RESOLUTION WHEREAS, it has been determined by the Board of County Commis- sioners, Weld County, Colorado, that a certain tract of land, being the property of Clarence A. Scott and Nadine R. Scott, husband and wife, of Brighton, Colorado, and more particularly described as follows, to-wit: Part of the East Half (El-) of the Northeast Quarter (NE++-) of Section 17, Township 1 North, Range 65 West of the 6th P. M. , Weld County, Colorado, being more particularly described as follows: Beginning at the Northeast Corner (NE Cor) of said Section 17 and considering the North line of said Section 17, as bearing North 89°53'04" West, with all other bearings contained herein relative thereto; Thence North 89°53'04" West, along the North line of said Section 17, 925. 00 feet; Thence South 00°00'00" West, 1320. 41 feet; Thence South 89°43'07" West, along the North line of the Southeast Quarter (SE+) of the Northeast Quarter (NE4) of said Section 17, 49. 60 feet; Thence South 00°02'09" West, along the West line of the East Three Quarters (E3/4) of the Southeast Quarter (SE+) of the Northeast Quarter (NE++-) of said Section 17, 1320. 75 feet to a point on the South line of the Northeast Quarter (NE ') of said Section 17; Thence North 89°19'21" East, along the South line of the Northeast Quarter (NE++-) of said Section 17, 975. 48 feet to the East Quarter Corner (El Cor) of said Section 17; Thence North 00°00'00" East, along the East line of the Northeast Quarter (NE ') of said Section 17, 2628. 01 feet to the Northeast Corner (NE Cor) of said Section 17, said point being the point of beginning, said described parcel of land containing 57. 458 acres, more or less, does not come within the purview of the definition of the terms "subdivision" and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as amended, and WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, desires to exempt this particular division of land upon the recommendation of the Weld County Zoning Administrator for the reasons as stated and pursuant to its authority under CRS 106-2-33 (d) 1963, as amended, NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de- scribed tract of land owned by Clarence A. Scott and Nadine R. 'Q" t• 1 a ir . of { , c '' -\. !r r 1 r RESOLUTION WHEREAS, it has been determined by the Board of County Commissioners, Weld County, Colorado, that Clarence and Nadine Scott are owners of approximately 59 acres of land in Weld County, Colorado, and described as being the East 925. 00 feet of the North- east Quarter (NE-41',) of the Northeast Quarter (NE ), and the East 3/4 of the Southeast Quarter (SE-k') of the Northeast Quarter (NE-1), all in Section 17, Township 1 North, Range 65 West of the 6th Principal Meridian, in Weld County, Colorado, and WHEREAS, the Scotts are desirous of selling approximately 3 acres of this land and keeping approximately 56 acres unto themselves, and WHEREAS, it appears that to accomplish said sale, the Scotts may apply for a Recorded Exemption from the Subdivision Regu- lations of Weld County, as the same is defined in Section 9-4 of the Weld County Subdivision Regulations, and WHEREAS, in addition to evidence presented by the Scotts, the Weld County Planning Commission staff has presented evidence and made representations concerning the desirability of granting said vari- ance, and WHEREAS, the Board of County Commissioners feels that when all of the evidence and representations are considered, good cause for granting a variance from the minimum lot size requirements of the Weld County Zoning Resolution has been shown. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the powers granted to the County under Chapter 106 CRS 1963 and Section 9-4A(6), Weld County Subdivision regulations as amended; that Clarence and Nadine Scott are granted an exemption as herein above stated from the lot size requirements of the Weld County Zoning Resolution. BE IT FURTHER RESOLVED, that this exemption is allowed so that the Scotts may proceed to apply for a Recorded Exemption and the lot size variance is conditioned on the Scotts applying for and doing all necessary to obtain said Recorded Exemption within 1 year, and said • variance is limited to Clarence and Nadine Scott, and will terminate if they sell or otherwise discontinue their interest in the abovementioned hind prior to obtaining approval for and recording the abovementioned Recorded Exemption.
