HomeMy WebLinkAbout20140775.tiff HEARING CERTIFICATION DOCKET NO. 2014-06 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR13-0057, FOR A USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL DISTRICTS (SELF MINI STORAGE, RV, BOAT AND CAMPER TRAILER STORAGE) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT- SHAWN AND STACEY GREATHOUSE A public hearing was conducted on March 12, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Tiffane Johnson Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated January 30, 2014, and duly published February 4, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Shawn and Stacey Greathouse, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0057, for a use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Districts (self mini storage, RV, boat and camper trailer storage) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Tiffane Johnson, Department of Planning Services, presented a brief summary of the proposal for 400 mini storage units and RV, boat and camper trailer storage on a five-acre portion of the 35-acre parcel and entered the favorable recommendation of the Planning Commission into the record as written. She reviewed vinyl and barbed wire fencing, as well as some landscaping on the south side of the building (placed east/west to shield the view of the other buildings) - adjacent to CR 50. There is a Lighting Plan (pole lights/downcast) and signage is also proposed. They are within the Urban Growth Area of the Town of Johnstown, and Johnstown expressed concern regarding the site distance from CR 15, due to a slight rise; however, the Weld County Department of Public Works approved the access permit and indicated no concerns. She showed images of the site and noted the closest residence is 600 et: CA PL y o 1 i�' 2014-0775 3 a`' PL2256 HEARING CERTIFICATION - SHAWN AND STACEY GREATHOUSE (USR13-0057) PAGE 2 feet to the southwest. • Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and requirements, and reviewed traffic counts. Access is from County Road 50 at the T- Intersection, with a setback from the main gate; there is an emergency secondary access as well. He said there will be a setback from the road; a grading permit and a road maintenance agreement are required. Average traffic is estimated to be 4-5 customers accessing storage on a daily basis, with more possible on weekends. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions. The Dust Abatement Plan calls for recycled asphalt, and the residence is served by Little Thompson Water. She noted Development Standard #14 should be revised, as it limits the applicant to 10 customers onsite. She also suggested that Development Standard #16 should be changed only to refer to the existing residence. • Shawn Greathouse, applicant, stated all the storage facilities in this area are full, so there is a definite need. He said has spoken with all of his neighbors and lives to the east of this property, so he and his family want this project to look good; he is fine with providing the landscaping requested by the Town of Johnstown. • No public testimony was offered concerning this matter. IR In response to Commissioner Conway, Mr. Greathouse said it was his idea to locate the access across from the T-Intersection and to add a Stop sign. Ms. Johnson suggested the deletion of the customer limit from Development Standard #14, and changing the word 'facility' to 'existing residence' in Development Standard #16, both done by assent of the Board. In response to Commissioner Kirkmeyer, Ms. Johnson said landscaping, lighting and signing have all been approved, and Mr. Greathouse briefly described his plans for signage. ▪ In response to Chair Rademacher, Mr. Greathouse indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. ��- Commissioner Kirkmeyer moved to approve the request of Shawn and Stacey Greathouse for a Site Specific Development Plan and Use by Special Review Permit, USR13-0057, for a use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Districts (self mini storage, RV, boat and camper trailer storage) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
