the Weld County Commissioners to sign a Quit Claim Deed to the Victor Hanson Living Trust affirming Weld County has no ownership interest to the surface or die minerals of the SW 1/4 of Section 21,Township 7 North,Range 57 West of 6t P.M.in Weld County, Colorado. My review of the Quiet Title action leads me to the conclusion Weld County was named as a Defendant and properly served.For whatever reason,Weld County elected not to file an Answer in that proceeding. Judge Dooley in his Decree noted in paragraph 1 that each Defendant has been properly served:In paragraph 5 of his finding,Judge Dooley indicated,because of the lack of response by Weld County and other:Defendants that a Default Judgment had:been entered against Weld County and other Defendants. • Judge Dooley then quieted title to Mr.Avey with language which suggests that the reservation Which occurred in the 1944 Treasurer Deed to Charles H.or Mary L.Avey was terminated. Had Weld County entered an Appearance in the Quiet Title action,it could have asked the Court to rule that its reservation of oil,gas and other minerals should have been reaffirmed.Because Weld County failed to appear,the District Court had jurisdiction to the quiet title to the surface and minerals to Mr. Avey-which it did.
