Engineering Development Review has reviewed this proposal. This project falls under the Use by Special
Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments
made during this phase of the Use by Special Review process may not be all-inclusive, as other issues
may arise during the remaining application process.
COMMENTS:
CR 119 is a local paved/gravel road and requires a 60-foot right-of-way at full build out. There is presently
a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in
the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
The County Road 106 and CR 121 Section Line have 60 feet of unmaintained County line right-of-way.
The applicant shall verify the existing right-of-way and the documents creating the right-of-way and this
information shall be noted on the plat. All setbacks shall be measured from the edge of right-of-way. The
applicant shall complete a Nonexclusive License Agreement for the upgrade and maintenance of Weld
County Right-of-Way.
A Traffic Narrative has been submitted dated 8/12/14. The applicant anticipates 150 work vehicles and 1
truck accessing the site during construction. Once operational there will be 15 employees split between
two shifts. Trucks will only be used to transport product if pipelines are non-operational.
An access permit has been approved for the access to the site (AP14-00402).
A Drainage Report has been signed and stamped by a Colorado Registered Professional Engineer. The
Engineer shall complete a Certification of Compliance stating that the final stamped drainage report is in
compliance with the Weld County Code. No formal review will be completed by engineering development
review. This certification can be found at
http://www.co.weld.co.us/departments/planningzoning/engineering.html. WE MAY NEED TO ASK FOR A
REQUEST FOR WAIVING THE 5YR VS. 10 YR RELEASER RATES. MICHELLE TO GET ANSWER
The applicants will be required to maintain historic drainage flows and run-off amounts on the property.
If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the start of
construction.
A Construction Stormwater Permit is required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-
692-3575.
CONDITIONS OF APPROVAL/REQUIREMENTS:
1. Prior to recording the plat:
A. An Improvements Agreement and Road Maintenance Agreement is required for this site.
This includes construction related traffic. Road maintenance including dust control,
damage repair, and triggers for improvements will be included.

B. The applicant shall complete a Nonexclusive License Agreement for the upgrade and
maintenance of Weld County Right-of-Way.
C. An accepted Final Drainage Report stamped and signed by a Professional Engineer
registered in the State of Colorado is required as well as a Certification of Compliance
stating that the final stamped drainage report is in compliance with the Weld County Code.
D. The plat shall be amended to delineate the following:
1. County Road 119 is designated on the Weld County Road Classification Plan as a
gravel local road, which requires 60 feet of right-of-way at full build out. The applicant
shall verify the existing right-of-way and the documents creating the right-of-way and
this information shall be noted on the plat. All setbacks shall be measured from the
edge of future right-of-way. This road is maintained by Weld County.
2. Label the approved County accesses on the plat with access permit number AP14-
00402.

recorded reception number and date.
5. The applicant shall label the approved water quality feature on the plat as "Water

6. The applicant shall indicate specifically on the plat the type of right-of-way/easement
and indicate whether it is dedicated, private, or deeded to provide adequate access
to the parcel.
7. Show and label standard tracking control onto publically maintained roadways on the
map.
8. The applicant shall label the approved water quality feature on the plat as "Water
Quality Feature, No Build/Storage Area", and label the required volume. (Department

2. Prior to Construction:
A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to
the start of construction. In the event that 1 or more acres are disturbed, the applicant shall
obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado
Department of Public Health and Environment.
DEVELOPMENT STANDARDS/NOTES ON THE PLAT
1. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. Weld County is not responsible for the maintenance of onsite drainage related features.
4. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

Environmental Health Services has reviewed this proposal for the Pony Creek Gas Processing
Facility to include oil and gas processing, storage of liquefied natural gas (NGL), condensate
(oil), and produced water.
The applicant has submitted an approved Dust Abatement Plan (attached in the Application). The
Dust Abatement Plan indicates gravel road base will be used on the access road, speeds will be
reduced on the access road, and water trucks will be utilized to control dust. Environmental
Health Services considers this Dust Abatement Plan to be approved.
The applicant has submitted a Waste Handling Plan (attached in the Application). The Waste
Handling Plan provides information about the chemicals being stored onsite and indicates all on-
site generated waste will be disposed of off-site at the landfill.
The applicant is proposing to install a new commercial septic system and a new water well. The
septic system will require engineer design and review. The water well will require a State of
Colorado Department of Water Resources permit. The applicant is proposing to provide bottled
water and portable toilets during construction activities and for truck drivers.
A Spill Prevention Control and Countermeasure plan (SPCC)will be required and the plan shall
be available on site at all times.
Environmental Health has no objections to the proposal; however, we do recommend that the
following conditions be part of any approval:
1. Prior to allowing the plat to be recorded:
A. The applicant shall submit written evidence of a commercial well to the
Department of Planning Services and the Department of Public Health and
Environment.
B. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of
Public Health &Environment. The plan shall include at a minimum, the
following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including the
facility name, address, and phone number).
4) Solids and sediment will accumulate in the storage tanks. The waste handling
plan shall include a detailed plan that describes the method of how those
solids will be removed, including all on-site handling procedures.
5) The waste handling plan shall provide a commitment to notify the Weld
County Department of Public Health and Environment in writing, in the event
the plan is amended. The plan shall be reviewed and approved by the Weld
County Department of Public Health and Environment.
2. Prior to the release of building permits:
A. The applicant shall submit evidence of an Air Pollution Emission Notice(APEN) and
Emissions Permit application from the Air Pollution Control Division, Colorado
Department of Public Health and Environment(CDPHE). Evidence of such shall be
submitted in writing to the Weld County Department of Planning Services. Alternately,
the applicant can provide evidence from the APCD that they are not subject to these
requirements.
2. Within one month of operation:
B. A Colorado Professional Engineer(PE) certified and signed copy of the Spill
Prevention, Control and Countermeasure Plan, prepared in accordance with the
applicable provisions of 40 CFR, Part 112 shall be provided to Weld County Department
of Public Health and Environment.
3. Prior to the issuance of the Certificate of Occupancy:
A. An On-Site Wastewater Treatment system is required for the proposed facility and shall
be installed according to the Weld County On-Site Wastewater Treatment System
(OWTS) Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County OWTS Regulations.
We recommend that the following requirements be incorporated into the permit as development
standards:

1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in
a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The facility shall operate in accordance with the approved "waste
handling plan", at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The
facility shall operate in accordance with the approved "dust abatement plan", at all
times.
5. This facility shall adhere to the maximum permissible noise levels allowed in the non-
specified Zone as delineated in Section 14-9-30 of the Weld County Code.
6. The facility shall be constructed and operated to ensure that contamination of soil and
groundwater does not occur. Any contaminated soils on the facility shall be removed,
treated or disposed of in accordance with all applicable rules and regulations.
7. All potentially hazardous chemicals must be handled in a safe manner in accordance
with product labeling and in a manner that minimizes the release of hazardous air
pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be
stored secure, on an impervious surface, and in accordance with manufacturer's
recommendations.
8. A current Colorado PE certified and signed copy Spill Prevention, Control and
Countermeasure Plan shall be available on site, at all times.
9. Adequate drinking, hand washing and toilet facilities shall be provided for employees
and patrons of the facility, at all times.
10. Portable toilets are acceptable for employees or contractors on site for less than 2
consecutive hours a day. All other sewage disposal for the facility shall be by septic
system. Any septic system located on the property must comply with all provisions of
the Weld County Code, pertaining to OWTSs.
11. The operation shall comply with all applicable rules and regulations of the State and
Federal agencies and the Weld County Code.

This plan describes where tank bottoms/solids will be disposed of but not the method in which they
will be removed or handled onsite. The proposed COA indicates:

After reviewing the application and documents submitted the Building Department has the following
comments:
A building and electrical permit will be required, per Section 29-3-10 of the Weld County Code, for any
new structures ,additions or renovation to any structures. A building permit application must be completed
and two complete sets of engineered plans. MSDS sheets for all materials stored shall be submitted with
building permit applications.
Buildings and structures shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2012 International Building
Code; 2012 International Mechanical Code; 2012 International Plumbing Code:; 2012 International Fuel
Gas Code; 2006 International Energy Code; 2011 National Electrical Code; 2009 ANSI 117.1

Dear Mr. Ogle:
The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011
memorandums to county planning directors, this office will only perform a cursory review of the
referral information and provide comments. The comments will not address the adequacy of the
water supply plan for this property or the ability of the water supply plan to satisfy any County
regulations or requirements.
The applicant is seeking a Site Specific Development Plan and Use by Special Review permit
for mineral resource development facilities, known as the Pony Creek Gas Processing Facility, on 80
acres. The facility will have up to 15 employees working in two shifts (10 daytime employees and 5
nighttime employees). The facility will also be visited by up to 10 offsite employees, delivery truck
drivers, and miscellaneous visitors per day.
Aside from an existing livestock well, late registered under permit no. 279741, there is no
existing water source on the property. A water truck will be utilized as necessary for dust control
purposes. The proposed water supply for drinking and sanitary needs at the site is a new commercial
well. Bottled water, portable toilets, and handwashing facilities will be provided to all employees
until the commercial well is in place, and will continue to be provided in the vicinity of the
condensate truck loading/unloading area for drivers and offsite employees that will not have access
to the permanent facilities in the warehouse and office. It is anticipated that a commercial exempt
well permit could be obtained for the site to be used for drinking and sanitary purposes inside an
individual commercial business, with no irrigation or other outside use allowed. The amount of
water allowed to be withdrawn from this type of well would be limited to one-third of an acre-foot,
or 108,600 gallons, per year.
This office's final determination regarding if a commercial exempt well permit can be issued
for the site will be made at the time a well permit application is submitted to this office. (Please
note that the new well would need to be the only exempt well on a parcel of 35 acres or more,
therefore the land area claimed on the permit application should not include the location of well
permit no. 279741.)
