This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all inclusive; as other issues may arise during the remaining application process. COMMENTS: Good Ave. within Aristocrat Ranchettes is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Barley Ave. is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road has been annexed by Fort Lupton and is NOT maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant shall delineate or dedicate an additional 10-foot of right-of-way parallel to Barley Ave. right-of-way for future build-out. REQUIREMENTS: Site Plan: Show Water Quality Capture Volume (WQCV) pond location on the plat. Use standard tracking control for access onto gravel roads such as class 6 road base or recycled base across both lanes at the access point. Access Permit Application Form: Show the approved access on the plat and label it with the approved access permit number (AP#). Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code. Traffic Study: The applicant is indicating in the questionnaire that he and 2 employees will use the site. A half-, three-quarter-, and one-ton pickup will be on site Drainage Report: The applicant submitted a Drainage Narrative from Alles, Taylor & Duke Surveying and Engineering Consulting, dated June 30, 2014. Q\Users\tjuanicorena\AppData\Local\Microsoft\Windows\Temporary Internet Files\Low\Content.lE5\DZ8S39ZD\USR14-0037[1].docx MEMORANDUM LI EL \ TO: Kim Ogle, Planning Services U� pU N T Y � FROM: Lauren Light, Environmental Health 'I SUBJECT: USR14-0037 De Foe DATE: 9/24/2014 Environmental Health Services has reviewed this proposal for a site specific development plan and use by special review permit for uses similar to uses listed in section 23-3-40 as uses by special review as long as the use complies with the general intent of the a (agricultural) zone district (defoe roofing company) and for accessory buildings with gross floor area larger than four percent (4%) of the total lot area per building on lots in an approved or recorded subdivision plat or lots part of a map or plan field prior to adoption of any regulations controlling subdivisions in the A (Agricultural) zone district. The application indicates there will be a maximum of 2 employees. Water is supplied by Aristocrat Ranchettes Water (acct DEF362). Sewer is provided by an existing septic system (G-19870053) which was sized for 4 bedrooms/8 people. Any additional hydraulic load to the existing septic system which exceeds sizing requirements shall require a review by a Colorado registered professional engineer and in the event the system is found to be inadequately sized or constructed, the system shall be brought into compliance with current regulations. A waste handling plan was not submitted however a receipt from Best Cleaner Disposal Inc. for trash removal was included in the application. A waste handling plan is required which shall address items associated with the roofing business. The waste handling plan shall also include whether vehicle or equipment washing or maintenance will take place onsite. The onsite dust abatement plan states that water will be utilized if necessary to control dust. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: 1. Prior to recording the plat: A. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1. A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2. A list of the type and volume of chemicals expected to be stored on site. 3.The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). (Department of Environmental Health) We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Non-specified Zone as delineated in Section 14-9-30 of the Weld County Code. 6. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Onsite Water Treatment Systems. 2 7. In the event the existing septic system is utilized for business use, the septic system shall be reviewed by a Colorado registered professional engineer if the usage surpasses septic permit G-19870053 sizing limitations. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed, the system shall be brought into compliance with current regulations. 8. This violation was initiated due to the operation of a roofing business without first completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual court date being scheduled, NO investigation fee is required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. If this application if approved by the Board of County Commissioners and once a plat is recorded will correct this outstanding violation. If this application is denied, the commercial vehicles, office trailer, storage and all operations shall be removed from the property within 30 (thirty) days of denial or the violation will proceed in court accordingly. SERVICE TEAMWORK,INTEGRITY,QUALITY I ORlrla' 0,' oil ritOri,rnlw MS nucr ' June 24, 2014 Weld County Department of Planning Services 1555 N. 17th Avenue Greeley, Colorado 80631 Dear Planning Review Board, At the request of Mr. Rodney DeFoe, Defoe Roofing located at 15814 Good Avenue Fort Lupton, CO, 80621 I am writing this letter regarding adjoining properties located at 15814 Barley Avenue and 15814 Good Avenue in Aristocrat Acres. On June 24, 2014, I went to the location and met with Mr. DeFoe. He has requested that the Fire District review a request to gate and lock the address on Barley Avenue due to several recent thefts. This request would restrict open access to the location without cutting the chain on the locked gate from Barley Avenue, which is also known as WCR 16. It appears that this access has not been used in some period of time as it is currently chained shut and overgrown. The access to the residence at 15814 Barley Avenue would be accessed through the 15814 Good Avenue driveway. The Fire District does not have any concerns for the access to this location during a fire from the Barley Avenue side as we would cut the chain and open the gate if needed. However, if the address does remain as stated there could be confusion in the case of a medical emergency. It would be the Fire District's recommendation that the 15814 Barley Avenue address be changed to a Good Avenue address if the driveway and vehicle traffic enters from the 15814 Good Avenue driveway. This would hopefully allow crews to easily find the correct location during any type of emergency. If you have any questions, do not hesitate to contact me. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The application is a Site Specific Development Plan and Use by Special Review Permit for a roofing company and accessory buildings in the Agricultural Zone District. The proposed source of water for the commercial business on the property will be through a water tap from the Aristocrat Ranchettes Water Project ("Aristocrat Ranchettes")Account No. DEF362. No information was provided on the specific amount of water that will be required to serve the roofing company. In addition, a letter of commitment from the Aristocrat Ranchettes was not provided with the referral material therefore it is not known if the Aristocrat Ranchettes is willing to supply this facility or has the water available for this facility. Based on the information available in the State Engineer's Office the Aristocrat Ranchettes has three wells, with permit nos. 20551-F, 20552-F and 33736-F that provide water to the central supply system for the Aristocrat Ranchettes Subdivision. These wells were decreed by the Division 1 Water Court in Case No. 93CW139.Well permit nos. 20551-F, 20552-F and 33736-F are limited to a combined annual withdrawal of 114.4 acre-feet per year. The three wells produce water from the Laramie-Fox Hills aquifer.Well permit nos. 20551-F, 20552-F and 33736-F must be used in accordance with the terms and conditions of the well permits and decree.
