HomeMy WebLinkAbout20140859.tiff HEARING CERTIFICATION DOCKET NO. 2014-15 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR13-0058, FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY (PARKING FOR EMPLOYEE VEHICLES AND COMMERCIAL TRUCKS AND A 7,200 SQUARE- FOOT SHOP/OFFICE) IN THE A (AGRICULTURAL) ZONE DISTRICT-JOSE NIETO A public hearing was conducted on March 19, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Diana Aungst Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: ID I hereby certify that pursuant to a notice dated February 14, 2014, and duly published February 19, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Jose Nieto, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0058, for an Oil and Gas Support and Service Facility (parking for employee vehicles and commercial trucks and a 7,200 square-foot shop/office) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. ICJ Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She said the use will be on 3.5 acres in the northwest corner of this 11-acre site, there is also a mobile home on the site, which is not a part of the USR, and the site is screened by USR-1454. Ms. Aungst reviewed surrounding land use; the closest residence is 150 feet south of the property line. Two property owners spoke at the Planning Commission hearing regarding concerns about drainage. The Town of LaSalle indicated it does not wish to annex the site at this time. She showed images of the site and the adjacent area, and said the drainage issues were discussed at length during the Planning Commission hearing and the applicant is currently working with the Department of Public Works to design the water quality feature. Ili Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and requirements; the shared access is off County Road 50. He reviewed traffic counts, and said that estimated site traffic is five (5) tandem trucks and ten (10) belly dumps, with 23 employees picking up trucks and parking their private vehicles,for the day. He addressed CC : Cp C64)'P(Abw) RA)(Ix)tkL[U-) 24 �� 2014-0859 PL1745 HEARING CERTIFICATION -JOSE NIETO (USR13-0058) PAGE 2 drainage concerns (the water table is only 1 foot below ground level), and said his department took into consideration the structures and additional gravel, as well as the concerns of the neighbors, and increased the size of the water quality feature to accommodate increased stormwater runoff. There is an offsite Road Improvements Agreement for the haul route on County Road 50. In response to Chair Rademacher, Tim Tuttle, Department of Public Works, said flow is to the southeast, so the feature will be placed in the low spot in that area. e Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions. She said a septic system will be required for the shop because they have two permanent employees, so they can install a new one or the existing system for the mobile home can be evaluated by an engineer to verify it is adequate for the number of people. There will be portable toilets for the drivers who will not remain onsite, which is addressed in Development Standard #18. The Central Weld County Water District provides water service, a Waste Handling Plan was submitted, the department is asking for a designated truck washing location on the plat, and waste disposal of tires, batteries, etc. still needs to be addressed. e Jessica Garcia, applicant's representative, gave a brief overview of the project. She said the mobile home on the site is not used for the business and confirmed the business has no formal Access Agreement with A and W, although A and W voluntarily widened the road to accommodate both businesses. Mr. Yatabe clarified the access is part of the Recorded Exemption and is, in part, owned by the applicant. Ms. Garcia said she understands there is a `handshake agreement' between the companies. No public testimony was offered concerning this matter. El In response to Chair Rademacher, Ms. Garcia indicated that she and the applicant have no Conditions of Approval and Development Standards they would like amended. She indicated willingness to install a septic system if that is unavoidable. She noted the drivers only come to pick up their vehicles and do not stay on site for more than a few minutes. Chair Rademacher indicated port-a-potties for the drivers on a site with such a high ground water table makes sense, but for the other three employees, the existing septic needs to be evaluated. (Clerk's Note: additional language was provided by Health Department staff following the hearing, which was added to Development Standard#17[subsequently renumbered to become Development Standard#16]to address the use of portable toilets for employees who are on the site less than two hours.) Ms. Aungst noted two conditions of approval address lighting and signage and said Condition of Approval #1.K.5 and #1.K.6 should state "the approved screening plan/approved parking plan - as shown on the plat," which was done by assent of the Board. Ms. Aungst reported the hours of operation for A and W are 24/7 and were not discussed at the Planning Commission hearing; however, following discussion, Development Standard #4 was deleted by assent of the Board. The Board confirmed portable toilets are acceptable for employees on site less than two consecutive hours per day. El In response to Chair Rademacher, Mr. Nieto indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards. 2014-0859 PL1745 HEARING CERTIFICATION -JOSE NIETO (USR13-0058) PAGE 3 e Commissioner Kirkmeyer moved to approve the request of Jose Nieto for a Site Specific Development Plan and Use by Special Review Permit, USR13-0058, for an Oil and Gas Support and Service Facility (parking for employee vehicles and commercial trucks and a 7,200 square-foot shop/office) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously. There being no further discussion, the hearing was completed at 10:58 a.m. This Certification was approved on the 24th day of March, 2014.
