CHANGE/EXPANSION OF USE OF AN EXISTING WELL Fasting: Northing:
ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from
seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(4)and the decree granted in case no.2011 CW240 Division 1 Water Court. The
operation of this well is subject to the terms and conditions of said decree.
4) Approved for the use of an existing well constructed under well permit no, 287107. Issuance of this permit hereby cancels
permit no. 287107.
5) The use of ground water from this well is limited to commercial, industrial, irrigation and livestock watering.
6) The pumping rate of this well shall not exceed 200 GPM.
7) The average annual amount of ground water to be withdrawn by this well in combination with all other wells withdrawing
water from the Pawnee aquifer pursuant to case no. 2011CW240 shall not exceed 2,268 acre-feet.
8) Production is limited to the Pawnee aquifer.
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case
number(s)as appropriate. The owner shall take necessary means and precautions to preserve these markings.
10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all
diversions must be maintained by the well owner(recorded at least annually)and submitted to the Division Engineer upon
request.
11) This well shall be located at least 600 feet from any existing well, completed in the same aquifer, that is not owned by the
applicant.
12) This well shall be located not more than 200 feet from the location specified on this permit.
13) This well is subject to administration by the Division Engineer in accordance with applicable decrees, statutes, rules,and

Good Morning Theresa,
I am currently working on the well permit application for Select Energy Services and have a question on the proposed
uses. Pursuant to the Supreme Court decision in East Cherry Creek Valley Water and Sanitation District v, Rangeview
Metro District, the State Engineer must limit the uses of a well permit for nontributary water to non speculative
beneficial uses. As currently applied for, the well permit application seek uses of industrial, municipal, irrigation,
commercial and all other beneficial uses. In order to apply for municipal use the Applicant must be a municipal entity or
otherwise show that such use is not speculative. Please justify that municipal use is not speculative or request that the
use be removed from the application. Also, we consider"all beneficial uses" to be speculative. Please list all specific
uses to which the water will be placed in lieu of seeking"all beneficial uses".
