RE: APPROVE VACATION OF SPECIAL USE PERMIT, SUP-172 - DCP MIDSTREAM, LP
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated October 16, 1972, the Board approved Special Use
Permit, SUP-172, for expansion of an existing cattle feedlot operation for William Koehler on the
following described real estate, to-wit:
E1/2 E1/2 NE1/4 SE1/4 of Section 28, Township 6
North, Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from the current property owner, DCP
Midstream, LP, 3026 4th Avenue, Greeley, Colorado 80631, to vacate said Special Use Permit,
SUP-172, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Special Use Permit, SUP-172, be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 10th day of March, A.D., 2014.

Subject: Request to Vacate SUP-172
Date: February 20, 2014
The Department of Planning Services received as request from DCP Midstream to vacate USR-
172 for a feedlot on lands now encumbered by USR13-0026 for the Lucerne Gas Plant
expansion.
This request was a condition of approval of USR13-0026, under the heading of prior to recording
the plat 1.F that stated: "The applicant shall submit a written request to vacate SUP-172
approved in 1972 for a feedlot located on lands associated with this permit."
The Department of Planning Services requests your support of this request.

RE: DCP Midstream/Vacate SUP-172
DCP Midstream would like to vacate SUP-172 due to the proposed expansion of the
Lucerne Gas Plant referenced under USR13-0026.
The feedlot that SUP-172 authorized, was no longer being used for its intended purpose,
and was dismantled in 2006 by DCP Midstream.
