HomeMy WebLinkAbout20143746.tiff HEARING CERTIFICATION DOCKET NO. 2014-98 RE: CHANGE OF ZONE, PUDZ14-0003, FOR A MINOR AMENDMENT TO PZ-1079 TO REMOVE BUILDING ENVELOPES ON LOTS 1-5 OF MEADOWS ESTATES PUD CHANGE OF ZONE PLAT (BEING PROCESSED IN CONJUNCTION WITH PUDF14-0014)-SCHRAGE LIVING TRUST AND LORI AND COLIN LEGGE A public hearing was conducted on December 10, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Chris Gathman Public Works representative, Wayne Howard Health Department representative, Lauren Light The following business was transacted: F I hereby certify that pursuant to a notice dated November 14, 2014, and duly published November 19, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Schrage Living Trust and Lori and Colin Legge, for a Change of Zone, PUDZ14-0003, for a Minor Amendment to PZ-1079 to remove building envelopes on Lots 1-5 of Meadows Estates PUD Change of Zone Plat (being processed in conjunction with PUDF14-0014). Brad Yatabe, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He stated the development was originally approved in 2008, and the applicant is now requesting to remove the building envelopes. Upon review, Mr. Gathman stated he found no requirement that they be shown and no other changes are being proposed at this time. If removed, future construction on Lots 1-5 would adhere to requirements and setbacks of the E (Estate) Zone District. ID In response to Commissioner Kirkmeyer, Mr. Gathman stated the building envelopes were included on the Change of Zone plat map as part of the application; however, it is unclear as to why the building envelopes were included. He noted he was not the original planner, the official record has no documentation of a specific requirement, and there was no discussion reflected in the minutes of the hearing. e Wayne Howard, Department of Public Works, provided a brief overview of the transportation plans and requirements. He requested the access be shown on the plat as well as the documents creating the internal roadway system (Conditions #1.A.4 and #1.A.5). 2014-3746 CC: C, 'PL, ➢W, }4., 11/2.9 PL1979 HEARING CERTIFICATION - SCHRAGE LIVING TRUST AND LORI AND COLIN LEGGE (PUDZ14-0003) PAGE 2 El Lauren Light, Department of Public Health and Environment, indicated water will be provided by the Little Thompson Water District and sewage disposal will be by septic systems. She stated she has no issues with removing the building envelopes since there are septic envelopes in place. El Dennis Messner represented the applicant and stated the original planning consultant is deceased, the original engineer has retired, and he has no further historical background as to why building envelopes were shown. He stated they currently conflict with some of the documents of the Homeowners' Association and the applicant is requesting that they be removed and the building setbacks be in accordance with the underlying zoning. El No public testimony was offered concerning this matter. In response to Chair Rademacher, Mr. Messner indicated he and the applicants have reviewed, and agree to abide by, the Conditions of Approval, as presented (delete Condition of Approval#1.A.3 as a duplicate of Condition #1.8.9 concerning recognition of the Right to Farm Statement). ID Commissioner Kirkmeyer moved to approve the request of Schrage Living Trust and Lori and Colin Legge for a Change of Zone, PUDZ14-0003, for a Minor Amendment to PZ-1079 to remove building envelopes on Lots 1-5 of Meadows Estates PUD Change of Zone Plat (being processed in conjunction with PUDF14-0014), based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously. There being no further discussion, the hearing was completed at 10:25 a.m. This Certification was approved on the 15th day of December, 2014.
