RE : APPROVAL OF RECORDED EXEMPTION NO. 360 - DAVID DROEGEMUELLER.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 3rd day of January, 1979 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into two
parcels of a certain parcel of land, as shown on the plat known as
Recorded Exemption No. 360 , being the property of David Droegemueller,
described as that portion of Section 10 , Township 5 North, Range
64 West of the 6th P.M. , Weld County, Colorado, being more particu-
larly described as follows :

under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A (3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by David Droegemueller be , and hereby is ,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 3rd day of

RE : Recorded Exemption #360
Dear Commissioners :
The attached application, plat and related items are in reference to a
request for a Recorded Exemption from David Droegemueller. The parcel
of land under consideration is described as Pt . Section 10 , T4N, R65W
of the 6th P .M. , Weld County, Colorado. This property is located 1 mile
northeast of the town of Kersey. This property contains approximately
128. 44 acres of Class II , III , IV, and VII irrigated soils . The request
is to split the property into parcels of 127 .44 acres and 1 . 0 acres .
As indicated in a letter dated November 28 , 1978 , it is the applicant ' s
desire to sell the 1 . 0 acre parcel with improvements . The applicant has
stated that the improvements on the 1 . 0 acre site are a liability to the
agricultural operation due to problems with maintenance, etc. The ap-
plicant will continue to farm the balance of the property. There are
currently two residences and outbuildings located on the 127.44 acre
parcel .
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services staff recommends the request
be approved for the following reasons :
1 . The proposed split conforms with Section 9-2 of the Weld County Sub-
division Regulations (intent clause of the recorded exemption pro-
cedure) , Section 3 . 3 A. of the Weld County Zoning Resolution (intent
clause of the Agricultural Zoned District ) , and the Weld County
Comprehensive Plan in that each parcel does have an existing set of
improvements . The use will be compatible with surrounding agricul-
tural uses . The request will allow agricultural and related uses
to be the predominant land use . There will be no reduction in the
amount of land currently being used for agricultural production .

to this request .
3. This request complies with the provisions of Section 9-4 (A) of

Gentlemen:
I am requesting the attached recorded exemption because the improvements
are no longer necessary for the farm and at this time they are a liability,
e.i. upkeep on the buildings, additional taxes, etc.
There is a complete set of improvements remaining with the farm including
a home, barns, sheds, corrals, etc. There is completely separate water
and sewer facilities for each set of improvements. The well on the portion
I wish to divide off furnishes that set of improvements only. The septic
system which was new in 1971 also is for that set of improvements only.
Allowing this recorded exemption will in no way harm the productivity of
the farm and will not be detrimental in any way.

The Recorded Exemption requested by David Droegemueller has
been reviewed by Environmental Health staff, and no apparent
conflict with health regulations was indicated. However, there
