HomeMy WebLinkAbout760539.tiff • RESOLUTION WHEREAS, pursuant to law, the Board of County Commissioners, Weld County, Colorado, is vested with the responsibility of administering the affairs of Weld County, Colorado, and WHEREAS, it has come to the attention of the Board of County Com- missioners, Weld County, Colorado, that pursuant to Title 23 of the public law 93-643, United States Code, commonly called "Federal-Aid Highway Amendments of 1974, " certain federal funds have been allocated for the improvement of certain public highways which are not on any federal-aid or state highway system, such programs being referred to as the Off-Systems Road Plan Program (OS), and WHEREAS, Off-Systems Road Plan Program projects are selected by the County and the eligible municipalities within the County and approved by the special highway committee of Colorado Counties, Inc. and the Municipal League, with the concurrence of the State Department of Highways, Division of Highways, State of Colorado, and WHEREAS, it has been determined by the Board that there is a need for certain construction projects within the County and in designated towns within the County, and WHEREAS, it has been determined by the Board that the State Depart- ment of Highways, Division of Highways, State of Colorado, is desirous of enter- ing into a contract for the completion of said projects utilizing federal highway administration funds on a prorata basis with County and Town funds on a prorata basis, and WHEREAS, certain eligible municipalities within the County desire to enter into an agreement with the County for the payment of the municipalities prorata share of the project costs set forth in the contract between the County and the State Department of Highways, Division of Highways, State of Colorado, designated as follows by municipality and project number: 1. La Salle Project # OS 9903 (3) 2. Ft. Lupton Project # OS 9903 (4) 3. Platteville Project # OS 9903 (5) 4. Kersey Project # OS 9903 (7) 5. Windsor Project # OS 9903 (8) 6. Frederick Project # OS 9903 (9) 7. Johnstown Project # OS 9903 (10) NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com- missioners, Weld County, Colorado, that said Agreement by and between the State Department of Highways, Division of Highways, State of Colorado, and the Board of County Commissioners, Weld County, Colorado, pertaining to the improvement of certain public highways which are not on any federal aid or state highway system, referred to as the Off-Systems Road Plan Program (OS), a copy of which is attached hereto and made a part hereof by reference, be, and it hereby is approved. The County agrees to enter into an agreement with the State De- partment of Highways, Division of Highways, State of Colorado, for the com- pletion of selected OS projects including Town's' Project# OS 9903(3) 2. The County will remit to the State Department of Highways, Division of Highways, State of Colorado Town's share of the total costs of the completion of Project # OS 9903(3) AGREEMENTS ON THE PART OF THE TOWN 1 . Town agrees that the estimated cost of Project # OS 9903(3) which shall be Town's responsibility is $17,834 and that upon final recapitulation of project costs Town may have increased financial respon- sibility for its share of the project. 2. Town agrees that the County shall submit bills to the Town when Town's prorata share of the costs of the project are known and Town will promptly remit to the County the amount billed until Town's full share of the project cost is paid in full. This Agreement shall inure to the benefit of and be binding upon the parties, their successors and assigns.
