RE: APPROVE VACATION OF RECORDED EXEMPTION, RE-4612 - NGL WATER
SOLUTIONS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on March 26, 2007, the Department of Planning Services administratively
approved Recorded Exemption #4612, creating parcels of 45.5 acres and 34.5 acres, more or
less, and
WHEREAS, said property is located in part of the S1/2 of the SE1/4 of Section 30,
Township 3 North, Range 65 West of the 6th P.M., Weld County, Colorado, being more
particularly described as Lots A and B of Recorded Exemption, RE-4612, and
WHEREAS, the Department of Planning Services staff, as a Condition of Approval of
Minor Amendment (MUSR11-0004) to Use by Special Review Permit (USR-1604), required the
vacation of Recorded Exemption, RE-4612, and
WHEREAS, the Board has received a request from NGL Water Solutions (formerly known
as High Sierra Water Services, LLC), c/o M3 Construction, LLC, 2861 West 120th Avenue,
Suite 250, Westminster, Colorado 80021, to vacate said Recorded Exemption, RE-4612, which
was recorded on March 12, 2008, at Reception #3541173, in the records of the Weld County
Clerk and Recorder, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Recorded Exemption, RE-4612, be, and hereby is, vacated.

SUBJECT: Request to vacate Recorded Exemption No. RE-4612
located in the South one-half of the Southeast one-quarter of
Section 30, Township 3 North, Range 65 West of the 6th
P.M., Weld County Colorado
On March 12, 2008 Recorded Exemption No. 1213-30-4 RE-4612 was recorded via Reception
number 3541173 creating two parcels of land, (Lot A) being 32.89 acres and (Lot B) being 44.49
acres, more or less.
NGL Water Solutions, being current property owners of land described as Lot A and Lot B of
Recorded Exemption number RE-4612 are requesting that this Recorded Exemption be vacated
such that the current Salt Water Disposal and Water Recycle Facility located on Lot A, permitted
under MUSR11-0004 formerly permitted as USR1604 be able to expand their current operations
to include additional oil field services.
The planning staff requests that the Board of County Commissioners accept this request and
vacate RE-4612.

Dear Kim,
As the authorized representative for NGL(formerly known as High Sierra Water Services, LLC), I
am hereby requesting the vacation of the Recorded Exemption No. 1213-30-4 RE-4612 for the
property referred to as the NGL C6 facility.
This request is being made for the purposes of the expansion of the C6 facility operations to
include a solids processing facility.This vacation would allow my client to merge both properties
owned by NGL to allow for full site access for their operations as well as reasonable calculations
of site drainage as a result of the addition of the new solids processing facility.
