RE: AMENDMENT TO RECORDED EXEMPTION NUMBER 307 - ERVIN AND
KATHLEEN FRANK.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, Recorded Exemption No. 307 was approved by the
Board of County Commissioners of Weld County, Colorado on the
5th day of April, 1978 , and said Recorded Exemption contains cer-
tain conditions, and
WHEREAS, the Board of County Commissioners, after having
reviewed Recorded Exemption No. 307 have determined that the re-
striction that all drainage and sewage which are ocurring in the
borrow pit located on the east side of said property and along
County Road 15 be corrected to the satisfaction of the Weld County
Health Department and the Weld County Engineer prior to recording
should be removed.
NOW, THEREFORE BE IT RESOVED by the Board of County Com-
missioners of Weld County, Colorado that the Resolution dated April
5, 1978 concerning the approval of Recorded Exemption No. 307 -
Ervin and Kathleen Frank, be and hereby is, amended to remove the
restriction which required that all drainage and sewage problems
which are ocurring in the borrow pit located on the east of said
property and along County Road 15 be corrected to the satisfaction
of the Weld County Health Department and the Weld County Engineer
prior to recording of Recorded Exemption No. 307.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 24th day of
April, A.D. , 1978.
