RE: DENIAL OF LOT SIZE VARIANCE NO. 89 - MR. BUD CLEMONS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 28th day of March, 1979 , in the
Chambers of the Board of County Commissioners of Weld County,
Colorado that a certain parcel of land is owned by Mr. Bud
Clemons, which land is more particularly described as follows,
to-wit:
A part of the Northeast Quarter of Section Three,
Township Five North, Range Sixty-four West of the
Sixth P.M. , Weld County, Colorado; excepting parcels
previously conveyed by deeds recorded in Book 657,
Reception No. 1579090; and Book 660, Reception No.
1581500; and together with 8-3/4 shares of the
capital stock of The New Cache LaPoudre Irrigating
Company; 10.9 shares of the capital stock of The
Cache LaPoudre Reservoir Company; 10 shares of the
capital stock of The North Side Lateral Company;
20 shares of the capital stock of the Blaine
Lateral Ccrlpany; and 2 preferred water rights
from Fossil Creek Reservoir, evidenced by original
contract numbers 47 and 48.
WHEREAS, the owners of said tract of land desire to obtain
a variance from the minimum lot size requirement so that Mr.
Bud Clemons may make application to the Board of County Commis-
sioners to apply for a recorded exemption, as set forth in Section
9-4.A. (6) of the Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, based upon the recommendations of the Department of
Planning Services, feels that the applicant has not shown good
cause fcr granting a lot size variance under Section 9-4 .A. (6)
of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that a variance from lot
size requirements be, and hereby is, denied to Mr. Bud Clemons
for the abovedescribed parcel of land.

RE: Lot Size Variance #89
Dear Commissioners :
The attached letter and related materials are in reference to a
request for a lot size variance by Mr. Bud Clemons . The parcel of
land is described as Pt. NE% Section 3, T5N, R64W of the 6th P.M. ,
Weld County, Colorado. This property is located one mile southeast
of Gill. The property contains approximately 15 acres of Class II
irrigated soils . The request is to obtain a variance from the mini-
mun lot size requirement, Section 9-4 A. (6) , so that they may make
application for a recorded exemption.
If this lot size variance is granted, Mr. Clemons will proceed with
an application for a recorded exemption to divide the property into
two parcels of approximately 5 acres and 10 acres . Mr . Clemons
desires to sell both parcels as residential sites to finance a
drainage operation on the entire northeast quarter. A letter from
Mr. Howard Sloan of the West Greeley District of the Soil Conserva-
tion Service dated February 1, 1979, describes the drainage proposal
in more detail .
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends this
request be denied for the following reasons :
1. The proposal requests do not comply with the Weld County Compre-
hensive Plan in that it would promote non-agricultural use of
agricultural land and it would encourage urban encroachment on
rural land use.

2. These requests are not in conformance with the intent clause of
the Agricultural Zone District (Section 3 . 3 A. of the Weld County
Zoning Resolution) which states :
"Intent - The intent in establishing the A-Agricultural
Zone District is to allow all agricultural related uses
in those areas in which agriculture is and should con-
tinue to be the predominant land use. This district is
intended to discourage encroachment of incompatible uses
upon the agricultural land in a district, to encourage
agricultural uses as the highest and best use of the
land in the district as compared with other uses in con-
flict therewith, and to provide for the orderly expansion
of urban growth in conformance with the Weld County Com-
prehensive Plan."
These requests would not be encouraging agricultural uses as the
highest and best uses , it would not be providing for the orderly
expansion of urban growth, and it would be promoting the division
of agricultural land into smaller, less economic parcel sizes .
3. These requests afire not in compliance with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County Sub-
division Regulations) . Said clause states :
"The intent in establishing the recorded exemption pro-
cedure is to provide, in accordance with the Weld County
Comprehensive Plan, a means whereby non-productive agri-
cultural lands may be developed for higher and more
productive uses insofar as such uses are compatible with
surrounding agricultural uses in areas where such land
divisions are proposed. (Revised 4-17-74) . "
The 15 acre parcel is productive agricultural land. The parcel has
Class II irrigated soils which is considered prime agricultural
land. By using the parcels for residential purposes , the land
would essentially be removed from agricultural production.
The Department of Planning Services Staff recognizes that Mr. Clemons
does have an existing lot with a potential building site and that he
also has a drainage problem which requires the generation of capital
to finance the corrective measures . However, the Department of Plan-
ning Services Staff feels that an increased burden will be placed on
the County by further subdividing the parcel and thereby increasing
services required by residential development.

Dear Mr. Honn:
This letter is my request for obtaining a lot size
variance on the above captioned property .
I have had numerous inquiries regarding the possibility
of selling 4, 5, or 6 acres off of the farm for a resi-
dential building site.
Before I acquired the property in 1975, there was a 15
acre tract that was a recorded exemption. I now desire
to divide this parcel into one 5 acre tract and one 10
acre tract. A 15 acre tract is not large enough to be
an economical farming unit, but it is too large for a
rural residential building site. I have not had anyone
inquire about buying a 15 to 20 acre, or larger, site.
Most people feel that they can properly care for and
adequately maintain a smaller parcel. As I mentioned
above, a 15 acre tract is not economical to farm by
itself and the actual productivity for both a 5 acre
tract and a 10 acre tract will be equal to or, perhaps,
greater than the 15 acre tract as people will be better
able to maintain the productivity.
There is an apparent need for rural homesites in the
area. This is evidenced by the fact that four or five
new homes have been built in the area during the past
few years as well as several older farm buildings, that
were separated from the main farm, have been remodeled
recently.
Please find attached a letter from the Weld County Soil
Conservation Service which indicates that there is a high
water table on this farm (seep) and, consequently, it is
not as productive as it would otherwise be or as produc-
tive as some of the neighboring farms are. Therefore,
if the entire 15 acres were totally lost from production,
it would not measurably affect the overall productivity
of this farm.

The soil conservation people did a detailed, in depth study
of this farm property and estimate yields would increase
50% - 75% if properly drained. The approximate cost was
$24,000.00 in 1977; however, I 'm sure this estimate has
increased substantially since then. My intentions are to
sell the parcels of land in question in order to obtain
funds for financing the drainage project. Also, you will
find a letter from Mr. Kenneth Colwell stating his original
abstract examination called for four separate deeds. It
was strictly a matter of convenience that the transfer was
accomplished in one deed rather than the four which were
called for; therefore, I am maintaining that the property
has one building permit for each of the two recorded exemp-
tions, one for the forty acre tract in the SENE, and one
for the remaining 65 acres located in the WNE3/4 for a total
of four permits. By allowing the proposed land split, you
would merely be returning the additional one building
permit that I feel the property is entitled to.
Also please find enclosed a plat of the 5 acre parcel and
the 10 acre parcel along with a letter from North Weld
County Water District stating that domestic water is avail-
able to the site.
A county road runs along the east side of the property and
no additional county services will be required.

Dear Mr. Honn :
Mr. Bud Clemons has consulted me concerning the above
described Weld County realty . Apparently , Mr. Clemons feels
he is entitled to at least 4 building permits , to-wit :
1 for recorded exemption #0963-3-1 -RE72 ; 1 for the 15 acre
tract located near the NE4 of said property; 1 for the 40 acre
tract located in the SE4 of said property; and 1 for the
remaining 65 acres located in the W% of the above property.
Apparently some problem has arisen since Mr. Clemons
acquired title from a Mr. James H . Tull in one deed describing
all of the above property in one description . The reason that
this method of transfer of the title was used is that Mr. Tull
acquired title to 3 parcels included in the above description
from 3 other owners prior to closing . My abstract examination
indicates that at time of closing 3 deeds would be required from
Robert L . Anderson , James R. Geist and Marvin L . Liming , the
owners of the parcels in the NE4 in addition to Mr. Tull . At
time of closing , Mr. Tull had prepared a deed for all of the .NE4
to Mr. Clemons , excepting 2 parcels with which we are not
concerned , containing 5 acres and 15 acres respectively . At
the closing , Mr. Tull presented conveyances from Mr. Anderson ,
Mr. Geist and Mr. Liming to himself , and therefore , Mr . Clemons
was assured of a good and marketable title upon the recording of
the 4 deeds .
In addition , your office should probably be advised that the
County Assessor is assessing the 4 parcels individually to
Mr . Clemons .

In regards to your telephone call, the soil in the EZNE' of Section 3,
Twp. 5N, Range 64W is classified as Kim loam, 1 to 3 percent slopes.
There is a high water table on some of the land in the general ar
ea
you requested. The drainage survey we made last year shows that the
water table impedes the growth of crops.
This information is general for the area and does not replace an on-
site investigation for specific problems.
I am enclosing a copy of a soils map for the area and the description
for Kim loam.
If there is a need for any further information, please feel free to
contact this office.

In regards to your telephone call, this farm is approximately 140
acres in the NE4 of Sec. 3 Township 5 North and Range 64 West or 6
miles east of the Greeley Airport.
Certain fields or portions of fields on this farm has a high water
table problem during the irrigation season that impedes the growth
of crops.
Installing subsurface drain tubing at certain locations on the farm
will lower water table and increase production on these seepy areas
50%-75%.
A drainage investigation has been made of this farm by SCS in February
1977. This included a design survey, soil logs (drilling holes on a
200' grid to find type of soils and depth to water) and a design
showing proposed locations of subsurface drains and length and sizes
of drain tubing needed. From this information on file at the Greeley
field office, SCS or others can determine approximate costs.
In field #1 cost would be approximately $12,000.00 and field #2 cost
would be approximately $12,000.00. The total for both jobs would
be about $24,000.00.
