This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: County Road 4 is a paved road and is owned and maintained by the City of Brighton. CR 4 is designated on the Weld County Road Classification Plan as a collector roadway, which requires additional right-of- way at full build out. The applicant must delineate on the plat the future right of way as required by the City of Brighton. Contact the City of Brighton for access turning radius requirements. Weld County recommends 45ft turning radius at the access to accommodate commercial vehicles. The gate must be set back 75 feet from future right-of-way to allow a truck or RV and trailer to pull completely off of the roadway and open the gate after the future road widening. Tracking control is required to keep mud and debris from tracking onto public roadways. At a minimum, a well maintained all weather surface such as recycled AC, recycled concrete, or gravel are required. Contact the City of Brighton for any requirements they may have that may be above the Weld County minimum. The traffic narrative indicatedl0-15 vehicles per day are anticipated upon full lease-up of this site. A Weld County Grading Permit will be required if disturbing more than 1 acre by the planning department. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303- 692-3575. CONDITIONS OF APPROVAL/REQUIREMENTS: 1. Prior to recording the plat: A. County Road 4 has been annexed by the Town/City of Brighton. Access and right-of-way requirements will be determined by the Town/City. B. An accepted Final Drainage Report stamped and signed by a Professional Engineer registered in the State of Colorado is required. C. The plat shall be amended to delineate the following: 1. County Road 4 is owned and maintained by the City of Brighton. All setbacks shall be measured from the edge of future right-of-way. If the existing right-of-way cannot be verified, it shall be dedicated. 2. Label the approved City of Brighton accesses on the plat with access permit number if applicable. 3. The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is dedicated, private, or deeded. 5. Prior to Construction: A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the start of construction. DEVELOPMENT STANDARDS/NOTES ON THE PLAT 1. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2. The historical flow patterns and runoff amounts will be maintained on the site. 3. Weld County is not responsible for the maintenance of onsite drainage related features. DATE: June 5, 2014 Environmental Health Services has reviewed this proposal for a Use permitted as a Use By Right, an Accessory Use, or a Use By Special Review in the Commercial or Industrial Zone Districts (an office building, a dump station, seven buildings for mini- storage as well as indoor RV and boat storage, approximately 42 covered & 404 outdoor spaces for the storage of RVs, boats with and without trailers, ATVs, vans, stand-alone campers, motor homes, 5th-wheel trailers, small-, medium-, and large-pick-up trucks with or without attached campers, and other similar items including industrial and/or commercial vehicles, heavy equipment, and & materials) provided that the property is not a lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. The application indicates one part time employee will be located on site when phase 2 is initiated and the maximum number of people on site would be 5 to 10. Water will be provided by an individual commercial well (permit 77880) and an individual sewage disposal system will be utilized for the office when phase 2 is started. As this is a full time business, permanent drinking water and sewage disposal facilities are required if the number of customers exceeds 10 per day as indicated in revised Policy 2.2.K. "Policy 2.2.K Use of portable toilets and bottled water (revised 5/8/12) Purpose: To define when portable toilets and commercially bottled water are allowed. Policy: Bottled water from a commercial source is allowed in the following circumstances: 1. Temporary or seasonal uses that are utilized 6 months or less per year (for example recreational facilities, firework stands, farmers markets ) 2. Gravel mines 3. 10 or less customers or visitors per day and/or one of the following: 4. 2 or less full time (40 hour week) employees located on site 5. 4 or less part time (20 hour week) employees located on site 6. employees or contractors that are on site for less than 2 consecutive hours a day Note: Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers." The dust abatement plan indicates access roads and drives will be covered with recycled asphalt, speed limits will be posted and native vegetation will be used for stabilization. A water truck will be utilized if necessary. The waste handling plan indicates there will be a dumpster provided which will be serviced by a local disposal company. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirement be incorporated into the permit as a condition that must be met prior to issuance of a certificate of occupancy for the office: 1. An individual sewage disposal system is required for the office and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls 2 fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 6. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. Portable toilets and bottled water are acceptable for 10 or less customers or visitors per day and/or 2 or less full time (40 hour week) employees on site. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 7. A permanent, adequate water supply shall be provided for drinking and sanitary purposes when the number of customers or visitors per day exceeds 10 and/or there are 3 or more full time (40 hour week) employees on site. 8. Sewage disposal for the facility shall be by septic system when the number of customers or visitors per day exceeds 10 and/or there are 3 or more full time (40 hour week) employees on site. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. RV storage facilities are generally an attractive target for thieves. One break- in event to a facility can involve many vehicles being entered and items stolen. Because each vehicle is considered its own crime scene, and each owner a separate victim, a single incident often ties up a deputy for the majority of his shift,just completing the initial report and preliminary investigation. It then requires an evidence technician to process each vehicle for evidence, and a detective to perform follow up investigation. If the thief is successful, the entire time consuming process will repeat itself if the owner does not take action to protect the property. This is an unnecessary burden on the taxpayers. The reasons for our concern is that the owner/operator of this business states that he is planning on being absent and running it from a distance via technology. There is also no mention of a security plan. I would recommend that this USR be approved only upon submission and implementation of a robust security strategy.
