HomeMy WebLinkAbout20142937.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO SEPTEMBER 24, 2014 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, September 24, 2014, at the hour of 9:00 a.m. e ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem - EXCUSED Commissioner Sean P. Conway - EXCUSED Commissioner Mike Freeman Commissioner William F. Garcia Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Susan Brown Controller, Barbara Connolly e MINUTES: Commissioner Garcia moved to approve the minutes of the Board of County Commissioners meeting of September 22, 2014, as printed. Commissioner Freeman seconded the motion, and it carried unanimously. e AMENDMENTS TO AGENDA: There were no amendments to the agenda. la CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda as printed. Commissioner Garcia seconded the motion, and it carried unanimously. la PUBLIC INPUT: No public input was given. • COMMISSIONER COORDINATOR REPORTS: Commissioner Freeman reported that all three Commissioners present attended the Big Ten Conference, a meeting of the ten largest Colorado Counties, and said it was interesting to hear about the different, and similar, issues in other counties. BIDS: la 1) RECONSIDER APPROVAL OF BID #B1400143, (CNG) 1 TON 4X4, CREW CAB - FLAT BED - DUAL WHEELS - DEPARTMENT OF PUBLIC WORKS: Trevor Jiricek, Director of General Services, explained this bid was awarded to AutoNation Ford in Littleton on September 17, 2014; however, AutoNation has since informed the County they cannot honor that price. Staff now recommends the bid be awarded to the second lowest qualifying vendor, Spradley Barr Ford in the amount of $59,760.00. Minutes, September 24, 2014 2014-2937 10/ Page 1 BC0016 0 Commissioner Freeman moved to approve said staff recommendation. The motion was seconded by Commissioner Garcia, and it carried unanimously. NEW BUSINESS: 1) CONSIDER AUTHORIZATION OF AGREEMENT BETWEEN INTERVENTION COMMUNITY CORRECTIONS SERVICES (ICCS) AND THE COLORADO JUDICIAL DEPARTMENT: Doug Erler, Director of the Department of Justice Services, explained that ICCS has an exclusive contract with Weld County. The 19th Judicial Probation Department and the Court seek to enter into a separate Treatment Services Agreement and are asking for the Board's approval of this independent contract due to that limitation. Mr. Erler described the nature of these services. He confirmed these would be all local offenders, and mentioned this was reviewed and approved by Frank Haug, Assistant County Attorney. Commissioner Garcia moved to approve said authorization of agreement. Seconded by Commissioner Freeman, the motion carried unanimously. El 2) CONSIDER APPLICATION FOR TRANSFER OF OWNERSHIP OF A HOTEL AND RESTAURANT LIQUOR LICENSE FROM SMOKEHOUSE ENTERPRISES, LLC, DBA OLE' HICKORY SMOKEHOUSE AND TAVERN, TO RAYHEL ENTERPRISES, LLC, DBA OLE' HICKORY SMOKEHOUSE AND TAVERN, AND AUTHORIZE CHAIR TO SIGN: Bob Choate, Assistant County Attorney, introduced this application resulting from a sale of the business. There were no concerns and he recommended approval. Robert Rayhel and his daughter Cody Rayhel introduced themselves and said they will put more emphasis on the restaurant aspect of the business; Cody reported a misdemeanor in Texas in 2012. Commissioner Freeman moved to approve said application and authorize the Chair to sign. The motion was seconded by Commissioner Garcia, and it carried unanimously. El 3) CONSIDER TEMPORARY CLOSURE OF CR 58 (18TH ST.) BETWEEN FERN AVE. AND CR 47.5, AND CR 47.5 BETWEEN U.S. HWY 34 AND CR 58: Janet Lundquist, Department of Public Works, reviewed these one-year road closures for the Weld County Parkway Project. She noted that, because of harvest, they moved the start date from September 9, 2014 to September 29, 2014. She noted agreements with the landowners have all been worked out for some time; this is a monumental project and will likely take the full year. She confirmed the roads are closed to thru traffic, but no one is denied property access. Commissioner Freeman moved to approve said temporary road closure. The motion, which was seconded by Commissioner Garcia, carried unanimously. le 4) CONSIDER INSTALLATION OF TRAFFIC CONTROL DEVICES ON IDAHO CREEK PWY FROM CR 7.5 TO FORESTER PLACE: Ms. Lundquist said staff received a request from the Idaho Creek Subdivision Homeowner's Association (HOA), for the placement of "No Parking" signs on both sides of the road. They had already installed the signs, but citizens who live along this stretch complained; staff received three letters of opposition and four phone calls, so this has been a controversial issue. In the past, staff has rarely allowed these signs in subdivisions. The HOA said that trailers and motor homes are their major concerns. Chair Rademacher noted this subdivision was not built out to County standards. Commissioner Garcia noted the HOA could take over this road; if they want to regulate them they should maintain them. Ms. Lundquist said this is the main entryway to their area, but home owners do use this for parking, as all of the other houses on this drive. It was confirmed these roads are county maintained and most the residences can only accommodate one vehicle. There was further discussion of parking, and Ms. Lundquist noted that residents stated they paid more for a corner lot to get the additional parking. Commissioner Rademacher said that's the problem with approving additions with exceptions to Code standards. Commissioner Garcia moved to deny said request. The motion, which was seconded by Chair Rademacher, carried unanimously. Minutes, September 24, 2014 2014-2937 Page 2 BC0016 e 5) CONSIDER CONTRACT AMENDMENT #1 FOR 2014 HOT AND WARM MIX ASPHALT / ASPHALT SUPPLY (BID #B1400054) FOR CR 49 FROM CR 18 TO CR 20 AND AUTHORIZE CHAIR TO SIGN - MARTIN MARIETTA MATERIALS: Jay McDonald, Director of the Department of Public Works, stated the department had budgeted and planned to do an overlay last year; however, due the Improvements Agreement with Anadarko they delayed, hoping Anadarko would get to it; they did not, but have offered to haul and lay the asphalt, if the County will purchase it. If not done, the Department will have to send personnel to patch the road during the winter, and that work will later be for nothing. Commissioner Freeman noted that it is unfortunate Anadarko has not yet followed through, and Commissioner Garcia, noted that, regardless, it needs to be made safe for Weld County citizens. Neil Bowers, Department of Public Works, said in the middle of winter it is hard to get materials, and noted there was no time-limit set in Anadarko's Road Improvements Agreement. Elizabeth Relford, Department of Public Works, explained Anadarko is just now starting the construction on their site after a two-year delay, and 2016 is the soonest they will start production. Ms. Relford said the overlay was already planned before Anadarko's agreement, so Public Works felt this was a reasonable compromise because Anadarko has the time and the manpower, and Public Works has a contract for the asphalt supply, and she said the overlay is not wasteful because the repairs are needed now. Commissioner Garcia moved to approve said contract amendment and authorize the Chair to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
