Conway - EXCUSED Commissioner Mike Freeman Commissioner William F. Garcia Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Diana Aungst Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated June 11, 2014, and duly published June 16, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Anadarko E&P Company, LP, c/o Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0013, for Mineral Resource Development Facilities, including Oil and Gas Support and Service Facilities (compressor station for natural gas and all related equipment, including, but not limited to, eight (8) compressors, vapor recovery units, separators, dehydrators, storage tanks, and one (1) seventy-foot in height communication tower) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. El Chair Rademacher advised Nathan Kaiser, Anadarko Petroleum, that, since Commissioner Conway was not able to be present, he had the option of continuing this matter to a date with the full Board present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Conway will listen to the record and make the determining vote. Mr. Kaiser indicated they would like to proceed. le Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Sign and Lighting Plans have been submitted, and the Planning Commission Ci CA 63`/)1�L 1DR)vW be) I{L(LI-) 2014-2130 PL2277 HEARING CERTIFICATION - ANADARKO E&P COMPANY, LP, CIO KERR-MCGEE GATHERING, LLC (USR14-0013) PAGE 2 added a Condition of Approval for a Landscaping and Screening Plan, based on testimony from surrounding property owners regarding visual impact. She described the plan that was submitted, reviewed surrounding land uses, and stated the applicant held a June 18, 2014, neighborhood meeting at the Platteville Community Center. Ms. Aungst showed images of the site, the site plans and vicinity map. El Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and requirements. One employee will visit the site daily, with 30-40 people at the site during construction. There will be a water quality feature and they will be required to pull a grading permit. County Roads 34 and 19 are collector roads. ID Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions. An Air emissions permit is required and that has been approved via the state, there will be a Spill Prevention Control and Counter Measure Plan, and they will mitigate noise with standard measures and meet EPA emissions requirements. Mr. Kaiser began by showing a vicinity map indicating how this station fits in with their other facilities. He talked about the neighborhood meeting for three compressor stations at one time, and said they provided notice to residents within 1,000 feet. The concerns brought up were in regard to noise, visual impacts, and safety. He explained the Colorado Oil and Gas Conservation Commission regulated guidelines and how the facility will operate under those limits, and the purpose of the communications tower, noting they will allow co-location. He stated the landscaping plan was already in the works before the Planning Commission hearing. In response to Chair Rademacher, he said it is more about landscaping than screening, but there will be a chain link security fence, sans razor wire. He presented views from the surrounding properties and images of the proposed landscaping. Richard Hergert, surrounding property owner to the east, said they worked with Anadarko and met with the Planning Commission because they don't want it to look institutional/industrial. Anadarko was accommodating, but he requested the Board to develop compression station standards, so that neighbors don't have to attend hearings for every one that is built in the area. He noted that the corn is not always as high as in the pictures, obscuring the station. He said they appreciate Anadarko's effort to work with them and to remove the razor wire. El Chair Rademacher stated he would prefer indigenous trees be used for the screening. Commissioner Kirkmeyer noted a reference under the 5th "Whereas" paragraph, #2.A.2, to a Noise Abatement Plan included with the application materials. Mr. Kaiser said noise abatement is built into their compressor's mechanical components that enable operation at the required decibels. Commissioner Kirkmeyer noted that she hears frequent noise complaints about the compressor facility near her house, and suggested a new Condition of Approval #2.A.4 to read, "The approved Noise Abatement Plan, as shown on the plat," and #5, to read, "The approved Landscaping and Screening Plan, as shown on the plat." Mr. Kaiser said the compressor station at CRs 2 and 21 is a better example of how this facility will be designed and stated the landscaping won't commence until next spring. 2014-2130 PL2277 HEARING CERTIFICATION - ANADARKO E&P COMPANY, LP, CIO KERR-MCGEE GATHERING, LLC (USR14-0013) PAGE 3 Commissioner Kirkmeyer said there was a reference to a Noise Abatement Plan, which she doesn't see in the Conditions of Approval or Development Standards. Ms. Aungst said the applicant has indicated they will remain in compliance with the required decibel limits. Mr. Kaiser said there is a Noise Abatement Plan, and it is an addendum. Commissioner Kirkmeyer indicated concerns regarding noise and urged the applicants to stay in compliance. She suggested under a new Condition of Approval #2.A.4 to read, "The approved Noise Abatement Plan, as shown on the plat," and also a new Development Standard #7, to read "The noise limits on the site shall be maintained in accordance with the approved Noise Abatement Plan". She also suggested Condition of Approval #1.A be deleted and a new Condition of Approval #2.A.5, to read: "The approved Landscape and Screening Plan, as shown on the plat," and a new Development Standard #5 to state, "the landscaping and screening on the site shall be maintained in accordance with the approved Landscaping and Screening Plan". Mr. Kaiser noted the landscaping will commence next spring. In regard to Development Standard #16, Ms. Aungst confirmed this could be deleted due to the addition of the Noise Abatement Plan, and since this pertains to statutes. In response to Commissioner Kirkmeyer, Mr. Kaiser confirmed the emergency number will be located at the entrance and is so indicated on the Sign Plan. Commissioner Kirkmeyer noted that an Emergency Action Plan needs to be in place and reviewed annually with the Office of Emergency Management and the local Fire District. Mr. Kaiser said they usually develop that shortly after operations commence. Lastly, in Condition of Approval #7, reword this so it says "Within six months of operation." The aforementioned changes were made by assent of the Board. El In response to Chair Rademacher, Mr. Kaiser, Anadarko E&P Company, LP, indicated they have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. e Commissioner Garcia moved to approve the request of Anadarko E&P Company, LP, c/o Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0013, for Mineral Resource Development Facilities, including Oil and Gas Support and Service Facilities (compressor station for natural gas and all related equipment, including, but not limited to, eight (8) compressors, vapor recovery units, separators, dehydrators, storage tanks, and one (1) seventy-foot in height communication tower) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record.
