The Department of Planning Services has determined through the review,that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:

Dear Mr King,
On December 23, 1997 you applied for recorded exemption 2155. Recorded Exemption 2155
was conditionally approved by planning staff on February 12, 1998. As a criteria of this approval
you were given sixty (60) days to meet the conditions and record the mylar.
To date, we have not been made aware of any attempts to meet these conditions. If you are
having difficulty in satisfying these conditions, or should you wish not to proceed with this
recorded exemption, then the Department of Planning Services will need to be notified in writing
of your decision.
We are well aware of the difficulty in meeting conditions associated with land use cases ,and are
willing to work with all of our clients. I have included a copy of the staff recommendation for your
review, and will be available to answer any questions and concerns you have. If I do not hear
from you in three weeks you will be receiving information concerning the violation hearing
process.

Ms. Dunn —The above captioned RE shows as a condition of approval (1.) that the
applicant designate a building envelope on proposed Lot"B." The applicant has already
commited to a 500 foot buffer around the Fort Lupton Cemetery that severely restricts
any future building on the north end of Lot"B." Further, the applicant does not wish to
unreasonably dictate where a future owner may wish to build a home. In order to
accommodate the request of the Department of Planning Services requirement, and to
provide for the legitimate concerns of the staff, the applicant proposes the following:
A note on the plat which states (to the effect) that Weld County will issue a building
permit on Lot"B"only if the proposed building site does not exceed 5 acres and which
site shall be located adjacent to either WCR 12 or WCR 29.
This proposal keeps improvements in close proximity to the county road thereby
preserving as much productive agricultural land as possible and simplifying the issue of
access from a county road.
Please contact me as soon as possible regarding this proposal so that the plat may be
completed in a timely manner.

Dear Mr. King:
On March 3, 1998, an evaluation of the existing individual septic disposal system at 4707 Weld
County Road 29, Fort Lupton, Colorado; Section 08, Township 01 North, Range 66 West, was
conducted by Stephen J. Wiatrowski.
The existing individual sewage disposal system is of sufficient size and capacity to adequately
handle the proposed load. This evaluation is based on a final treatment capacity for
a 2 bedroom residence.
Be advised, neither the County of Weld nor any of its agents or employees undertake or assume
any liability to the owner of the above property, to any purchaser of the above property or to any
lending agency making a loan on the above property or in the report.
This inspection was conducted for the purpose of determining compliance with current regulations
and for detecting health hazards observable at the time of inspection. This does not constitute a
warranty that the system is without flaw or that it will continue to function in the future. Inspections
requested during periods of snow cover and high soil saturation may be of questionable value to
potential buyers due to adverse conditions. Evaluations based on Statements of Existing (S.O.E.)
relies on information the property owner provides, under oath, indicating current status of the
system and representing to the best of his/her knowledge the system is not failing to function
properly.

RECORDED EXEMPTION QUESTIONAIRE
1. Water Supply Statement:
a. Domestic Use: Proposed Lot "A" is served by an existing domestic well
registered as no. 36032. Proposed Lot "B" has no existing domestic water
supply, but the parcel is of sufficient size that a well permit should be
obtainable for future use. The applicant proposes that as a condition of
approval the placement of a note on the final plat that states no build ng
permits will be issued on Lot "B" without an adequate domestic water
supply.
b. Irrigation: Proposed Lot "B" is mostly irrigated farmland with irrigation
waters derived from 30 ' shares of capital stock in the Fulton Irrigating
Company. These waters provide an adequate supply to irrigate any crops
adapted to the area. The applicant intends to dedicate one share of t
Fulton Irrigating Company for use to maintain the irrigation needs o
proposed Lot "A."
2. Statement regarding sewage disposal/septic: The dwelling on proposed
Lot "A" is served by an existing septic system. It does not appear that the
septic is currently permitted by the Weld County Health Department. The
applicant intends to submit a Statement of Existing System to place the
system of record and accommodate an ISDS evaluation.
3. Description of current use of the property: The current use of the property
in total is as an irrigated farm and rural residence. The Northwest corner of
the property borders Hillside Cemetery serving the City of Fort Lupton. Mr.
King sold the land to the Hillside Cemetery prior to August 30, 1972 as shown
in deeds contained in the attached Certificate of Conveyances.
4. Reason for the Recorded Exemption and proposed use of the property:
The applicants seek approval of a Recorded Exemption in order to have
separate, legal parcels for purposes of estate planning. As a part of an
overall estate plan, Mr. King is forming a family Limited Liability Company and
intends to deed the larger Lot "B" as a farm to the LLC while retaining
personal ownership of the smaller Lot "A" residential parcel.
5. Description of location, size, use of new lots:The property is described as
the E ' of the NE % of Section 8, Township 1 North, Range 66 West of the
6th P.M., less approximately 7 acres out for the Hillside Cemetery in the
Northwest corner. The property is located at the Southwest corner of the
intersection of WCR 12 and WCR 29. It is ' mile South and % mile East of
the City of Fort Lupton. Proposed Lot "A will be 6.7 acres +1- and will be used
as a rural residential parcel. It contains the existing improvements of a
dwelling, barn, loafing shed, corrals, and misc. outbuildings. The proposed
use of Lot "B" is for production agriculture and a potential future building site.
6. Statement regarding unique physical properties: There are no unique
physical properties of the parcel that affect the consideration of a Recorded
Exemption.
7. Statement regarding structure setback requirements:All structures
currently meet or will meet all setback requirements.

need to establish a conservation easement at this time and has no plan to do

9. Statement regarding building envelope:There are no current plans to build
on Lot "B". In order to provide an adequate buffer zone to accommodate the
uses of the Hillside Cemetery, the applicant proposes a note on the plat
requiring a 500 foot setback from the boundary of the Hillside Cemetery withi
which no building shall be allowed.
10.Statement of consistency with Weld County Comprehensive Plan:This
application is consistent with the provisions of the Weld County
Comprehensive Plan. Particular attention has been given to preservation of
prime agricultural lands wherever possible as well as consideration for
compatibility with existing surrounding uses.
11.Statement of compatibility with surrounding land uses: The proposed
uses of production agriculture and rural residence are consistent with the
similar uses of all surrounding properties. The proposed land use change will
not affect the use or operation of the Hillside Cemetery. The aforementioned
proposed 500 foot setback will provide a buffer from potential development
nearby the cemetery.
12.Statement of consistency with intent of the zoning district:All proposed
and current uses are consistent with the intent and allowed uses in the A—
Agricultural zoning district.
13.Statement of consistency with efficient and orderly development
a. assist orderly and efficient development This proposal assists in
orderly and efficient development by preserving agricultural lands, utilizing
existing accesses, and maintaining consistency of use with surrounding
properties.
b. health, safety, and welfare: The proposed creation of an additional lot
should have minimal effect regarding health, safety, and welfare in that
provisions are available for adequate water and septic. No new road
accesses are proposed. Impact to sheriffs patrols and fire protection is
minimal. The property is located in the Fort Lupton Fire Protection District.
c. conformation with municipal or county plans: To the best knowledge
of the applicant, this proposal should be consistent with existing county or
municipal plans. The property is located within 1 mile of the City of Fort
Lupton. The proposed change should not adversely impact the urban
growth plan of the City of Fort Lupton, or the existing uses of the Hillside
Cemetery.
d. preservation of agricultural land:All attempts have been made to
preserve as much prime irrigated agricultural land as possible.
a retention of irrigation water: No irrigation waters are impacted or
restricted by the application. No intent is evident to remove irrigation
waters or to remove lands from irrigation.
f. preserve natural vegetation & control erosion:This application makes
no changes that would contribute to an increase in erosion hazards.
There is adequate natural vegetation in place on Lot "A" to control erosion

and an adequate supply of water to support the existing vegetation. The
applicant proposed to dedicate 1 share of the Fulton Ditch to Lot "A" for
irrigation purposes. Current and anticipated farming practices and water
supply on Lot "B" should also adequately control erosion.
g. Accesses: No new accesses are proposed. Proposed Lot "A" is served
by two existing accesses, a driveway on the south which is used primarily
as residential access, and a driveway on the north which is used to access
the barn and corral area as well as access to the northern farm field. The
applicant requests that both accesses be allowed. Since the balance of
the parcel is perimeter fenced, the north driveway access is needed for
agricultural access to what will be Lot "B." There will be designated
easement across Lot "A" to Lot "B" for non-exclusive use for agricultural
purposes. There is an agricultural access at the southeast corner of Lot
"B" that serves the south end of the parcel.

1. A Weld County Septic Permit is required for the proposed home septic system and shall be
installed according to the Weld County Individual Sewage Disposal Regulations.
2. The Environmental Protection Services Division of the Weld County Health Department was
unable to locate a septic permit for the septic system located at 4707 WCR 29, on the smaller
parcel of this application. Any existing septic system(s) which is not currently permitted
through the Weld County Health Department will require an I.S.D.S. Evaluation prior to the
issuance of the required septic permit(s). In the event the system(s) is found to be inadequate,
the system(s) must be brought into compliance with current I.S.D.S. regulations.
