RE: APPROVAL OF LOT SIZE VARIANCE NO. 48 - EUGENE ASHBOUGH.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 24th day of October, 1977 , in
the Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain parcel of land is owned by Eugene
Ashbough, which land is more particularly described as follows ,
to-wit: •
All that part of the Northwest Quarter (NW4) of Section
Eleven (11) , Township 5 North, of Range 67 West of the
6th P.M. , County of Weld, State of Colorado, lying South
of U.S. Highway No. #34, and being more particularly described
as follcws: Commencing at the North Quarter corner of said
Section Eleven (11) , and considering the East line of the
Northwest Quarter (NW4) of said Section Eleven (11) , to
bear South 00°00'50" West and with all other bearings con-
tained herein relative thereto: thence South 00°00'50"
West along the East line of the Northwest Quarter (NWq)
of said Section Eleven (11) , 1,922.75 feet to a point on the
Easterly right-of-way line of U.S. Highway No. #34, said
point being the true point of beginning; thence continuing
South 00°00'50" West along the East line of the Northwest
Quarter (NWa) of said Section Eleven (11) , 713.45 fact to
the Southeast Corner of the Northwest Quarter (NWa) of said
Section Eleven (11) ; thence North 89°08'05" West along
the South line of the Northwest Quarter (NW4) of said Section
Eleven (11) , 950.57 feet to a point on the Easterly right-of-
way line of said U.S. Highway No. 34; thence North 53°40'10"
East along said Easterly right-of-way line of U.S. Highway
No. 34, 1,180.02 feet to the true point of beginning.
WHEREAS, the owners of said tract of land desire to obtain
a variance from the minimum lot size requirement so that Mr.
Ashbough may make application to the Board of County Commissioners
to apply for a recorded exemption, as set forth in Section 9-4 .
A. (6) of the Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, based upon the recommendations of the Department of
Planning Services , feels that the applicant has shown good cause
for granting a lot size variance under Section 9-4 .A. (6) of the

Planning Services , feels that the applicant has shown good cause
for granting a lot size variance under Section 9-4 .A. (6) of the

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that a variance from lot
size requirements, be, and hereby is, granted to Eugene Ashbough
for the above-described parcel of land.
The above and foregoing Resolution was , on motion duly made

RE: Lot Size Variance #48
Dear Commissioners:
The attached letter and related materials are in reference to
a request by Eugene Ashbough for a lot size variance. The property
in question is described as Pt . of the N 1 of Section 11, T5N,
R67W of the 6th p.m. , Weld County, Colorado. Said property is
located immediately southwest of the State Highway maintenance yard
on State Highway 34 west of Greeley. The property in question
contains approximately 6 acres of non-irrigated land with Class VI
soils. The request is to obtain a variance from the minimum lot
size requirement , Section 9-4(a)(6) , so that Mr. Ashbough may make
application to apply for a recorded exemption. Section 9-4(a) (6)
states, "That the original tract or parcel of land to be divided
under this section meets the minimum lot size requirement established
by the Weld County Zoning Resolution; variance from this requirement
being allowed only upon good cause being shown to the Board of County
Commissioners or where said tract or parcel of land lies within the
comprehensive plan area of an existing incorporated town of Weld
County. (Revised 4/17/74)"
If this lot size variance is granted, Mr. Ashbough will proceed
with his application for a recorded exemption to divide the property
into two lots . One lot is proposed to contain approximately 11 acres
with an existing set of improvements. The second lot is proposed
to contain approximately 41 acres with no existing residential
improvements. As indicated in a letter dated June 2 , 1977, Mr.
Ashbough desires to sell the existing improvements and the 11 acre
parcel and retain the 41 acre parcel for a new residential home
site for himself . A separate access exists for each of the two
proposed parcels in question.

Based upon the information submitted and the adopted policies in
the County, the Planning Commission staff recommends the request
be approved for the following reasons:
1. The request complies with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural District
(Section 3. 3A of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan since non-productive agricultural
land is proposed to be split and utilized for residential
purposes which would be compatible with land uses in the
surrounding area.
2. The 6 acre parcel in question has low utility for agricultural
use due to the small acreage involved and the poor soils under-
lying the property.
