Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Tiffane Johnson Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: L I hereby certify that pursuant to a notice dated July 18, 2014, and duly published July 23, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Lundvall Energy Park, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0029, for Mineral Resource Development Facilities, including Oil and Gas Support and Service Facilities (commercial trucking and regional supply yard including equipment storage, shop and employee parking) and Uses similar to the Uses listed in Section 23-3-40 as Uses by Special Review, as long as the Use complies with the general intent of the A (Agricultural) Zone District, including energy industry regional storage yard for equipment related to solar and wind power providers in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Ei Chair Rademacher advised Steve Lundvall, applicant, that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Kirkmeyer will listen to the record and make the determining vote. Mr. Lundvall indicated he would like to proceed today. Cc. &'-+\ 1>-I L(T3'1?1,JLIb&& N'L(pt) q- 2014-2533 PL2297 HEARING CERTIFICATION - LUNDVALL ENERGY PARK, LLC (USR14-0029) PAGE 2 e Tiffane Johnson, Department of Planning Services, presented a brief summary of the proposal and explained the recent property transfer and minor modifications to the application. She displayed a vicinity map and described the improvements made to the property by the previous owner. She stated staff has received no referral responses from the surrounding municipalities, she reviewed the comments submitted by the remaining referral entities, and she gave a brief description of the surrounding land uses. She reviewed the proposed site plan and anticipated operations, and entered the favorable recommendation of the Planning Commission into the record as written. El In response to Chair Rademacher, Ms. Johnson confirmed there is a recorded 30-foot access easement which will be reflected on the plat and the berm does go all the way around the property. Responding to Commissioner Conway, Ms. Johnson clarified the application indicates 20-30 shipments daily during primarily normal business hours, and she deferred to the applicant to explain the night time activities. She also noted the existing improvements will remain. Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and requirements, internal circulation, and access. He noted the applicant will be required to enter into an Improvements Agreement on County Road (CR) 46, with an average daily traffic count of 1,174 taken on June 11, 2014. El Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, dust abatement, and waste handling. She also explained the office has been removed; therefore, Condition of Approval #6 may be removed. Mr. Lundvall stated they have outgrown their current site of 31 years due to increased demand, and he gave a brief overview of their business operations. In response to Chair Rademacher, Mr. Lundvall stated he believes the berms are adequate screening, the interior area has been sprayed for weeds, and the berm weed mitigation and hydro-seeding will take place in the Fall for better growing conditions. Responding to Commissioner Conway, Mr. Lundvall explained they operate one shift from 7:00 a.m. until 5:30 p.m., with occasional work on the weekends and 24/7 operations only happen periodically. No public testimony was offered concerning this matter. In response to Chair Rademacher, Mr. Lundvall indicated he would request placing pipe racks on the site prior to recording the plat. Chair Rademacher indicated agreement but wanted to ensure the Lighting Plan is addressed. Ms. Johnson agreed it is a reasonable request since there will be no structures, as long as drainage is preserved. Responding to Chair Rademacher, Ms. Johnson indicated the Weed Management Plan will consist of the applicant documenting the weed management plan and the timing for mitigation and seeding. IR In response to Chair Rademacher, Mr. Lundvall stated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended, with the provision of early placement of pipe racks. 2014-2533 PL2297 HEARING CERTIFICATION - LUNDVALL ENERGY PARK, LLC (USR14-0029) PAGE 3 L Commissioner Conway moved to approve the request of Lundvall Energy Park, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0029, for Mineral Resource Development Facilities, including Oil and Gas Support and Service Facilities (commercial trucking and regional supply yard including equipment storage, shop and employee parking) and Uses similar to the Uses listed in Section 23-3-40 as Uses by Special Review, as long as the Use complies with the general intent of the A (Agricultural) Zone District, including energy industry regional storage yard for equipment related to solar and wind power providers) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Garcia, and the motion carried unanimously. The Board commended the applicant for a quality application. There being no further discussion, the hearing was completed at 10:40 a.m. This Certification was approved on the 25th day of August, 2014.
