STATE AND FEDERAL REGULATORY REQUIREMENTS 10. The permit number and AIRS ID point number (e.g. 123/4567/890) shall be marked on the subject equipment for ease of identification. (Reference: Regulation Number 3, Part B, III.E.) (State only enforceable) 11. Visible emissions shall not exceed twenty percent(20%)opacity during normal operation of the source. During periods of startup, process modification, or adjustment of control equipment visible emissions shall not exceed 30%opacity for more than six minutes in any sixty consecutive minutes. (Reference: Regulation No. 1, Section II.A.1. &4.) 12. This source is subject to the odor requirements of Regulation No.2.(State only enforceable) 13. At all times, including periods of start-up, shutdown,and malfunction,the facility and control equipment shall, to the extent practicable, be maintained and operated in a manner consistent with good air pollution control practices for minimizing emissions. Determination of whether or not acceptable operating and maintenance procedures are being used will be based on information available to the Division, which may include, but is not limited to, monitoring results, opacity observations, review of operating and maintenance procedures, and inspection of the source. (Reference: Regulation No. 6, Part A. General Provisions from 40 CFR 60.11 b. No article, machine, equipment or process shall be used to conceal an emission which would otherwise constitute a violation of an applicable standard. Such concealment includes, but is not limited to, the use of gaseous diluents to achieve compliance with an opacity standard or with a standard which is based on the concentration of a pollutant in the gases discharged to the atmosphere. (§ 60.12) c. Written notification of construction and initial startup dates shall be submitted to the Division as required under § 60.7. d. Records of startups, shutdowns, and malfunctions shall be maintained, as required under§ 60.7. e. Written notification of opacity observation or monitor demonstrations shall be submitted to the Division as required under§ 60.7. f. Excess Emission and Monitoring System Performance Reports shall be submitted as required under§ 60.7. g. Performance tests shall be conducted as required under§ 60.8. h. Compliance with opacity standards shall be demonstrated according to § 60.11. 14 Point 002:To satisfy RACT,this facility shall follow the New Source Performance Standards requirements of Regulation No. 6, Part A, Subpart KKK, Standards of Performance for Onshore Natural Gas Processing Plants including, but not limited to, the following: • 40 CFR, Part 60, Subpart A—General Provisions • §60.632 Standards o (a)-Each owner or operator subject to the provisions of this subpart shall comply with the requirements of § 60.482-1 (a), (b), and (d) and 60.482-2 through 60.482-10, except as provided in §60.633, as soon as practicable, but no later than 180 days after initial startup. o (b) - An owner or operator may elect to comply with the requirements of §60.483-1 and §60.483-2. o (d) Each owner or operator subject to the provisions of this subpart shall comply with the provisions of§60.485 except as provided in §60.633(f)of this subpart. o (e) Each owner or operator subject to the provisions of this subpart shall comply with the provisions of §§60.486 and 60.487 except as provided in §§60.633, 60.635, and 60.636 of this subpart. • §60.633 Exceptions o (a) Each owner or operator subject to the provisions of this subpart may comply with the following exceptions to the provisions of subpart W. AIRS ID: 123/9B7D Page 5 of 13 %.,z, tolor Depanent 6f • .IiHealth and Environment =e 1 :Air Pollution Control Division o (b)( «r. pregaurcirrelief device iri-gas/vapaservice may be monitored quarterly and within 5 days after each pressure release to detect leaks by the methods specified in §60.485(b) except as provided in §60.632(c), paragraph (b)(4) of this section, and §60.482-4 (a)through (c) of subpart VV. • (2) If an instrument reading of 10,000 ppm or greater is measured,a leak is detected. • (3)0)When a leak is detected, it shall be repaired as soon as practicable, but no later than 15 calendar days after it is detected, except as provided in §60.482-9. • (ii)A first attempt at repair shall be made no later than 5 calendar days after each leak is detected. o (c)Sampling connection systems are exempt from the requirements of§60.482- 5. • §60.635 Recordkeeping o (a) Each owner or operator subject to the provisions of this subpart shall comply with the requirements of paragraphs (b) and (c) of this section in addition to the requirements of§60.486. o (b) The following recordkeeping requirements shall apply to pressure relief devices subject to the requirements of§60.633(b)(1) of this subpart. • (1) When each leak is detected as specified in §60.633(b)(2), a weatherproof and readily visible identification,marked with the equipment identification number, shall be attached to the leaking equipment. The identification on the pressure relief device may be removed after it has been repaired. • (2) When each leak is detected as specified in §60.633(b)(2), the following information shall be recorded in a log and shall be kept for 2 years in a readily accessible location: • (i) The instrument and operator identification numbers and the equipment identification number. • (ii)The date the leak was detected and the dates of each attempt to repair the leak. • (iii) Repair methods applied in each attempt to repair the leak. • (iv) "Above 10,000 ppm" if the maximum instrument reading measured by the methods specified in paragraph (a) of this section after each repair attempt is 10,000 ppm or greater. • (v) "Repair delayed" and the reason for the delay if a leak is not repaired within 15 calendar days after discovery of the leak. • (vi)The signature of the owner or operator(or designate)whose decision it was that repair could not be effected without a process shutdown. • (vii)The expected date of successful repair of the leak if a leak is not repaired within 15 days. • (viii) Dates of process unit shutdowns that occur while the equipment is unrepaired. • (ix) The date of successful repair of the leak. The designation of equipment subject to the provisions of §60.482-4(a) shall be signed by the owner or operator. • §60.636 Reporting Requirements o (a) Each owner or operator subject to the provisions of this subpart shall comply with the requirements of paragraphs (b)and (c) of this section in addition to the requirements of§60.487. o (b) An owner or operator shall include the following information in the initial semiannual report in addition to the information required in §60.487(b) (1)—(4): Number of pressure relief devices subject to the requirements of §60.633(b) except for those pressure relief devices designated for no detectable emissions under the provisions of §60.482-4(a) and those pressure relief devices complying with §60.482-4(c). o (c)An owner or operator shall include the following information in all semiannual reports in addition to the information required in §60.487(c)(2) (i)through (vi): • (1) Number of pressure relief devices for which leaks were detected as required in §60.633(b)(2) and • • (2) Number of pressure relief devices for which leaks were not repaired as required in §60.633(b)(3). 15. Points 003-007: These units are subject to the Particulate Matter and Sulfur Dioxide Emission Regulations of Regulation 1 including, but not limited to, the following: a. No owner or operator shall cause or permit to be emitted into the atmosphere from any fuel-burning equipment particulate matter in the flue gases which exceeds the following (Regulation 1, Section III.A.1): j (i) For fuel burning equipment with designed heat inputs greater than 1x106 BTU per hour, but less than or equal to 500x106 BTU per hour, the following equation will be used to determine the allowable particulate emission limitation. PE=0.5(FI)a26 Where: PE = Particulate Emission in Pounds per million BTU heat input. Fl = Fuel Input in Million BTU per hour. b. Sources of sulfur dioxide shall not emit sulfur dioxide in excess of the following limitations. (Heat input rates shall be the manufacturer's guaranteed maximum heat input rates). (Regulation 1, Section VI.B) (i) Limit emissions to not more than two (2) tons per day of sulfur dioxide (Regulation 1, Section VI.B.5.a) 16. Point 002: Upon startup of these points, the owner or operator shall follow the most recent operating and maintenance(O&M)plan and record keeping format approved by the Division, in order to demonstrate compliance on an ongoing basis with the requirements of this permit. Revisions to your O&M plan are subject to Division approval prior to implementation. (Reference: Regulation No. 3, Part B, Section III.G.7.) COMPLIANCE TESTING AND SAMPLING Initial Testing Requirements 18. Point 002:Within one hundred and eighty days(180)after commencement of operation,the owner or operator shall complete the initial extended gas analysis of gas samples that are representative of volatile organic compound (VOC)and hazardous air pollutants(HAP)that may be released as fugitive emissions. This extended gas analysis shall be used in the compliance demonstration as required in the Emission Limits and Records section of this permit. The operator shall submit the results of the gas analysis and emission calculations to the Division as part of the self-certification process to ensure compliance with emissions limits. 19. Point 002:Within one hundred and eighty days(180)after commencement of operation,the operator shall complete a hard count of components at the source and establish the number of components that are operated in "heavy liquid service", "light liquid service", "water/oil service" and "gas service". The operator shall submit the results to the Division as part of the self-certification process to ensure compliance with emissions limits. Periodic Testing Requirements 20. Point 002: On an annual basis, the owner or operator shall complete an extended gas analysis of gas samples that are representative of volatile organic compounds (VOC) and hazardous air pollutants (HAP)that may be released as fugitive emissions. This extended gas analysis shall be used in the compliance demonstration as required in the Emission Limits and Records section of this permit. 21. Point 002:This facility is subject to the leak detection and repair(LDAR)requirements of 40 C.F.R Part 60, Subpart KKK. ADDITIONAL REQUIREMENTS 22. A revised Air Pollutant Emission Notice(APEN)shall be filed:(Reference: Regulation No.3, Part A, II.C) a. Annually by April 30th whenever a significant increase in emissions occurs as follows: For any criteria pollutant: For sources emitting less than 100 tons per year, a change in actual emissions of five (5) tons per year or more, above the level reported on the last APEN; or For volatile organic compounds (VOC) and nitrogen oxides sources (NO,)in ozone nonattainment areas emitting less than 100 tons of V0C or N0,a per year, a AIRS ID: 123/9B7D Page 8 of 13 ,olor Depar nenf 6f PtblicHealth and Environment "t" Errit Air Pollution Control Division if _ Chang t ht,a ,t nual aftal ifiliations ajiga : ton a-, , ar or more or five percent, whichever is greater, above the level reported on the last APEN; or For sources emitting 100 tons per year or more, a change in actual emissions of five percent or 50 tons per year or more,whichever is less, above the level reported on the last APEN submitted; or For any non-criteria reportable pollutant: If the emissions increase by 50% or five (5)tons per year,whichever is less, above the level reported on the last APEN submitted to the Division. b. Whenever there is a change in the owner or operator of any facility, process, or activity; or c. Whenever new control equipment is installed, or whenever a different type of control equipment replaces an existing type of control equipment; or d. Whenever a permit limitation must be modified; or e. No later than 30 days before the existing APEN expires. GENERAL TERMS AND CONDITIONS 23. This permit and any attachments must be retained and made available for inspection upon request. The permit may be reissued to a new owner by the APCD as provided in AQCC Regulation No. 3, Part B, Section II.B upon a request for transfer of ownership and the submittal of a revised APEN and the required fee. 24. If this permit specifically states that final authorization has been granted,then the remainder of this condition is not applicable. Otherwise, the issuance of this construction permit does not provide"final"authority for this activity or operation of this source. Final authorization of the permit must be secured from the APCD in writing in accordance with the provisions of 25-7-114.5(12)(a) C.R.S. and AQCC Regulation No. 3, Part B, Section III.G. Final authorization cannot be granted until the operation or activity commences and has been verified by the APCD as conforming in all respects with the conditions of the permit. Once self-certification of all points has been reviewed and approved by the Division, it will provide written documentation of such final authorization. Details for obtaining final authorization to operate are located in the Requirements to Self-Certify for Final Authorization section of this permit. 25. Single Source Determination for Kerr-McGee's Central Oil Stabilization Facility Kerr-McGee Gathering LLC (KMG) recently submitted a permit application for the Central Oil Stabilization Facility (COSF) which they plan to locate adjacent to the existing facility with AIRS ID 123/6916, called the Platteville Station. This existing facility, which includes operations owned by KMG, Noble Energy Inc., and Rose Rock, was determined by the Division to be a single source on 12/5/2012. The Division has determined that the COSF should not be aggregated with the Platteville Station. Facility Description Kerr-McGee plans to pump condensate directly from wellhead separators to the COSF. The condensate will then be flashed to atmospheric at the centralized facility so that emissions can be collected for processing. The stabilized oil will be sent to either the Rose Rock pipeline or to a nearby rail facility. The Platteville Station (AIRS ID 123/6916) consists of a pipeline injection operation owned by Rose Rock and two Oil Polishing Facilities (OPFs) owned by Noble Energy and KMG. Background In the PSD regulations promulgated with the 1980 Preamble, EPA established the following three-part test to determine what buildings, structures, facilities and installations should be considered a single source. This three-part test is currently codified at 40 C.F.R. § 52.21(b)(6): All of the pollutant-emitting activities which belong to the same industrial grouping, are located on one or more contiguous or adjacent properties, and are under the common control of the same person (or persons under common control). . . . Pollutant-emitting activities shall be considered as part of the same industrial grouping if they belong to the same "Major Group" (i.e., which have the same first two digit code) as described in the Standard Industrial Classification Manual, 1972, as amended by the 1977 Supplement (U.S. Government Printing Office stock numbers 4101-0066 and 003-005-00176-0, respectively). Same Industrial Grouping The COSF is classified as a Crude Petroleum and Natural Gas facility with SIC 1311. The Platteville Station is split into two SIC: the existing KMG and Noble oil polishing facilities both are also SIC 1311 while the Rose Rock station has SIC 4612. Contiguous or Adjacent The COSF will share its southern border with the Noble and Rose Rock portions of the Platteville Station, and will be approximately 800 ft. from Kerr-McGee's OPF. Common Control KMG owns both the COSF and an OPF which is part of the Platteville Station. The 2012 determination was based on common control of the OPFs by Rose Rock; a similar control relationship would be needed to aggregate the COSF with the other operations at the site. According to a September 18, 1995 letter by William A. Spratlin, Director of the Air, RCRA, and Toxics Division of EPA Region 7, the location of a facility on another company's property can establish a control relationship. The existing operations at this Platteville Station were determined to be under common control because the Noble and Kerr-McGee oil polishing trains are located on land owned by Rose Rock. This determination does not apply to the COSF because it will be constructed on land which is not owned by any of the companies operating at the site. The COSF will therefore not be under common control with the Platteville Station. The Spratlin letter provides some additional criteria for overturning or reinforcing a control relationship, but these apply only when common control has already been presumed based on land ownership. Summary The COSF is not a single source with the Platteville Station. Unlike the existing Noble and KMG facilities at the Platteville Station, the relationship between the COSF and Rose Rock does not warrant a determination of common control.
