The Division is required to make an approval or denial decision no later than April 21, 2014 therefore; a response to the following adequacy review concerns should be submitted to the Division as soon as possible. 1. The Applicant response is adequate. 2. As required by Rule 1.6.2 (e),please submit proof of the notice to all owners of record of surface and mineral rights of the affected land and the owners of record of all land surface within 200 feet of the boundary of the affected land including all easement holders located on the affected land and within 200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing or by proof of personal service. The Division did not receive proof of notice for the following landowner and structure owners: a. L.G. Everist, Inc. b. Deporter,Arvid R. 3. Please provide the Division evidence the Applicant attempted to obtain notarized structure agreements, typically a certified mail receipt,with all owners of the structures on and within 200 feet of the affected area of the site or comply with one of the other provisions of Rule 6.4.19. Please be advised the Connell Carr Pit application may be deemed inadequate,and the application maybe denied on April 21, 2014, unless the above mentioned adequacy review items are addressed to the satisfaction of the Division. If more time is needed to complete the reply, the Division can grant an extension to the decision date. This will be done upon receipt of a written waiver of the Applicant's right to a decision by April 21, 2014 and request for additional time. This must be received no later than the deadline date. Connell Carr Pit, Permit No. M-2014-001 Dear Mr. Hays: The following discussion and attachments are submitted on behalf of our client, Connell Resources, Inc., in response to the Adequacy Review comments prepared by the Division of Reclamation, Mining and Safety dated April 16, 2014 for the Connell Carr Pit 112 Construction Materials Reclamation Permit application. Platte River Power Authority requested a mining setback of 50 feet from the east edge of their buried gas pipeline easement. During communications with Platte River Power Authority and DRMS, Connell Resources agrees to provide the 50-foot setback from the gas line easement. With the mining pit top of bank setback a minimum of 50 feet or three (3) times the adjacent pit depth, whichever is greatest, from permanent man-made structures, the applicant believes that we have complied with the provisions of Rule 6.4.19 and we do not believe that mining and reclamation activities will adversely affect the stability of any significant, valuable and permanent man-made structure not owned by the applicant. As stated in the DRMS Adequacy Review comments from Blue Earth Solutions dated April 7, 2014, the Applicant has been discussing the proposed mining and reclamation operation with owners of adjacent utility structures.
