Expedition is managed by two individuals with collective oil & gas experience of over thirty years, including approximately twenty years of direct experience in the Colorado SWD business. Consequently, Expedition personnel are confident in their ability to safely and efficiently construct and operate SWD facilities in Weld County, Colorado. Jim Goddard is the Co-Founder and Co-President of Expedition. Mr. Goddard has over 20 years of direct experience with SWDs in the DJ Basin of Northern Colorado. Specifically, he served as General Manager and oversaw the development of Conquest Water Services (a predecessor company of High Sierra's SWD business in the region) from one facility to seven facilities. In his capacity as General Manager of Conquest Water Services, Mr. Goddard acquired locations, permitted facilities (including Weld County USR permits and COGCC drilling permits), oversaw drilling and construction, and managed the operations and customer relationships. 2 The SWD Market in Weld County, CO • Horizontal E&P wells require a large amount of water to frac and complete the well, and much of this water comes back to the surface early in the life of the well. The increased use of horizontal well completions has greatly increased the quantity of disposal volumes injected in Weld County's commercial SWD facilities. • Based on publicly available information provided by the Colorado Oil and Gas Conservation Commission, the amount of oilfield wastewater injected into Weld County SWD facilities has increased over 4x since January 2010. • The last commercial disposal facility opened in Weld County was the C8 facility opened by Conquest in August 2011 . The disposal capacity of Weld County's eleven existing commercial disposal facilities doesn't meet current disposal demand. — Results in long wait times at existing facilities — Oilfield trucks waiting in line at disposal facilities spill out onto Weld County roadways — E&P operators are reportedly shutting in producing wells due to the lack of disposal capacity • Further, the existing disposal capacity is woefully inadequate to meet future disposal needs based on drilling plans disclosed by the operators in the region. For example, Noble Energy has disclosed plans to increase drilling from 300 wells in 2013 to over -600 wells per year by 2016. Other large operators have similar drilling plans on the table. During this time, Jim has taken a number of steps to be a good neighbor to the residents of Weld County, particularly those in close proximity to the facilities he has built and operated. • Below are a few examples of policies Expedition will implement at the proposed EWS #2 location in order to be a good neighbor to nearby Weld County residents (Mr. Goddard has previously implemented these policies at prior locations he built and/ or operated). — Use of pipelines to reduce truck traffic - Expedition will seek to construct pipelines to connect nearby oil and gas wells in order to reduce the number of oilfield trucks. As evidence of this, Expedition has decreased its USR request from 130 trucks/ day to 70 trucks/ day. — Morning hours of operation - In response to concerns about school bus pick up in the early morning, Expedition proposes to open the facility for operation at 8:00am, half an hour after the school bus picks up at 7:30am — Nighttime hours of operation - In order to reduce the amount of truck traffic at night, Expedition proposes to shut its gate at 10:00pm, after which time no trucks will be allowed to enter. - Low Lighting - Expedition will use " down-lighting" to reduce light emissions from the facility. - Traffic Flow - Expedition has visited with several stakeholders to understand their concerns regarding traffic flow. • Importantly, Expedition has contacted or attempted to contact every single neighbor within close proximity to the facility in order to address concerns and answer questions about the proposed EWS #2 facility. Specific information on these efforts is available upon request. 9 Weld County Criteria and Request for Approval Weld County Criteria • The proposed EWS #2 facility meets the intent of the Weld County Code — Comprehensive Plan — Zoning — Compatibility • Additionally, Expedition agrees with the Conditions and Development Standards for the proposed EWS #2 facility. I would ask that the following concerns be entered before a decision is made. Ladies/Gentlemen; I appreciate that measures have been taken to cap the traffic and hours of operation of the facility, however I still have reservations that from 8am until 10pm, 7 days per week, 365 days per year there will be 5 trucks per hour, 1 truck every 20 minutes, coming in and going out of the location at County Road 59 and County Road 50. This will most definitely impact noise and traffic. I can only presume there will also be additional ambient noise from the pumping and injection equipment as well. Thus, disturbing what historically has been a quiet"neighborhood". Additionally, with the dangerously blind curve that is just north of the intersection of County Road 50 and County Road 59 I anticipate accidents. This is already a concern, with the paving of County Road 50 I have seen numerous occasions where semi-trucks have failed to stop and barely slow to traffic on County Road 59. I have seen no information regarding the chemical components in the brine water that will be injected into the ground nor the waste that will be discharged from the trucks at the washout. While the brine injections should be far deeper than any well water, these and the surface waste washout emissions are still a point of concern for me, my child and my livestock. Section 2 C states that"Staff has not received letters, telephone calls or electronic mail from adjacent or surrounding property owners". The first I became aware of such a project was by happening upon a notice posted at the Kersey Post Office regarding the hearing on June 18th. If Expedition Water Solutions made any attempt, which I doubt, to contact those of us that will be impacted but their proposal, I can state that I was not. This blatant disregard for their "neighbors" is, I hope, not indicative of future relations. Clearly the negative financial impact due to depreciation of my property value and the certain environmental impact due to increased traffic, noise and disturbance are of great concern to me, however the overall welfare of my child, our home and our lifestyle are paramount in my opposition to this proposal. The narrative does not address the intersection of US 34 with WCR 59. It's impossible to determine if the intersection traffic volume is increasing by more than 20% based upon the information provided. Such an increase would require that a new access permit for US 34/WCR 59 be obtained . But having said that, all of the auxiliary lanes are already constructed. Getting a permit would be just a formality. There is no need for the proposed facility because all of the major oil producers operating in the area already have exclusive delivery contracts at other existing and proposed locations closer to the source, that are currently operated by a highly experienced, well established, and publically-funded company. 2. The proposed location is currently zoned and suitable for rural residential use only, not industrial use. 3. No truck haul routes to and from the proposed facility have been determined and can be changed at any time. 4. School bus and pedestrian safety concerns exist. Even though the Applicant has expressed a willingness to open at 8AM, they do not propose to close at 3 :30PM when kids return home from school. 5 . Serious public road problems: • WCRs 50 and 61 are chip-sealed ( not paved) and cannot support the weight and proposed volume of heavy truck traffic because those roads are already deteriorating, even after less than a year of use. • There are no shoulders on WCRs 50, 59 or 61 and dangerously deep drainage ditches exist on both sides of all three roads. • The onsite truck parking area associated with the proposed facility is inadequate and truck staging on public roads near the entrances of other similar facilities occurs on a regular basis. • The turning radius at the intersections of WCRs 50/59, 50/61, and 61/US 34 is inadequate and unsafe for the proposed size and volume of heavy truck traffic. Turning, acceleration, and deceleration lanes would be necessary at all three intersections, as well as the entrance to the proposed facility, which would require the acquisition of a significant amount of adjacent private property. • Motorist visibility at the intersections of WCRs 50/59 and 50/61 is limited due to hills and offset Section correction line alignments at both locations. 6. The Applicant has suggested that water could be transported to the proposed facility via (a ) pipeline(s) . However, all of the landowners adjacent to the proposed facility are opposed to the application and all major oil producers already have exclusive contracts for wastewater disposal with another firm . 7. Portions of the proposed facility are within FEMA Flood Way, and the proposed surface and groundwater protection and storm water containment and detention plans are woefully inadequate. 8.
