WHEREAS, the Town of Eaton is making improvements
to certain streets, including Cheyenne Avenue, in the Town
of Eaton, and
WHEREAS, portions of Cheyenne Avenue are within
the Town of Eaton and portions are without, and
WHEREAS, the entire project has been advertised
and let for bids, and
WHEREAS, the engineer' s estimate of the county' s
share of such improvements is $10, 475. 55, and
WHEREAS, an agreement has been submitted by the
Town of Eaton for the approval of the Board of County
Commissioners.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners, Weld County, Colorado, that the Chair-
man be and he is hereby authorized to sign said agreement
with the Town of Eaton for improvements on Cheyenne Avenue.
The above and foregoing resolution was, on motion
duly made and seconded, adopted by the following vote this
28th day of May , 1975, nunc pro tunc as of May
15, 1975. /

AGREEMENT
or
THIS AGREEMENT made and entered into this 1) day of May,
1975 by and between the TOWN OF EATON, COLORADO, hereinafter
called the "town" and WELD COUNTY, hereinafter called the "county, "
WITNESSET H:
WHEREAS the town is making improvements to certain streets ,
including Cheyenne Avenue in the Town of Eaton; and
WHEREAS portions of Cheyenne Avenue are within the Town of
Eaton and portions are without; and
WHEREAS the entire project has been advertised and let for
bids ; and
WHEREAS the engineer ' s estimate of the county' s share of such
improvements is $10,475 . 55 ; and
WHEREAS the county desires to pay its share of said improve-
ments .
IT IS THEREFORE AGREED :
1 . That the whereas clauses above set forth are incorporated
by reference as a part of this agreement .
2 . The project will be completed by the town in accord with
the plans and specifications .
3 . The county will pay its share of the final construction costs
directly to the contractor, based upon the engineer ' s final certi-
fication .
4 . The county ' s share will not include any costs for curb,
gutter or sidewalk.
