RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
USR14-0065, FOR A MINERAL RESOURCE DEVELOPMENT FACILITY, INCLUDING
AN OIL AND GAS SUPPORT AND SERVICE FACILITY (WATER DEPOT) IN THE
A (AGRICULTURAL) ZONE DISTRICT - WAGISTICS, LLC, C/O SELECT ENERGY
SERVICES
A public hearing was conducted on December 24, 2014, at 10:00 a.m., with the following
present:

The following business was transacted:
I hereby certify that pursuant to a notice dated November 14, 2014, and duly published
November 19, 2014, in the Greeley Tribune, a public hearing was conducted to consider the
request of Wagistics, LLC, do Select Energy Services, for a Site Specific Development Plan
and Use by Special Review Permit, USR14-0065, for a Mineral Resource Development Facility,
including an Oil and Gas Support and Service Facility (water depot), in the A (Agricultural) Zone
District. Brad Yatabe, Assistant County Attorney, made this a matter of record and also noted
that Weld County General Services Director, Trevor Jiricek, is present in the audience as a
business interest of the applicant; however, he does not find this to be a conflict of interest.
lE Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal and facility operations. He displayed a vicinity map and reviewed the surrounding land
uses, as well as the noise and lighting standards. Mr. Gathman stated staff received no
correspondence from surrounding property owners and he gave an overview of the referral
agency responses. He indicated the property is located within the three-mile referral area of the
City of Greeley which submitted comments concerning traffic congestion and lack of shoulders
on County Road (CR) 60.5; however, the site is 1.25 miles east of the city boundary and the
road is maintained by Weld County in this location. He further stated the Town of Kersey
offered no concerns. Mr. Gathman said an Improvements Agreement will be required and he
entered the favorable recommendation of the Planning Commission into the record as written.

Mr. Gathman noted, on behalf of Lauren Light, Department of Public Health and
Environment, no issues or concerns and the Resolution contains the typical standards for a
water depot. El He also displayed the site map and photographs of the area, which he
reviewed for the record.
F Jennifer Petrik, Department of Public Works, provided a brief overview of the
transportation plans and requirements, stating CR 60.5 is designated as a collector status
roadway with an average daily traffic count (ADT) of 3,146. She stated the Access Permit has
been approved and the applicant will be installing cattle guards for tracking control. She
reviewed the anticipated amount of truck trips and indicated an Improvements and Road
Maintenance Agreement will be required but no haul route is currently identified. Lastly,
Ms. Petrik stated the applicant has applied for a Grading Permit, and submitted plans for a
Water Quality Feature and a Weed Control Plan.
El Heather Barbare, Department of Public Health and Environment, was present to answer
questions on behalf of Ms. Light. She stated there will be no full-time employees, bottled water
and portable toilets will be allowed, and she described the Dust Abatement and Waste Handling
Plans.
F John Tufte, Lamp Rynearson and Associates, represented the applicant and confirmed
they did provide a disclosure letter concerning Mr. Jiricek's business interest. He stated this
USR will allow a secondary use for trucks heading east, and the existing pond is used for
augmentation. In response to Chair Rademacher, Mr. Tufte confirmed the pond is lined.
IR No public testimony was offered concerning this matter. In response to Chair
Rademacher, Mr. Tufte indicated no concerns with proposed Conditions of Approval or
Development Standards. Responding to Commissioner Kirkmeyer, Mr. Tufte confirmed the
applicant did meet with the neighbors and they did not express concerns regarding landscaping.
Mr. Tufte further stated he and the applicant have reviewed, and agree to abide by, the
Conditions of Approval and Development Standards, as presented.
Commissioner Conway moved to approve the request of Wagistics, LLC, do Select
Energy Services, for a Site Specific Development Plan and Use by Special Review Permit,
USR14-0065, for a Mineral Resource Development Facility, including an Oil and Gas Support
and Service Facility (water depot), in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Kirkmeyer. 1E Commissioner Conway thanked Commissioners Rademacher
and Garcia for all of their years of service, insightful questions, and common sense perspectives
through the years as they conclude the last hearing of their terms of service. There being no
further discussion, the motion carried unanimously and the hearing was completed at
10:20 a.m.
