HomeMy WebLinkAbout750433.tiff RESOLUTION WHEREAS, a public hearing was held on April 28, 1975, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Weld County Colorado, a municipal corporation, requesting permission to locate a gravel pit operation on the following described property, to-wit: That part of the West Half (W+) of the Southeast Quarter (SE+) of Section 26, Township 6 North, Range 66 West of the 6th Principal Meridian, Weld County, Colorado, lying South of County Road No. 64 as the same is now situated; and that part of the West Half (W2) of the East Half (EZ) of the Southeast Quarter (SEI) of Section 26, Township 6 North, Range 66 West of the 6th Principal Meridian, Weld County, Colorado, lying South of County Road No. 64 as the same is now situated, and being more particularly described as follows: Beginning at the Southeast Corner (SE Cor) of said Section 26 and considering the South line of the Southeast Quarter (SE3) of said Section 26 as bearing North 89°23'50" West, with all other bearings contained herein being relative thereto; Thence North 89°23'50" West along said South line, 671. 66 feet to the True Point of Beginning; Thence continuing North 89°23'50" West along said South line, 2014. 98 feet; Thence North 00°04'09" East, 1232, 01 feet to the Southerly right-of-way line of said County Road 64; Thence along the Southerly right-of-way line of said County Road 64 by the following four (4) courses and distances: South 87°26'33" East 1316. 18 feet; South 81°08'12" East 203. 57 feet; South 75°39'38" East 351. 80 feet; South 71°11 '57" East 114. 05 feet; Thence South 00°04'31" West 1037. 00 feet to the True Point of Beginning. Said described parcel of ground contains 54. 617 acres, more or less, and WHEREAS, the petitioner was present, being represented by its three members of the Board of County Commissioners of Weld County, Colorado, namely Glenn K. Billings, Chairman; Roy Moser and Victor Jacobucci, and also represented by County Attorney, Samuel S. Telep, and WHEREAS, there was no opposition to the request of petitioner for the location of said gravel pit operation, and WHEREAS, the said requested gravel pit operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(8) and Section 6. 1(3) of the Zoning Resolution of Weld County, said gravelpit operation may be authorized upon the approval of the Weld County Planning Commission and the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission and having been fully informed; pi_ 115O I5O 750433 NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Weld County Colorado, a municipal corporation, to locate a gravel pit operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That the owner, contractor, or operator, prior to opening any pit, shall submit location of pit, owner's name, and description of pit oper- ation to the Weld County Engineer, and shall submit complete unit develop- ment plans for each gravel pit approval by the Weld County Planning Commission and such unit development plan shall be filed in the office of the Weld County Clerk and Recorder. 3. That petitioner shall proceed with due diligence to effect con- struction of said gravel pit operation and that he shall have up to one year from date hereof to begin the construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 4. That the operation and development of each gravel pit excavation and rehabilitation shall be in accordance with the rules and regulations for the operation of gravel pits as adopted by Weld County, Colorado. 5. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. SUBJECT: Home Rule Meeting DISCUSSION: Mr. Weigand announced there would be a meeting tonight at 7:30 P.M. in front of the Home Rule Committee studying the functions and structure of the Planning Commission, Board of Adjustment and zoning. SUBJECT: East of Eaton Area DISCUSSION: It was brought to the Board ' s attention that there is an area just east of Eaton that could use some rehabilitation. Trying to get water and sewer to them now. Considering a self-help program to get the housing upgraded. SUBJECT: Mobile Home Regulations DISCUSSION: Mr. Juntunen stated that the mobile home regulations were presently undergoing changes. He suggested that in the A-I and A-D zoning districts the words "mobile home" be changed to "movable housing" . Should change "may review and renew annually" to "must. . . " . Also, could add a mobile home to be allowed for parent(s) or family for medical (health) reasons. VOTING MEMBERSHIP: Will be, Nix, Heitman , Yost, Weigand and Elliott APPLICANT: Weld County CASE NUMBER: SUP #272 Tape 563 & 564 SUBJECT: Gravel Extraction Site LOCATION: Pt W'z SE'a Sec 26 T6 R66 APPEARANCE: Richard Straub, County Engineer DISCUSSION: Located just south of Highway 64 about one mile northwest of Greeley. It is their intention to go in and mine the gravel over a ten year period. Will be ending up with three ponds of approximately 27 acres. They will be used by owner for basic recreational fishing and maybe some protective wildlife resting areas. Intend to have a crusher set up in the middle of the total 57 acre site. First phase of operation will be ten acres in the northeast part of the site; then move south and then west. Depth of excavation to be about 30' . Will be excavating in the low flood plain areas . Will be putting in a temporary ford across the river which would wash out in any high water; would not be causing any backing up or damming of the river. Will leave a greenbelt around the entire site. Maximum slopes are proposed four to one side slopes. Will have roads between phase one and two. Planning staff recommends approval for the following reasons: (1 ) Complies with Weld County Comprehensive Plan for mineral extraction and rehabilitation; (2) Complies with H.B. 1529 for extraction of mineral resources; (3) Complies with Weld County Zoning Resolution for extraction and reclamation of mineral resources. SUBJECT TO: (1 ) Extraction limited to plans submitted; (2) State Engineer comments on augmentation. At present, State Engineer recommends denial until an augmentation plan is submitted to them. Mr. Straub felt that the evaporative loss from these small ponds will be very minimal and will not cause any change in the current river flow. Weld County, as such, has no ownership of any water they could use for augmentation plans . There will be approximately 100 acre feet of evaporation. At present, there is no State Law re- quiring water augmentation . Mr. Juntunen stated that at this time, there are some illegal splits of parcels out in this area and aren ' t sure if this parcel itself was in- volved. Also, some question regarding roads . Mr. Honn suggested they could table this until clarification is reached on the two items in question; or approve it subject to these two items being cleared up prior to being put on the County Commissioners agenda. 1110 MOTION: By Mr. Weigand, • MTo table until these two item are cleared up. \) Seconded by Mr. Elliott. No comments from audience. s APPLICANT: Knaus Subdivision DISCUSSION: Withdrawn at this time, Utility Board needs some questions answered. SUBJECT: Martin Brothers Subdivision Tape 564 DISCUSSION: Mr. Honn presented the sketch plan given to him by Martin Brothers on land contiguous to present subdivision. Would like to get the Boards feeling on this before they proceed. Legal description is SEa Sec 12 Tl R66. On County Road 37 approximately two and a half miles south of Hwy 52, about half way between Hudson and Ft. Lupton. Didn' t think there was any drainage problem. Talking about 40 acres divided into one acre lots. Essentially dry land, "A" zoning. Class IV to VI soils. Mr. Honn read portions of the comprehensive plan that apply to this parcel . Chapter 3 dealing with. "RESOURCE MANAGEMENT POLICIES", page 48 paragraph 1 reads , "Agriculture is considered a valuable resource in Weld County which must be protected from adverse impacts resulting from uncontrolled and undirected business, industrial and residential growth. In order to maintain and promote this im- portant segment of the County ' s economy, the cultural and human value associated with farm life and overall benefits of an agricultural en- vironment in the uses of prime irrigated farm land for uses other than agricultural will be critically reviewed to insure the proposed develop- ment will not adversely impact the agricultural interests of the County and that development will positively contribute to the overall economy, environment and tax base of the County" Also, from the same Section, page 48 paragraph 3 - "In order to minimize conflicting land uses and minimize the cost of new facilities and services to the taxpayers, industrial , commercial , business and residential develop- ment will be encouraged to locate adjacent to the existing 27 incorporated towns and in accordance with comprehensive plans and stated wishes of each community. Where new developments desire to locate in the rural areas, away from the existing municipalities, they will be required to justify their development with a detailed plan. . . .accompanied by an economic impact statement and environemntal impact statement prepared by recognized experts, showing all details of how the proposed develop- mnet will affect the local and county' s economic base, the tax revenue and cost of public services such as food , utilities, roads and health services; and the immediata and long term impact on the existing en- vironment. . . ". Same Section, page 49 paragraph 4 - regarding water availability. Same Section, page 50 paragraph 6 - encouraging use of non-productive rural land and water surpluses. Sunny side (or Sunny Acres) is contiguous to the South. The existing subdivision has only two lots with lawns. The rest is mainly sand. Water seems to be lacking. Do have covenants on existing subdivision. Read again parts pertaining to residential growth, page 59 paragraphs 1 and 2. Next Section, "WATER & OTHER NATURAL RESOURCES" , page 70 paragraphs 2 and 4. "ENVIRONMENTAL PROTECTION" , pages 72 and 73 paragraphs 1 , 2 , 3, 4 and 5. 1111 • lip• Mr. Stewart , Boll of Adjustment member stated thought the soils are basically sandy loam. Are building new homes in this subdivision. Could maybe consider a central water system. Located in Ft. Lupton ' s Fire District. Most of the lots are sold. There are about five sub- divisions in this area. It was felt a field trip would be in order. Mr. Juntunen inquired about adequacy of school facilities. Some discussion regarding roads. Have they been accepted by the County; Is there a market for more lots in this area? Mr. Paul stated the water tests of wells in this area proved bacteria safe. Question arose as to whether or not Martin ' s were aware of all the new regulations. Mr. Honn stated he had gone over the rules with them. Mr. Straub did object to the ten lot accesses onto a proposed high speed highway. Wells are about 75 to 100 feet deep. Need to get some input from Ft. Lupton and some of the other towns. Field trip set for February 4, 1975 to leave at 8:45 A.M. and visit the south end of the County. Have the developers present to discuss the application. Will also look at McErven property. SUBJECT: Parkland Estates Tape 564 CASE NUMBER: S-112 DISCUSSION: Mr. Honn stated that a gentleman from the ditch company had been in the office regarding the ditch running through the proposed subdi - vision. (Erie Coal Creek Ditch) Stated they had not been notified of any hearings. Approved by County Commissioners (Zone Change) subject to water and sewer agreements with the Town of Erie. The ditch runs through the center of a couple of lots . Would like to see the ditch tiled through the subdivision (this was the ditch representative' s sug- gestion) . Property owners are not notified until Commissioners hearing . Legal Counsel stated that if the ditch problem had not come out at the time of preliminary platting, it would be something that the ditch company would have to work out with the developer. If it did come up during preliminary platting , it can he brought up again at final platting. SUBJECT: Northwest Acres CASE NUMBER: S-91 Tape 564 DISCUSSION: Located four miles north and one mile west of Windsor. Desiring to file platting south of Northwest Estates . Contiguous across the County Road on approximately 35 acres of ground. The area Mr. Foster has now is essentially a certain economic level of homes. Has had re- quests for a lower economic value of home (around $35,000) . There will be about 25 to 30 lots about one acre each. Will turn the water on another part of ground , so will not actually lose any of the agricultural productivity. Class II soils. Thought present subdivision was about 35% developed currently. Would like to field trip this too. Meeting adjourned. Also submitted to Adams County and the Regional Council of Governement. Discussion followed regarding use of land between Ft. Lupton and Brighton. Land should be held basically for light industrial uses. Mr. Howard Leeper has been in to the office discussing a parcel of ground in that area for industrial type uses . Concern was expressed regarding possible annexation of parts of Weld County along the railroad right-of-way and highway into Adams County/Brighton. Brighton felt if they were going to be providing the services (water and sewer) , then they should get some benefit from it. Discussion regarding economics involved in future growth in this area . Les Fraley, from the C ;t; of Brighton, gave a brief presentation of the plan. 'T R4C (t Han done as a result of a study done and presented to the Counci n ..;mil or May of 1974. Part of their recommendation to the State Highway Department is that State Highway No. 7 be moved over to the County Line Road. Their immediate concern into Weld County would be the light industrial . Would have an agricultural greenbelt around this area. Have three types of industrial zoning proposed (I-1 , I-2 and General Commercial ) with performance standards set for each type. General feeling of commission members was that this would not be detrimental for Weld County. Mr. Straub stated that they had met with the owner of the property, and he (owner) would be happy to donate all his runoff from his farm to the Poudre ) River to supplement any evaporation loss caused by any future ponds. However, reluctant to donate 67 acre feet into the River to account for evaporation loss. In connection with this project, they will be / straightening the River on this piece of ground which will shorten the River 500 to 700 feet, thereby reducing evaporative loss by that much. Discussion followed regarding augmentation. Tom read comments from P ,^ : "r gain and also the letter from the State. APPLICANT: Dave Knaus CASE NUMBER: S-40 Tape 569 SUBJECT: Knaus Subdivision , Third Filing LOCATION: N NE1 Sec 8 T5 R66 APPEARANCE: Dave Knaus; Jay Freese, Engineer; Greg Parish, Attorney 1125 DISCUSSION: Mr. Freese presented plat and some background on Knaus Subdi- vision. Lot 7, Block 1 will be deleted as there was a problem of obtaining extra right-of-way from owner. Originally platted in 1964. In 1970, attempted to file second filing. Never recorded. In 1974, second filing was presented; however, it was held up pending filing of third filing. City of Greeley, at the time, approved water and fire and signed same on the plat. Planning staff recommends this request be tabled for following reasons: (1 ) City of Greeley states there is inadequate pressure in the lines for fire protection; (2) City of Greeley Water Engineer seeks to minimize the number of users served by direct taps onto transmission lines; (3) City of Greeley feels the water lines from 20th Street north to the subdivision (approximately 3/4 of a mile) would solve the problem. THE SUBDIVISION PLAT AND APPLICATION AT THIS TIME: (1 ) Meets requirements for final platting; (2) Would complete (with 1st and 2nd filings) the Estate zoning available; (3) Has been approved by the Utility Board; and (4) Would require Subdivision Im- provements Agreement and bond amount to be established by the County Engineer, prior to approval by the Board of County Commissioners . Bill Neal from the City of Greeley Planning Office was present and made the following comments: This has come before their Planning Commission as it is within their Comprehensive Plan area. It is not that this land is not worth subdividing; there are no problems at all with the plat. It is just that they are concerned with the inadequate pressure for fire protection. If it was in the City, they would not approve it until proper lines were installed to get the water pressure up. Feel the problem can be solved before it becomes a problem to future property owners. Mr. Freese raised the question of equitability. There was no doubt that the extension of the line would solve the pressure problem. How- ever, the problem that has been created is not totally of Mr. Knaus' making. City of Greeley originally allowed Mr. Knaus to tap onto the transmission line and approved, in essence, the virtually same overall subdivision presented today. The only real difference is a decrease in the number of units. The City of Greeley has allowed a number of other taps out in this area which also don' t have adequate pressure. Problem then becomes one of economics for Mr. Knaus to build this water line. Presently in Milliken Fire Protection District. Hope to get into the Western Hills Fire District in a couple of years . Conversations with the Fire Chief out there indicate that water pressures are not adequate, but it turns out , three of the five fire hydrants do meet the 20 pounds pressure : .. ii : d by County regulations . Pressure was felt to hold up for a considerable length of time, except maybe in the winter time. Thought maybe a fair share from each lot to pay for the line from 20th Street could be assessed. Mr. Knaus stated he was not aware of putting in a $40,000 line when he signed his water over to the City of Greeley. His understanding was it would be for the development of the land. Mr. Freese wanted to know if this was the only problem, that of meeting the requirements for water except pressure for adequate fire protection. Not sure regulations specify any certain length of time for pressure being maintained. Discussed this with Mr. Shaffer (City of Greeley Water Department ) , and he said that he thought they had in their transmission line, certain pressure or certain head at the crest of the hill , elevation 4350 feet. 1125 Took locations of each of the fire hydrants, substracted their ele- vations and came up with head difference and converted this to psi . One fire hydrant at 75th Avenue and 11th Street got 11 psi ; one at 74th Avenue and 12 Street got 20.8 or 21 psi ; one at 73rd Avenue and 11 Street got 15.6 psi ; and other two in second filing got 20.2 psi and 29.7 psi . You will have some reduction in pressure after this is developed. MOTION: By Mr. Elliott, To approve this subject to working out something with the City of Greeley regarding water. COMMENT: County Engineer stated that there are some detailed plans that will have to be worked out prior to final submittal before the County Commissioners. Motion died for lack of second. RESOLUTION: Be it therefore resolved to recommend approval to the Board of County Commissioners of Knaus Subdivision, Third Filing as presented. Motion by Mr. Ashley, seconded by Mrs. Yost. A vote of "Aye" by Heitman, Yost and Ashley. A vote of "No" by Nix and Elliott. Vote 2 to 3. Motion carried. COMMENTS: Mr. Elliott questioned who was going to suffer when the 30 some lots were developed and there was little pressure. Might be able to put a booster pump on the line. Have some responsibility to future owners. Felt City should share part of the blame as they signed the water contracts. Mr. Neal stated he was not sure what had been done 10 years ago, but now, they provide three domestic taps in exchange for raw water. Irregardless, there will be a problem. City Engineer willing to extend their lines (paid for by Mr. Knaus) . City of Greeley does recognize the contract, but not sure exactly what their obligations are. Will check it further. SUBJECT: Northwest Estates FILE NUMBER: S-90 Tape 570 APPEARANCE: Mr. Foster DISCUSSION: This parcel (under discussion today) is immediately south of existing Northwest Estaces. Rotn Subdivision located in close proximity. Original preliminary done in June 1971 . Proposed 22 building sites. The water and land is served by another lake, therefore, would not be taking the water out of agriculture uses. Have had several requests for a lower cost of home, but still good quality. All houses built here must meet certain standards set up by the Foster-Shott Enterprises. This de- velopment could help switch water to another parcel of ground for farming purposes. Have contract for domestic water with North Weld Water. Have original Health DeparLcrct approval on perc tests. A 2" tap furnished to every lot ffl- 4-ligation. Have quite a few homesites undeveloped mainly because of - _,.e _conomy situation. Mr. Honn gave brief rundown of Planning Commission action back in 1971 . It appears to have been tabled first and eventually recommended for denial . Legal counsel advises that this would be a new application now, as there has been no activity for a year on this application. It would have to come through as a PUD. Discussion regarding provision for schools , police protection, fire protection, etc. , also the city of Windsor' s reaction. SUBJECT: Kelim Rezoning DISCUSSION: Mr. Juntunen presented a request from Lorimer County Planning Commission for Weld County' s comments regarding a rezone request for a truck terminal located at Kelim, Colorado. It' s just south of Hwy 34 and about 2 or 3 miles west of Highway 25, in Larimer County. Discussion regarding access on Hwy 34, traffic count, traffic hazards, etc. It is presently zoned "B" . Felt they needed more information furnished before 1127 a decision couldbe made. Would like to express to Larimer County appreciation for asking for our input. SUBJECT: State Trails Tape 570 DISCUSSION: Roy Jost, Planner for Weld County, wanted some input from the Board members regarding State Trails (recreational trails) . "These are trails which interconnect parks and recreation areas with residential communities along routes of scenic, natural historic geologic or water oriented interest. A recreational trail is not a route designed for expeditious commuting to and from shopping centers, places of employment and residential areas. Nor is it a non-motorized trail immediately adjacent to a state or interstate highway , such trails detour around highways. " This is the State' s definition of a recreational trail . Mr. Jost stated that he had been contacted this morning regarding Weld County' s participation. State of Colorado adopted the 1971 Trails Act. The problem now is that Greeley wants to participate and apply for funds, but since Weld County has not done anything along this line, they have no State trails to connect into. State system basically follows natural river systems. In Weld County, it would be along the South Platte from Denver; and along the Poudre up to Ft. Collins; Big Thompson up through the Loveland area. Not sure how the funding works. Right of way has to be acquired along the river for these trails; this would be part of the funding program. There is a proposed trail now from Island Grove Park, but if the County does not get involved, the City can only develop the trail within the city limits. Greeley could develop to their boundaries, the rest would be done in stages. Meeting adjourned. Juntunen Planning Director Weld County Planning Commission 1516 Hospital Road Greeley, Colorado 80631 Re: Special Use Permit 272-74-35 Dear Mr. Juntunen: This is to acknowledge receipt of material pertaining to the special use permit for a gravel mining operation along the Cache La Poudre River. The material submitted does not include a water resource investigation for the proposed Special Use . The gravel mining, if permitted, will result in the construction of three ponds with a surface area of 27 acres . These newly exposed water surfaces will evaporate in excess of 63 acre feet of water per year. This permanent loss of water from the stream system which is highly over-appropriated would materially affect other vested water rights . The possibility of injury to surrounding wells and irrigation ditches has not been considered. In that no remedy is provided to injured water rights , I do not recommend approval of the Special Use Permit.
