HomeMy WebLinkAbout20142273.tiff RESOLUTION RE: ACTION OF BOARD AT INITIAL HEARING CONCERNING RESCINDING USE BY SPECIAL REVIEW PERMIT#1736 - ROBERT COLLINS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on August 25, 2010, the Board approved the application of Jessie Cogburn, 13473 County Road 17, Platteville, Colorado 80651, c/o Robert Collins, 13187 County Road 17, Platteville, Colorado 80651, for a Site Specific Development Plan and Use by Special Review Permit#1736 for a Home Business (Collins Construction and Trucking) in the A (Agricultural) Zone District, on the following described real estate, being more particularly described as follows: Lot A of Recorded Exemption #5021; being part of the SW1/4NE1/4 of Section 29, Township 3 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, the Department of Planning Services notified the current property owner, Robert Collins, of outstanding Conditions of Approval and items to be completed prior to recording the plat, by letters dated July 29, September 27, and November 21, 2011, and WHEREAS, on the 14th day of December, 2011, an Initial Hearing was held before the Board to consider granting additional time to meet all of the conditions/requirements of approval and record the plat, or set a Final Determination Hearing to Rescind approval of Use by Special Review Permit #1736 and Deny the application, at which time the Board deemed it advisable to continue the matter to December 17, 2012, and then to December 16, 2013, and then to January 15, 2014, and then to January 22, 2014, and then to July 28, 2014, and WHEREAS, after hearing all testimony presented, the Board deemed it advisable to dismiss the matter since all outstanding Conditions of Approval have been met. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the applicant has demonstrated completion of the outstanding items and is eligible to record the plat and the matter be, and hereby is, dismissed. December 13, 2013 Staff conducted a Field Investigation to document compliance prior to this hearing. January 15, 2014 The Board of County Commissioners continued the case until January 22, 2014 January 22, 2014 The Board of County Commissioners heard testimony and deemed it advisable to continue the case until July 28, 2014 to all Mr. Collins additional time to meet all of the conditions/requirements of approval and record the USR-1736 map July 7, 2014 Mr. Collins contacted Planning to indicate his progress in completing the construction of the breezeway and provided photographs to so demonstrate. Mr. Collins indicated he had scheduled the Final Inspection on July 8, 2014 July 8, 2014 Mr. Collins received Final Approval for the building addition and 9x10 foot wood frame breezeway. Final approval of the Building, Electric, Mechanical and Plumbing was also granted. Inspector: Jonathon Gesick. July 28, 2014 The USR-1736 map will be submitted for signature by Planning Commission and the Board of County Commissioners. Given the actions taken by Mr. Collins, all conditions of approval have been met prior to recording the USR-1736 map. Therefore the Department of Planning Services recommends that the case be referred back to Planning to coordinate the signatures and recording of the USR-1736 map. December 14, 2013 Board of County Commissioners initial hearing concerning rescinding Use by Special Review Permit#1736 January 8, 2014 Staff received correspondence from Mr. Collins by facsimile addressing many of the outstanding conditions of approval. Included in the case file. January 9, 2014 Mr. Collins telephoned the Planning office seeking confirmation of receipt of the items sent by facsimile. Mr. Collins stated all conditions of approval had been addressed, except for completion of the breezeway component attaching the residence to the new recreational room. Mr. Collins inquired if meeting could be continued as he was subpoenaed for a Court Case. January 13, 2014 Mary Evett, Environmental Health stated "the only outstanding EHS condition is the revised waste handling plan. The applicant did not include disposal or recycling of used tires, batteries or other scrap parts from vehicle and equipment maintenance and repairs. All other EHS conditions have been met. January 14, 2014 Staff received an electronic letter dated January 13, 2014 from Ms. Jenna L. Ellis, Esq. in the office of Marinoff&Associates, Attorney's at Law in Westminster, Colorado stating "Robert Collins has been subpoenaed to appear in the Weld County Court, located at: 915 10th Street Greeley, CO 80631. He will need to be present for the following dates: January 13th through the 16`". If there are any questions please call this office at 303- 280-8166. We thank you in advance." January 14, 2014 Staff contacted the office of Marinoff&Associates requesting the Court Docket Number for the case. Docket Number is 12CR1677, Mr. Collins is providing testimony in Division 12 as the Defendant in this proceeding. January 14, 2014 Staff conducted a Field Investigation to document compliance prior to this hearing. Photographs are attached as Power point presentation in File. January 15, 2014 Current status of outstanding Conditions of Approval Mr. Collins indicates in his letter dated January 7, 2014 that all of the outstanding Conditions of Approval have been met with the exception of the Final Approval for the Breezeway connecting the existing residence to a mobile home to be utilized as a recreational room, and per Ms. Evett's email, a revised waste handling plan for the disposal or recycling of used tires, batteries or other scrap parts from vehicle and equipment maintenance and repairs remain outstanding. 1. The plat shall be amended to delineate the following: A. The plat shall be prepared in accordance with Section 23-2-260.D of the Weld County Code. County Road 17 is classified by the County as a local gravel road, which requires a 60 foot right-of-way at full build out.The applicant shall verify the existing right-of-way and the documents creating the right-of-way. If the right-of-way cannot be verified, it shall be dedicated. The plat shall delineate the existing right-of-way and the documents which created it. The applicant shall provide evidence that Recorded Exemption, RE-5021, has been submitted for recording, thereby creating a separate legal parcel. Plat recorded 8.25.2010 per Reception No. 3713895. 3. The applicant shall complete required construction and obtain a Certificate of Occupancy, Building Permit (BCR10-00042) for the addition to the existing dwelling built in 1890 to attach a 9 x 12 foot wood frame breezeway to a 14 x 66 foot 1975 Champion block and tied mobile home for use as a recreational room. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. (Weld County Department of Planning Services) Building Inspection granted a 180 day Extension to Building Permit BCR10-00042 with a new expiration date of July 29, 2014. This is the single item required prior to recording the USR-1736 Plat 4. The applicant shall complete required construction and obtain a Certificate of Occupancy, Building Permit(BCR07-01472)for the agricultural exempt pole barn. Should the pole barn be utilized for storage of commercial materials and equipment a change of use building permit will be required. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. The applicant shall address the concerns expressed by the Department of Public Health and Environment, specific to their referral dated April 26, 2010. The applicant shall submit a dust abatement plan, detailing on site dust control measures, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. The applicant must receive a final inspection and approval from the Environmental Health Services for septic permit number SP-1000094. Condition Met per email of 9.27.2011 C. In the event washing of vehicles will occur on site the applicant shall ensure that any vehicle washing area(s) shall capture all effluent and prevent discharges from the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. The applicant shall submit evidence of an Aboveground Storage Tank permit from the Colorado Department of Labor and Employment (CDL&E), Oil Inspection Section for any aboveground storage tanks located on the site. Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection Section that they are not subject to these requirements. Condition Met per Electronic Mail from M. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be provided to Environmental Health Services Division of the Weld County Department of Public Health & Environment. In accordance with Section 3-6-1 of the Colorado Department of Labor and Employment Division of Oil and Public Safety Storage Tank Regulations (7 C.C.R. 1101-14) as well as EPA regulations (40 CFR Part 112). The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The applicant has addressed Condition of Approval No. 5.6 only, with all other Conditions of Approval outstanding. 1. The plat shall be amended to delineate the following: A. The applicant shall submit evidence of an Aboveground Storage Tank permit from the Colorado Department of Labor and Employment (CDL&E), Oil Inspection Section for any aboveground storage tanks located on the site. Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection Section that they are not subject to these requirements. E. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be provided to Environmental Health Services Division of the Weld County Department of Public Health & Environment. In accordance with Section 3-6-1 of the Colorado Department of Labor and Employment Division of Oil and Public Safety Storage Tank Regulations (7 C.C R 1101-14) as well as EPA regulations (40 CFR Part 112). F. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). G. Any aboveground storage tanks and 55 gallon drums not recorded on the plat must be removed and properly disposed. 6. The applicant shall address the concerns expressed by the Department of Public Works specific to their referral dated February 24, 2010.
