BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
APRIL 9, 2014
The Board of County Commissioners of Weld County, Colorado, met in regular session in full
conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County
Administration Building, Greeley, Colorado, April 9, 2014, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Douglas Rademacher, Chair
Commissioner Barbara Kirkmeyer, Pro-Tem - EXCUSED
Commissioner Sean P. Conway - EXCUSED

El MINUTES: Commissioner Garcia Freeman moved to approve the minutes of the Board of County
Commissioners meeting of April 7, 2014, as printed. Commissioner Freeman seconded the motion,
and it carried unanimously.
El AMENDMENTS TO AGENDA: There were no amendments to the agenda.
E CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda as
printed. Commissioner Garcia seconded the motion, and it carried unanimously.
E PUBLIC INPUT: Sandy Rice, County resident of Erie Colorado, spoke in regard to an alleged
violation of USR-1627, and entered photos into the record as Exhibit "A". She said the Cambodian
Cultural Center was approved in 2008, and neighbors voiced concerns at that time about the large size
of the gatherings. She said their permit allows 200 people and 2 large events per year; however 500-
600 people attend multiple events blocking the roads. Bruce Barker, County Attorney, advised the
Board to refer this matter to the Planning Department for investigation and consideration of a possible
Show Cause hearing before the Board. Ms. Rice was advised to speak with Tom Parko, the Director.
Ms. Rice noted the next event will take place on April 19 and 20, and she would like a County
representative to be present. She affirmed the Planning Department has been notified of past
violations. Commissioner Freeman, as the Planning Department Coordinator, said that he would follow
up on the issue.

NEW BUSINESS:
E5 1) CONSIDER MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO SIGN -
SHARE OUR STRENGTH'S COOKING MATTERS COLORADO (NO KID HUNGRY): Director Mark
Wallace, Department of Public Health and Environment, reported this contract will allow the hiring of a
full-time Cooking Matters coordinator/health educator for low-income families regarding ways to
purchase and prepare affordable healthy meals; the County will be reimbursed for the full cost with
responsibility for providing supervision and work space. He stated this is an important supplement to
his department's healthy eating and active living initiative and in addressing childhood obesity.
Commissioner Garcia moved to approve said memorandum of understanding and authorize the Chair
to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously.
E9 2) CONSIDER MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO SIGN -
PET'S EMERGENCY CLINIC: Dr. Wallace explained the County will provide up to six (6) rabies
vaccinations for the clinic's employees and the clinic will prepare samples free of charge and are
available 24/7. He noted this is increasingly important as the number of cases of skunks with rabies
increases. Commissioner Freeman moved to approve said memorandum of understanding and
authorize the Chair to sign. The motion was seconded by Commissioner Garcia, and it carried
unanimously.
E9 3) CONSIDER ACKNOWLEDGING CANCELLATION OF TAX LIEN SALE CERTIFICATE
(TS CERT 2005-0668) FOR PARCEL #053933103007: John Lefebvre, Treasurer, was unable to be
present; Commissioner Freeman moved to continue this item to the following hearing, Monday,
April 14, 2014. Commissioner Garcia seconded the motion and it carried unanimously.
E 4) CONSIDER RENEWAL APPLICATION FOR A RETAIL LIQUOR STORE LICENSE AND
AUTHORIZE CHAIR TO SIGN - CROW VALLEY LIQUORS, LLC, DBA CROW VALLEY LIQUORS:
Brad Yatabe, Assistant County Attorney, recommended approval. Chair Rademacher opened the floor
to public comment and none was forthcoming. Commissioner Freeman moved to approve said license
and authorize the Chair to sign. Seconded by Commissioner Garcia, the motion carried unanimously.
E5 5) CONSIDER TEMPORARY CLOSURE OF CR 53 BETWEEN STE HWY 392 AND CR 66:
Amy Joseph, Department of Public Works, reviewed the temporary road closure for a culvert
replacement. Commissioner Garcia moved to approve said temporary road closure. The motion,
which was seconded by Commissioner Freeman, carried unanimously.
E9 6) CONSIDER WORK ORDER FORM #2 PURSUANT TO AGREEMENT FOR CR 22 AND 49
INTERSECTION IMPROVEMENTS PROJECT AND AUTHORIZE CHAIR TO SIGN - WESTERN
STATES LAND SERVICES: Leon Sievers, Department of Public Works, explained this is pursuant to a
professional services agreement to acquire rights-of-way, on an hourly rate schedule not to exceed
$20,000.00. Commissioner Garcia moved to approve said work order form and authorize the Chair to
sign. The motion was seconded by Commissioner Freeman, and it carried unanimously.
El 7) CONSIDER WORK ORDER FORM #3 PURSUANT TO AGREEMENT FOR CR 49
EXTENSION IMPROVEMENTS PROJECT AND AUTHORIZE CHAIR TO SIGN -WESTERN STATES
LAND SERVICES: Mr. Sievers said this is similar to the previous item and reviewed the three parcels.
Commissioner Freeman moved to approve said work order form and authorize the Chair to sign. The
motion was seconded by Commissioner Garcia, and it carried unanimously.

E5 8) CONSIDER AGREEMENT FOR PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY AND
PERMANENT EASEMENT FOR CERTAIN IMPROVEMENTS TO CR 49 AND AUTHORIZE CHAIR TO
SIGN - WELD COUNTY INVESTMENT GROUP, INC.: Mr. Sievers reviewed the purchase, location,
and compensation. Commissioner Garcia moved to approve said agreement and authorize the Chair
to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously.
El 9) CONSIDER AGREEMENT FOR PURCHASE OF TEMPORARY CONSTRUCTION
EASEMENT FOR THE CR 49 EXTENSION PROJECT AND AUTHORIZE CHAIR TO SIGN - WELD
COUNTY INVESTMENT GROUP, INC.: Mr. Sievers said this is the same landowner and reviewed the
compensation. Commissioner Freeman moved to approve said agreement and authorize the Chair to
sign. The motion was seconded by Commissioner Garcia, and it carried unanimously.
10) CONSIDER AGREEMENT FOR PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY AND
PERMANENT EASEMENT FOR CERTAIN IMPROVEMENTS TO EAST 18TH STREET, AS PART OF
THE CR 49 EXTENSION PROJECT, AND AUTHORIZE CHAIR TO SIGN - JOSEPHINE CLOUGH:
Mr. Sievers stated this parcel is over the Platte River and therefore vital for the new bridge and
reviewed compensation. Commissioner Freeman moved to approve said agreement and authorize the
Chair to sign. The motion was seconded by Commissioner Garcia, and it carried unanimously.
11) CONSIDER AGREEMENT FOR PURCHASE OF TEMPORARY CONSTRUCTION
EASEMENT FOR CERTAIN IMPROVEMENTS TO EAST 18TH STREET, AS PART OF THE CR 49
EXTENSION PROJECT AND AUTHORIZE CHAIR TO SIGN - JOSEPHINE CLOUGH: Mr. Sievers
stated this is the same project and landowner. Commissioner Freeman moved to approve said
amendment and authorize the Chair to sign. The motion was seconded by Commissioner Garcia, and
it carried unanimously.
IEl 12) CONSIDER FIRST AMENDMENT TO AGREEMENT FOR THE EXCHANGE OF CERTAIN
REAL PROPERTY BETWEEN BIG THOMPSON INVESTMENT HOLDINGS, LLC, AND WELD
COUNTY, COLORADO: Mr. Yatabe stated that this is an amendment to the land swap agreement for
the Weld County Industrial Park, a process started in June, 2012; the property value is being adjusted
to be an equal swap, in order to avoid a taxable event, and there is no disadvantage for the County in
allowing that. He stated the developer has been asked to cover a larger portion of the closing costs
due to additional County staff time. The easement will be included in the agreement for two water and
electric lines, but gives the County recourse if those interfere with Grader Shed operations. He said the
closing is scheduled to take place on April 14, 2014, and explained the process. Commissioner Garcia
moved to approve said work agreement and authorize the Chair to sign. The motion was seconded by
Commissioner Freeman, and it carried unanimously.
F 13) CONSIDER AMENDMENT TO CHANGE ORDER #1 TO AGREEMENT FOR THE
HOEKSTRA GRAVEL PIT CLAY LINER-SLURRY WALL DESIGN-BUILD CONTRACT (BID
#61200123) AND AUTHORIZE CHAIR TO SIGN - HALL-IRWIN CONSTRUCTION: Mr. Barker
reviewed the history of this item, the contract (coverage of remediation) and the flood event issues. He
stated Hall-Irwin has acknowledged their responsibility for necessary flood repairs and remediation and
also explained that the County picked up the cost of de-watering after that event. The County and
Hall-Irwin have determined this is a fair resolution of all of those issues. Commissioner Garcia moved
to approve said amendment to change order and authorize the Chair to sign. The motion was seconded
by Commissioner Freeman, and it carried unanimously. Chair Rademacher thanked staff for all their
hard work on this.

E 14) CONSIDER FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION
38-1-101, C.R.S., AGAINST ANDREW JAY HOP AND THE PAULA LEE HOP EXEMPTION TRUST:
Mr. Choate explained this is related to the CR 49 Extension Project. He said Mr. Sievers has been in
contact with the owners, but even after significant negotiation they remain three times higher on the
purchase price than multiple appraisals indicate is appropriate. Mr. Choate explained this will authorize
the County's Controller to pay into the registry of the court, or to the property owner, as required by law.
Mr. Sievers gave a brief history on this negotiation, confirming this is a financial versus a philosophical
issue; the owner is not opposed to the alignment or the road. Commissioner Garcia moved to approve
said filing of proceedings. Commissioner Freeman seconded the motion, saying the County doesn't
have much of a choice, and it carried unanimously. Commissioner Garcia praised Mr. Sievers for his
hard work on this ac mm project accommodating property owners while protecting the County's interests and
Chair Rademacher concurred with both statements.
El 15) FINAL READING OF WELD COUNTY CODE ORDINANCE #2014-5, IN THE MATTER OF
REPEALING AND RE-ENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION, OF THE
WELD COUNTY CODE: Commissioner Garcia moved to read by title only. Seconded by
Commissioner Freeman, the motion carried unanimously. Mr. Barker read the title for the record.
E Mr. Choate explained the purpose of the change, and reported no changes since the previous
reading. El Chair Rademacher opened the meeting for public comment and none was forthcoming.
El Commissioner Freeman moved to approve said code ordinance on final reading. Seconded by
Commissioner Garcia, the motion carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2014-05 was approved on Final Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 9:40 a.m.

Consecration of Sima Boundary, Buddha Statues
and Inauguration of new Bt tilding ceremony
We,the monk,board of members and Buddhist fr {lowers of Cambodian Cultural Center,
Inc. known as Wat Buddha Mondol Raingsey-the Cambt Alan Buddhist Temple in Erie,
Colorado, are going to organize and celebrate the ceremo ny of Sima boundary,Buddha Statues
and new building inaugural which will take place on Jinx>2223-24,2012 according to the
Buddhist tradition.
As mentioned above, We would like to invite Ven -able monks, lay men, lay women,
ladies and gentlemen,and all Buddhist followers to join an.d support this ceremony.
