RESOLUTION
WHEREAS, pursuant to law, the Board of County Commissioners,
Weld County, Colorado, is vested with the responsibility of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has come to the attention of the Board of County Com-
missioners, Weld County, Colorado, that pursuant to Title 23 of the public law
93-643, United States Code, commonly called "Federal-Aid Highway Amendments
of 1974, " certain federal funds have been allocated for the improvement of certain
public highways which are not on any federal-aid or state highway system, such
programs being referred to as the Off-Systems Road Plan Program (OS), and
WHEREAS, Off-Systems Road Plan Program projects are selected by
the County and the eligible municipalities within the County and approved by the
special highway committee of Colorado Counties, Inc. and the Municipal League,
with the concurrence of the State Department of Highways, Division of Highways,
State of Colorado, and
WHEREAS, it has been determined by the Board that there is a need
for certain construction projects within the County and in designated towns within
the County, and
WHEREAS, it has been determined by the Board that the State Depart-
ment of Highways, Division of Highways, State of Colorado, is desirous of enter-
ing into a contract for the completion of said projects utilizing federal highway
administration funds on a prorata basis with County and Town funds on a prorata
basis, and
WHEREAS, certain eligible municipalities within the County desire
to enter into an agreement with the County for the payment of the municipalities
prorata share of the project costs set forth in the contract between the County
and the State Department of Highways, Division of Highways, State of Colorado,
designated as follows by municipality and project number:
1. La Salle Project # OS 9903 (3)
2. Ft. Lupton Project # OS 9903 (4)
3. Platteville Project # OS 9903 (5)
4. Kersey Project # OS 9903 (7)
5. Windsor Project # OS 9903 (8)
6. Frederick Project # OS 9903 (9)
7. Johnstown Project # OS 9903 (10)
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com-
missioners, Weld County, Colorado, that said Agreement by and between the State
Department of Highways, Division of Highways, State of Colorado, and the Board
of County Commissioners, Weld County, Colorado, pertaining to the improvement
of certain public highways which are not on any federal aid or state highway system,
referred to as the Off-Systems Road Plan Program (OS), a copy of which is attached
hereto and made a part hereof by reference, be, and it hereby is approved.
BE IT FURTHER RESOLVED, by the Board of County Commissioners,
Weld County, Colorado, that said Agreement with each individual municipality
herein set forth, providing for the payment of funds by the said municipality to the
County of Weld, State of Colorado, for that municipality's prorata share of the
project costs of those projects designated under the Off-Systems Road Plan Program
(OS), a copy of which is attached hereto and made a part hereof by reference, be,
and it hereby is approved.

BE IT FURTHER RESOLVED, that the Board be, and it hereby is
authorized to execute the contracts as submitted and to make the same effective
forthwith.
The above and foregoing Resolution was, on motion duly made and

A GREEMENT
THIS AGREEMENT is made and entered into this day of
Ape , 1976, by and between the County of Weld, State of Colorado, a
political subdivision, hereinafter referred to as Weld, and the Town of
La Salle , Weld County, Colorado; a political subdivision,
hereinafter referred to as Town, WITNESSETH:
WHEREAS, pursuant to Title 23 of the public law 93-643, United
States Code, commonly called "Federal Aid Highway Amendment of 1974",
certain federal funds have been allocated for the improvement of certain
public highways which are not on any federal aid or state highway system,
such program being hereinafter referred to as the Off-Systems Road Plan
Program (OS); and
WHEREAS, the costs of the selected OS projects will be borne by the
Federal Highway Administration (FHWA) and the County at the rate of seventy-
four percent (74%) and twenty-six percent (26%) respectively; and
WHEREAS, OS projects are selected by the County and the eligible
municipalities within the County and approved by the special highway com-
mittee of Colorado Counties Incorporated and the Colorado Municipal League,
with the concurrence of the State Department of Highways, Division of High
ways, State of Colorado, and the FHWA; and
WHEREAS, the improvements at construction sites selected by the
County and eligible municipalities have been determined to be in the public
interests and are to be constructed with funds allocated for the seventy-five-
seventy-six (75-76) fiscal year; and
WHEREAS, the Town, desirous of having certain improvements con-
structed as follows: Asphalt Paving
and designated as Project # OS 9903(3)
NOW, THEREFORE, in consideration of the mutual covenants set forth
hereinafter and the faithful performance thereof, the County and the Town do

AGREEMENTS ON THE PART OF THE COUNTY
1 . The County agrees to enter into an agreement with the State De-
partment of Highways, Division of Highways, State of Colorado, for the com-
pletion of selected OS projects including Town's' Project# OS 9903(3)
2. The County will remit to the State Department of Highways, Division
of Highways, State of Colorado Town's share of the total costs of the completion
of Project # OS 9903(3)
AGREEMENTS ON THE PART OF THE TOWN
1 . Town agrees that the estimated cost of Project # OS 9903(3)
which shall be Town's responsibility is $17,834 and that upon final
recapitulation of project costs Town may have increased financial respon-
sibility for its share of the project.
2. Town agrees that the County shall submit bills to the Town when
Town's prorata share of the costs of the project are known and Town will
promptly remit to the County the amount billed until Town's full share of the
project cost is paid in full.
This Agreement shall inure to the benefit of and be binding upon the
parties, their successors and assigns.
IN WITNESS WHEREOF, the parties hereto have caused the foregoing

AGREEMENT
THIS AGREEMENT is made and entered into this 9T4 day of

Fort Lupton , Weld County, Colorado; a political subdivision,
hereinafter referred to as Town, WITNESSETH:
WHEREAS, pursuant to Title 23 of the public law 93-643, United
States Code, commonly called "Federal Aid Highway Amendment of 1974",
certain federal funds have been allocated for the improvement of certain
public highways which are not on any federal aid or state highway system,
such program being hereinafter referred to as the Off-Systems Road Plan
Program (OS); and
WHEREAS, the costs of the selected OS projects will be borne by the
Federal Highway Administration (FHWA) and the County at the rate of seventy-
four percent (74%) and twenty-six percent (26%) respectively; and
WHEREAS, OS projects are selected by the County and the eligible

WHEREAS, the Town, desirous of having certain improvements con-
structed as follows: Upgrade, curb and gutter, asphalt between
US 85-4 lane and US Hwy. Business by-pass
and designated as Project # OS 9903(4)
NOW, THEREFORE, in consideration of the mutual covenants set forth
hereinafter and the faithful performance thereof, the County and the Town do
hereby agree as follows:
AGREEMENTS ON THE PART OF THE COUNTY
1 . The County agrees to enter into an agreement with the State De-
partment of Highways, Division of Highways, State of Colorado, for the com-
pletion of selected OS projects including Town's Project# OS 9903(4)
2. The County will remit to the State Department of Highways, Division
of Highways, State of Colorado Town's share of the total costs of the completion
of Project # OS 9903(4)
AGREEMENTS ON THE PART OF THE TOWN
1. Town agrees that the estimated cost of Project # os e9A3 (4)
which shall be Town's responsibility is $5,200 .00 and that upon final
recapitulation of project costs Town may have increased financial respon-
sibility for its share of the project.
2. Town agrees that the County shall submit bills to the Town when
Town's prorata share of the costs of the project are known and Town will
promptly remit to the County the amount billed until Town's full share of the
project cost is paid in full. -
This Agreement shall inure to the benefit of and be binding upon the
parties, their successors and assigns.

2. The County will remit to the State Department of Highways, Division
of Highways, State of Colorado Town's share of the total costs of the completion
of Project OS 9903(7)
AGREEMENTS ON THE PART OF THE TOWN
1 . Town agrees that the estimated cost of Project # OS 9903(7)
which shall be Town's responsibility is $2 ,600 . 00 and that upon final
recapitulation of project costs Town may have increased financial respon-
sibility for its share of the project.
2. Town agrees that the County shall submit bills to the Town when
Town's prorata share of the costs of the project are known and Town will
promptly remit to the County the amount billed until Town's full share of the
project cost is paid in full.
This Agreement shall inure to the benefit of and be binding upon the
parties, their successors and assigns,

2. Town agrees that the County shall submit bills to the Town when
Town's prorata share of the costs of the project are known and Town will
promptly remit to the County the amount billed until Town's full share of the
project cost is paid in full.

1 . Town agrees that the estimated cost of Project # OS 9903(10)
which shall be Town's responsibility is$2769.00 and that upon final
recapitulation of project costs Town may have increased financial respon-
sibility for its share of the project.
2. Town agrees that the County shall submit bills to the Town when
Town's prorata share of the costs of the project are known and Town will
promptly remit to the County the amount billed until Town's full share of the
project cost is paid in full.
This Agreement shall inure to the benefit of and be binding upon the
parties, their successors and assigns.

recapitulation of project costs Town may have increased financial respon-
sibility for its share of the project.
2. Town agrees that the County shall submit bills to the Town when
Town's prorata share of the costs of the project are known and Town will
promptly remit to the County the amount billed until Town's full share of the
project cost is paid in full.
This Agreement shall inure to the benefit of and be binding upon the
parties, their successors and assigns.
