RE: DIRECTING CLERK TO THE BOARD TO HAVE PUBLISHED A NOTICE OF
INTENT TO DESIGNATE THE SITE SELECTION AND CONSTRUCTION OF
THOSE MAJOR FACILITIES OF A PUBLIC UTILITY CONSISTING OF NEW
PIPELINES DESIGNED FOR TRANSMISSION OF WATER AND NATURAL GAS OR
OTHER PETROLEUM DERIVATIVES AS A MATTER OF STATE INTEREST,
PURSUANT TO C.R.S. § 24-65.1-401, AND SETTING OF A PUBLIC HEARING
REGARDING SUCH DESIGNATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the
authority of administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to C.R.S. § 24-65.1-401, the Board of County Commissioners
has the authority to designate those activities listed in C.R.S. § 24-65.1-203 as "matters of
state interest," which may then be subject to guidelines and regulations promulgated by the
Board, pursuant to C.R.S. § 24-65.1-402, and
WHEREAS, the Board desires to conduct a public hearing on January 19, 2015, to
consider the designation of the site selection and construction of those major facilities of a
public utility consisting of new pipelines designed for transmission of water and natural gas or
other petroleum derivatives, and
WHEREAS, pursuant to C.R.S. § 24-65.1-404(2)(a), the Board is required to publish
notice of said public hearing in a newspaper of general circulation in Weld County at least
thirty (30) days and not more than sixty (60) days prior thereto, and
WHEREAS, pursuant to Weld County Code Section 21-1-210(B), the Board desires a
recommendation from the Weld County Planning Commission regarding the proposed
designation prior to the January 19, 2015, designation hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Clerk to the Board be, and hereby is, directed to have
published in the County Newspaper on December 12, 2014, notice that the Board intends to
designate the site selection and construction of those major facilities of a public utility
consisting of new pipelines designed for transmission of water and natural gas or other
petroleum derivatives as a matter of state interest, pursuant to C.R.S. § 24-65.1-401.
BE IT FURTHER RESOLVED by the Board that a public hearing to consider such
designation be, and hereby is, set for January 19, 2015, at 9:00 a.m., in the Centennial
Hearing Room located in the Weld County Administration Building at 1150 O Street, Greeley,
Colorado 80631.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, further directed to include in the notice of intent to designate the above stated information
regarding the date, time and place of said public hearing.

BE IT FURTHER RESOLVED by the Board that the proposed designation be referred
to the Weld County Planning Commission for consideration and a recommendation at the
December 16, 2014, Planning Commission meeting.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 8th day of December, A.D., 2014.
