Attached you will find the chronological documentation of our efforts to come to resolution with
Anadarko Petroleum Corporation on surface use along with a map of a tentatively agreed upon
alternate drilling location. The process has been somewhat disappointing. Anadarko has been
slow to respond and unreliable in what they have shared with us.
We initiated discussions with Anadarko regarding the North Country PUD back on 1/30/2014,
prior to submitting our Change of Zone application, with the hope we could resolve issues ahead
of time. We eventually met with Anadarko's representative, Mr. Jamie McIlvain,at our home on
3/31/2014. Mr. McIlvain shared that Anadarko did not have any plans for this area for at least
the next five years and our PUD plans would likely not interfere with Anadarko's future
activities. Therefore he would prepare and submit a retraction letter to Weld County Planning
Department.
Unfortunately a month later, on 4/29/2014 we were notified that Anadarko had changed its mind
and would not be filing the retraction letter for the North Country PUD. They now wanted us to
sign a contract stating that we would waive all current COGCC setback requirements related to
property lines, well locations and tank battery locations. This was unacceptable to us; therefore,
on 5/8/2014 we replied with a drawing(see attached) and letter depicting a proposed alternate
drilling window location that would minimize the impact to the property and protect and
preserve future opportunity for Anadarko to access their mineral rights.
In Weld County Planning Commission Meeting Minutes from the Planning Commission hearing
on 5/6/2014, it is stated that we are required to either "submit a copy of an agreement with the
property's mineral owner/operators stipulating that the oil and gas activities have been
adequately incorporated into the design of the site" OR "show evidence that adequate attempt has
been made to mitigate the concerns of the mineral owner/operators." We feel we have made our
best effort to meet these requirements by outlining our discussion efforts and continuing to work
with Anadarko. Responses from Anadarko are continually slow and have only come after we
have asked for updates or have reminded them that deadlines are approaching quickly.
While we hope to reach resolution with Anadarko, we do not anticipate this happening by the
Board of County Commissioner Hearing on 5/21/2014. We would ask that our PUD request be
allowed to continue through the process as we continue to try to work with Anadarko.

Frits - Anadarko Surface Discussion Timeline Summary
1/30/2014—Applicant sent a letter to Ms. Bobbi DeRose with Anadarko Petroleum Corporation
notifying Anadarko of the applicants intent to proceed with the North Country PUD on the
property and the need to make Anadarko aware due to its mineral position for the property.
Applicant made good faith effort to notify mineral holder in advance of the Change of Zone
process to provide ample time to discuss and negotiate a solution.
2/12/2014—Ms. DeRose responded saying the company would have landman Mr. Jamie
McIlvain review the PUD proposal and get back to applicant quickly in an effort to avoid future
delay of the PUD process. No further correspondence or dialog occurred for the following
month.
3/21/2014—Ms. DeRose provided objection notice letters to the Weld County Planning
Department in relation to the North Country PUD on the final day of the Change of Zone
Referral Comment Period .
3/25/2014—Mr. McIlvain emailed applicant an aerial image of the PUD quarter section with
drilling windows for 3N68W overlaid for discussion purposes.
3/31/2014—Mr. McIlvain met with applicant at applicant's residence to discuss proposed
development activity and potential conflicts with future exploration activity. Mr. McIlvain
indicated at that time that the proposed new lot with single new house and shed would likely not
interfere with future activities;therefore he would prepare and submit a retraction letter to Weld
County Planning Department.
4/10/2014—Mr. McIlvain followed up with an email to applicant regarding the onsite meeting
and provided confirmation that Anadarko would be submitting a retraction letter, in reference to
their previous objection letter submitted to the County, stating that both parties had met as well
as outlining the items discussed at the meeting.
4/29/2014—Mr. McIlvain contacted applicant with notification that Anadarko had changed its
mind and would not be filing the retraction letter for the North Country PUD. Mr. McIlvain
forwarded an additional site map and a link to relevant COGCC setback requirements in
preparation for a new discussion related to protecting the site drilling windows.
5/1/2014—Mr. McIlvain forwarded to applicant an Anadarko Easement and Surface Use
Agreement requesting that applicant agree to a waiver of all current COGCC setback
requirements related to property lines, well locations and tank battery locations for North
Country PUD. The Easement and Surface Use Agreement contained no information related to
any potential location of wells or above ground or underground support infrastructure and
appurtenances and no timeline for such activities.
5/6/2014—Mr. McIlvain notified the Weld County Planning Department via email, on the date
of the Weld County Planning Commission Hearing,that Anadarko had met with applicant and
had begun working on a Surface Use Agreement. He noted that Anadarko (KMG) would submit
a retraction letter regarding the PUD once an agreement is reached.
5/8/2014 — Applicant responded to Mr. McIlvain with an exhibit depicting a proposed alternate
drilling window location that would minimize impact to the property and protect and preserve
future opportunity for Anadarko to access their mineral rights. Applicant is prepared to modify
the Easement and Surface Use Agreement to specify the preserved future drilling window and
facilities activity subject to agreement with Anadarko.
5/13/2014 - Applicant spoke with Mr. McIlvain regarding relocating the small drilling window to
the east property line and centered on the property line between the two lots. This would require
a property setback waiver for the property line between the two lots.
5/14/2014 - Applicant sent Mr. McIlvain a map depicting the proposed relocated drilling window
to further negotiations in an effort to complete something before the BOCC meeting. Mr.
McIlvain agreed to moving the drilling window to the new location.
5/15/2014 - Mr. Mcllvain sent an updated contract showing the new agreed upon drilling
window to applicant. Contract still request that
1 . Applicant remove Anadarko from any future liability
2. Applicant waive our right to object to the location of any of KMG's facilities on the basis
of setback requirements in the rules and regulations of the COGCC
5/16/2014 — Applicant notified Mr. Mcllvain of our concern with the above two contract
requirements.
