RE: WCR 49 Extension—FHU Environmental Services Change Order No.2

Brief description of the problem/issue:
The original scope of environmental services and the subsequent Change Order No. 1 needs to be modified.
Recently the County has received a RAMP Grant from CDOT for the construction of improvements to the
WCR 49/SH 34 Intersection (see attached aerial photo with project limits). This new stand-alone project will
require FHU to complete additional environmental services as required for the CDOT Form 128 Categorical
Exclusion to be obtained. This will enable the County to bid out the intersection separately from the rest of the
WCR 49 Extension Project. Public Works is anticipating this intersection project will be constructed in the
summer of 2014.
The additional environmental services to be provided by FHU were accounted for in the RAMP Grant
application. In the application these additional design services were estimated to be $70,000. The recent fee
proposal received from FHU is in the amount of$38,790. Costs related to environmental clearances, design,
ROW acquisition, and utilities relocation are to be paid for by the County as part of our cost-share matching
funds required by the grant. The total cost of this intersection is estimated to be $2,200,000. The County cost-
share funding portion is estimated to be $700,000.
What options exist for the Board:
The Board can choose to approve the attached Change Order No.2 with FHU, or choose to delay or cancel the
proposed additional environmental services.
Recommendation to the Board:
Public Works recommends approval of the Change Order No.2 with FFIU. If approved, the consultant plans to
have completed environmental clearances for this project by April,2014 so construction can proceed in June.

The following change is hereby made to the Contract Documents: The original scope of services related to the
Agreement for Professional Services dated October 10, 2011 and the subsequent Change Oder No.1 needs to be
modified. The County has received a RAMP Grant from CDOT for the construction of improvements to the WCR 49/SH
34 Intersection. This new stand-alone project will require FHU to complete additional environmental services as require
for the CDOT Form 128 Categorical Exclusion to be obtained. This permit is required by CDOT prior to giving their
concurrence to advertise the project for construction. PW staff is currently planning to bid the construction work
associated with the RAMP Grant in April,2014. Details of the scope of services are described in the attached documents
provided by the consultant:

CHANGE TO CONTRACT PRICE:
Original Contract Price: $129,855.00
Current Contract Price adjusted by previous Change Order: $199,195.00
The Contract Price due to this Change Order will be increased by: $38,790.00
The new Contract Price,including this Change Order,will be: $237,985.00
CHANGE TO CONTRACT TIME:
The Contract Time will be increased by 12 months.

Weld County Road 49 / US 34 Intersection Improvements
CDOT Environmental Clearances
Scope of Work
Project Description
In order to provide regional north/south connectivity east of Greeley, Weld County Road
49 (WCR 49) was identified as an arterial corridor between US Highway 34 (US 34) and
State Highway 14 (SH 14). Weld County identified a preferred alignment for this corridor
in the Weld County Road 49 Arterial Corridor Study (Felsburg Holt & Ullevig [FRU]
2004). The preferred alignment was selected because it would best improve north/south
connectivity in this portion of Weld County.
In 2011, FHU worked with Weld County and the US Army Corps of Engineers (USACE)
to determine if the selected alignment over the Cache la Poudre River could be
permitted under the Clean Water Act. Through an alternative screening process, the
USACE concurred with Weld County that the selected alignment appeared to be the
least environmentally damaging practicable alternative (LEDPA).
In 2012 and 2013, FHU continued to work on Clean Water Act Section 404 permitting
(404 Permitting) for the entire WCR 49 alignment. In the meantime, Weld County was
awarded RAMP funding for the southern portion of the project. Due to the fact that the
funding is being obtained from the State, CDOT clearances must be obtained prior to
construction. Weld County has requested that a scope of work and fee estimate be
prepared to obtain environmental clearances for the WCR 49 at Highway 34
improvements.
Major items in this scope include: historical resources documentation, preparation of a
biological resources memo and a categorical exclusion memo. This scope of work and
fee, in combination with the current contract, will achieve the environmental clearances
for WCR 49 intersection improvements at US 34.
Task 1 — CDOT Environmental Clearances
Purpose
Environmental Clearance - All environmental reports and clearances will be completed,
permits obtained, and mitigation plans developed to attain CDOT Form 128 clearance
prior to advertisement of the project. The following environmental activities include those
resources that require specific FHU investigation.
• Air Quality Analysis: FHU will prepare a qualitative analysis of air emissions in the
project area. FHU will conduct this analysis in accordance to CDOT guidance.
• Noise Impacts Analysis: There are no noise impacts expected in the project area due
to the project. FHU will prepare a memo in accordance with CDOT guidance to support
the environmental clearance document.
• Biological Resources: FHU will conduct a site visit to document the biological
resources in the project area. This includes the identification of wetlands, wildlife habitat,
and noxious weeds. It is not anticipated that any biological resources that require
mitigation or special consideration are present in the project area.
• Archaeology and Paleontology: Archaeology and paleontology documentation was
previously prepared for the entire WCR 49 project. More research or investigation is not

needed for this project, however a site specific summary of the archaeology and
paleontology will be prepared as a part of the environmental clearance.
• Permits: No environmental permits, other than documentation for the CDOT Form 128
are expected at this time.
Task 2— Historic Clearances
Purpose
This scope and fee was prepared to address the needs of the USAGE and State Historic
Preservation Office (SHPO) such that results in the issuance of a Section 404 Permit.
The purpose of this task is necessary because of the plans to realign the Ogilvy Ditch,
which is an historic resource. Because of this impact to a historic resource, an evaluation
of this and other historic resources in the project area are required. The issuance of a
Section 404 permit (Nationwide or Individual) is a federal action and requires that the
USAGE notify the SHPO of the action and potential impacts to historic resources. This
effort is required to comply with Section 106 of the National Historic Preservation Action
of 1966.
In general, the following steps will have to be taken to achieve concurrence with the
SHPO:
• Determine and Coordinate Area of Potential Effects
• Identify Historic Properties within Area of Potential Effects
o Prepare Architectural Forms (per property)
o Conduct Field Visit
o Prepare Management Data Forms
o Prepare Report
• Determine Effect to Eligible Historic Properties
• Mitigate Adverse Effects
FHU will sub-contract with Dill Historians to document the eligibility status of the ditches
and properties in the project area to be on the National Register of Historic Places. The
documentation of such resources requires that the completion of forms that describes
the context of the resource and the characteristics of the structure or feature that serves
as a contributing factor to the eligibility of the site to be listed on the National Register.
These forms must be completed by an historian with sufficient education, training, and
experience to recognize and properly document these resources. These forms are
required for all potential resources in the project area that have potential to be impacted
by the project. A report documenting these forms and results are required and to be
submitted to SPHO for review and concurrence.
Once the eligibility status of these resources are determined and the SHPO concurs with
these eligibility determination, FHU and Dill will determine the types of effects to the
eligible resources from the implementation of the project. This involves the application of
criteria of adverse effects specified in Section 106 through reviewing and understanding
the project design. These effects are documented and sent to SHPO for review and
concurrence. This process usually requires multiple steps with SHPO to achieve
concurrence.
At the current anticipated design, it is anticipated that the realignment of Ogilvy Ditch
could be determined by the SHPO to be an adverse effect to the resource. If this effect is
determined by SHPO, then mitigation will be required by SHPO. This typically results in
a very detailed recordation of the resource. This Level II Documentation, or recordation,

includes specific photography requirements and more detailed documentation by an
historian. The Level II Recordation is estimated at about $6,000 per property.
Task 3— Categorical Exclusion Documentation
Purpose
FHU will prepare all the necessary materials in support of CDOT Form 128 —Categorical
Exclusion. Work previously performed by FHU under previous task orders will be utilized
as needed. FHU will prepare the documents, graphics, and plans, with assistance from
the County, as appropriate.
Task 4 - Project Coordination/Meetings
Purpose
FHU will provide appropriate project management of the work to assure that the scope,
budget, and schedule are adhered. FHU has assumed no more than four (4) additional
project coordination meetings will be required to discuss the project and coordinate the
work efforts.
